AN ORDINANCE DECLARING FLOODWALL REMNANTS AS
SURPLUS PROPERTY AND APPROVING AND AUTHORIZING
THE MAYOR TO EXECUTE PLAT AND QUITCLAIM DEEDS TO
THE CURRENT PROPERTY OWNERS ADJOINING THE
SURPLUS PROPERTY FOR ECONOMIC DEVELOPMENT
PURPOSES
WHEREAS, during the late 1930s the City of Paducah began acquiring certain
real property in the vicinity of the old Husbands Road for the "C" portion of the proposed
Floodwall construction; and
WHEREAS, by Indenture from the Paducah & Illinois Railway Company dated
December 22, 1938, of record in Deed Book 200, page 188, in the McCracken County Clerk's
office and Indenture from J. Lawrence Jones and wife, Clara Jones, dated January 11, 1939, of
record in Deed Book 200, pagel86, in the aforesaid clerk's office, the City of Paducah acquire an
interest in and to a certain 20' by 400' strip of land (the "Surplus Property") for purposes of the
floodwall construction; and
WHEREAS, the City of Paducah have determined that the Surplus Property is no
longer necessary, appropriate, or in the best interests of the operations of the floodwall and that
the Subject Property should be deemed surplus substandard real estate having no true value; and
WHEREAS, the City of Paducah wishes to quitclaim the Surplus Property to the
current land owners of the parent tract from which the Surplus Property was carved, without
consideration; and
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. Recitals and Authorizations. The Board of Commissioners hereby
declares the Surplus Property to be surplus property as it relates to the operations of the
floodwall.
SECTION 2. Recitals and Authorizations. The Board of Commissioners hereby
further approves the transfer of a portion of the Surplus Property to Lots of Wheels, LLC, a
Kentucky limited liability company, and a portion of the Surplus Property to MAEGAH
Properties & Development, Inc., a Kentucky corporation, as their interest may appear, the current
owners of the parent tract from which the Surplus Property was acquired, by quitclaim and for
the consideration of $1.00, subject to any access easement rights, if any, that the City Engineer
deems necessary over, through and alone the Surplus Property. .
SECTION 3. Recitals and Authorizations. That the Mayor of the City of
Paducah, Kentucky is hereby authorized to retain the services of a professional land surveyor for
the preparation of plat -depicting the Surplus Property and the execution of said plat; and further
authorized to execute and deliver quitclaim deeds of the Surplus Property to Lots of Wheels,
LLC, and MAEGAH Properties & Development, Inc., respectively, as their interests may appear,
