At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City Hall at 7:00 p.m., Tuesday, June 1, 1993, Mayor Montgomery presided, and upon call of the roll the following answered to their names: Commissioners Grumley, Hornsby, and Mayor Montgomery (3). Commissioner Feezor and Commissioner Taylor were absent (a.). MINUTES Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the reading of the Minutes for May 20, 25 and 27, 1993, be waived and that the Minutes of said meeting(s) prepared by the City Clerk be approved as written. Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby and Mayor Montgomery (3). MOTIONS R & F DOCUMENTS Commissioner Hornsby offered motion, seconded by Commissioner Grumley that the following documents be received and filed: 1. CEMETERY LOTS Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the Board of Commissioners approve 491 492 the sale of the following cemetery lot(s) and that the City Clerk be authorized to execute a Deed of Conveyance for said cemetery grave(s): N. 1. Coretta Caffey, Rushing Addition to Oak Grove Cemetery, Sec. 6, Lot 151 SE, in the amount of $225.00 (Receipt No. 1478) 2. MUNICIPAL ORDERS PERSONNEL CHANGES Commissioner Hornsby offered motion, seconded by Commissioner Grumley that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders that the personnel changes on the attached list be approved: (SEE MUNICIPAL ORDER BOOK) Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby and Mayor Montgomery (3). ORDINANCES - INTRODUCTION \p PURCHASE VAN FOR PUBLIC WORKS DEPT. Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH CENTRAL CHEVROLET IN THE AMOUNT OF $12,086.00 FOR THE PURCHASE OF ONE 1994 DODGE VAN, FOR USE BY THE PUBLIC WORKS DEPARTMENT." The foregoing title summarizes the contents of this ordinance. '! AMEND SECTION 2-297 (B)(4) - HUMAN RIGHTS COMMISSION " Commissioner Hornsby offered motion, seconded by Commissioner Grumley that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTION 2-297(B)(4) OF ARTICLE XVI, 'HUMAN RIGHTS COMMISSION,' OF CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY." This ordinance is summarized as follows: That upon approval of the Board of Commissioners of the City of Paducah the Human Rights Commission may employ an executive director, attorneys, hearing examiners, clerks and other employees and agents as are required to carry out the duties and powers of the Commission. Y DEED OF CONVEYANCE FOR PADUCAH INDEPENDENT SCHOOL DISTRICT Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A DEED TO THE BOARD OF EDUCATION OF THE PADUCAH INDEPENDENT SCHOOL DISTRICT AND THE PADUCAH INDEPENDENT SCHOOL DISTRICT FINANCE CORPORATION RECOVEYING CERTAIN PROPERTIES FROM THE CITY THROUGH THE BOARD TO THE CORPORATION ORIGINALLY CONVEYED TO THE CITY IN CONNECTION WITH SCHOOL BUILDING REVENUE BOND ISSUES." This ordinance is summarized as follows: That the Mayor and City Clerk shall be and they are hereby authorized to execute a Deed reconveying to the Board JUNE 1, 1993 493 and the Corporation those properties previously conveyed to the City in connection with the Prior Bonds; said reconveyance shall be subject to the rights, if any, of the owners of the Prior Bonds so long as any of same remain outstanding and unpaid. Said reconveyance shall be made in accordance with the provisions of KRS 162.120 through 162.290 and the respective bond ordinances pursuant to which the Prior Bonds were authorized. FINAL SUBDIVISION APPROVAL FOR JOE PITTARD Commissioner Hornsby offered motion, seconded by V Commissioner Grumley that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY AND DEVELOPMENT PLAN OF JOE PITTARD LOCATED ON 3475 SAVOY CIRCLE AND 1112 ROBINWOOD DRIVE." The foregoing title summarizes the contents of this ordinance. FINAL ANNEXATION OF PADUCAH INFORMATION AGE PARK Commissioner Hornsby offered motion, seconded by Commissioner Grumley that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS". This ordinance is summarized as follows: Annexing territory known as the Information Age Park into the City of Paducah located west of and adjacent to the present city limits, along U.S. Highway 60. ORDINANCES - ADOPTIONS CHANGE ORDER NO. 2 WITH MOTOROLA COMMUNICATIONS INC. Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the Board of Commissioners adopt an - ordinance entitled, "AN ORDINANCE APPROVING CHANGE ORDER NO. 2 FOR ADDITIONAL RADIO EQUIPMENT WITH MOTOROLA COMMUNICATIONS INC. INCREASING THE TOTAL CONTRACT AMOUNT TO A SUM NOT TO EXCEED $981,049.00, AND AUTHORIZING THE MAYOR TO EXECUTE SAME." The foregoing title summarizes the contents of this ordinance. PURCHASE 2 DUMP TRUCKS Commissioner Hornsby offered motion, seconded by Commissioner Grumley that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT WITH NAVISTAR INTERNATIONAL CORPORATION IN THE AMOUNT OF $100,000.00 FOR THE PURCHASE OF TWO INTERNATIONAL 4900 SERIES CREW CAB CHASSIS TRUCKS, FOR USE BY THE DEPARTMENT OF ENVIRONMENTAL AND ENGINEERING SERVICES AND THE PUBLIC WORKS DEPARTMENT." APPROVAL OF GRANT AGREEMENT BETWEEN GPEDC AND COMMONWEALTH Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING A GRANT AGREEMENT BETWEEN KENTUCKY'S STATE PROPERTY AND BUILDINGS COMMISSION AND CABINET FOR ECONOMIC DEVELOPMENT AND GPEDC FOR GRANT PROCEEDS UP TO $2,200,000.00." This ordinance is summarized as follows: Approving a grant agreement by and between Kentucky State Property and Buildings Commission and Cabinet for Economic Development with GPEDC wherein the Commonwealth of Kentucky is JUNE 1, 1993 to provide $2,200,000.00 to GPEDC for the purposes of developing the Project known as the Paducah Information Age Park. AMEND AGREEMENT BETWEEN GPEDC AND THE CITY OF PADUCAH Commissioner Hornsby offered motion, seconded by Commissioner Grumley that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE APPROVING AN AMENDMENT TO PURCHASE AGREEMENT BETWEEN THE CITY OF PADUCAH AND G.P.E.D.C., INC., AND AUTHORIZING AN OPTION TO PURCHASE." This Ordinance is summarized as follows: Approving an agreement to purchase agreement between the City and GPEDC wherein GPEDC will be allowed to retain excess rentals paid by TeleService over loan payments to be made to the local Paducah banks, and additionally, to accord to GPEDC an option to purchase the old Florsheim building for an amount equal to the City's loan balance with the Commonwealth of Kentucky, which loan was procured by the City to purchase the aforesaid building. 0P -L>- No. 93-4--':'944. 0RAD. la1C ZS. APPROVE CONTRACT FOR COLEMAN ROAD Commissioner Grumley offered motion, seconded by Commissioner Hornsby that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT BETWEEN THE DEPARTMENT OF RURAL AND MUNICIPAL AID, COMMONWEALTH OF KENTUCKY, AND THE CITY OF PADUCAH, KENTUCKY, FOR PLACING BITUMINOUS SURFACE ON COLEMAN ROAD FROM U.S. 60 AND EXTENDING NORTHERLY TO CHARTER OAK ROAD." The foregoing title summarizes the contents of this ordinance. DISCUSSIONS The following items were discussed: (1) Trash Pickup (2) Cemetery Appearance (3) Property Upkeep Procedure (4) Noise Nuisance Ordinance (5) Mosquito Problem - State will not handle the spraying for mosquitoes this year. (6) Budget Review for Thursday, June 3, 1993 and June 7, 1993 are cancelled (7) Discussion of Section 28-9, "Sale of Goods, Wares and Merchandise on Streets, Sidewalks or Alleys," of the Paducah Code of Ordinance Bonnie Alsobrook, owner of Port -O -Call, discussed the permits that are obtained for use of the sidewalk for the selling of goods or other. EXECUTIVE SESSION Commissioner Hornsby offered motion, seconded by Commissioner Grumley that the Board go into closed session for discussion of matters pertaining to the following topics: (1) Proposed or pending litigation (2) Issues which might lead to the appointment, dismissal, or disciplining of an employee; as permitted by KRS 61.810(1)(f). Adopted on call of the roll, yeas, Commissioners Grumley, Hornsby and Mayor Montgomery (3). Commissioner Hornsby offered motion, seconded by Commissioner Grumley to reconvene in open session. JUNE 1, 1993 Mayor Montgomery offered motion, seconded by Commissioner Grumley that the Board of Commissioners authorize an increase in payments to retirees covered by the Police & Firefighters' Pension Fund in the amount of 3.1% retroactive to July 1992.
