ROLL CALL
At a Regular Meeting of the Board of Commissioners held in the
Commission Chambers at City Hall at 6:00 p.m., Tuesday,
October 22, 1996, Mayor Jones presided, and upon call of the
roll by the City Clerk, the following answered to their names:
Commissioners Coleman, Grumley, Hornsby and Mayor Jones (4).
Commissioner Renfro was absent (1).
PRESENTATION OF DUKE AND DUCHESS AWARDS
Mayor Jones joined Mr. and Mrs. Milton Childress at the podium
and presented them with Duke and Duchess awards. .
Mr. Childress will be a honorary Grand Marshal of the Veterans
Day Parade to be held in Paducah on November 11, 1996. Mr.
Childress is the oldest known veteran of World War I. At age
24, Pvt. Childress was a member of the U.S. Army's Battery E,
5th Regiment at Camp Zachary Taylor, KY, ready for action
against German forces attacking Europe in 1917. As a trained
artillery man, he had prepared himself to do battle with the
Germans during World War I, but before he could get to Europe he
was hospitalized with flu, and Germany surrendered. He is 102
years and 10 months of age and resides in Marion, Crittenden
County, Kentucky. He and Mrs. Childress have been married 76
years. Their only child, a daughter, and only grandchild, a
granddaughter, also joined them at the podium.
PRESENTATION OF LITTLEVILLE HISTORY BY WALTER BEASLEY
Walter Beasley read 1900 newspaper articles detailing the
history of Littleville. Littleville was named after J.W.
Little, a native of Dresden, TN, who purchased a large tract of
land which would later be named "Littleville". Mr. Little
started a spoke factory on his property.
Mr. Beasley also read a newspaper article about Hiram Blow, who
started a stave factory in Littleville around the turn of the
century.
ECONOMIC TRIP TO TUPELO, BY COMMISSIONER GRUMLEY, ET AL
Mayor Jones asked Commissioner Grumley to report on his recent
economic development trip to Tupelo, Mississippi, with a group
which included Chamber of Commerce staff. Commissioner Grumley
said two of the individuals who made this trip will give reports
at the November 12 Commission Meeting.
MINUTES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the reading of the minutes for October 8, and 15,
1996, be waived and that the minutes of said meeting as prepared
by the City Clerk be approved as written. Adopted on call of
the roll, yeas, Commissioners Coleman, Grumley, Hornsby, and
Mayor Jones (4).

Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the following documents be received and filed:

Commissioner Hornsby offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners approve the sale of
the attached cemetery lot(s) and authorize the City Clerk to
execute Deeds of Conveyance for same:
1. Frank Brown, Rushing Addition to Oak Grove Cemetery, Sec.
6, Lot 130 NE, in the amount of $225 (Receipt No. 22353)
2. Mae Anna Brown, Rushing Addition to Oak Grove Cemetery,
Sec. 6, Lot 130 NW, in the amount of $225 (Receipt No. 22345)

MUNICIPAL ORDER
PERSONNEL CHANGES
Commissioner Hornsby offered motion, seconded by Commissioner
Grumley, that upon the recommendation of the City Manager, the
Board of Commissioners of the City of Paducah orders that the
personnel changes on the attached list be approved:

VETERANS DAY PARADE ON NOV. 11TH
Mayor Jones gave the parade route for the Veterans Day Parade.
Gayle Frye said transportation in the parade will be provided by
the City. The parade will begin at approximately 11:11 a.m.,
J to correspond with the signing of the Armistice Treaty which
ended World War I in 1918. Mayor Jones told Ms. Frye to re-
contact high schools in surrounding cities, including Southern
Illinois, to try to get a band for the parade. He said the
City of Paducah will -pay a band's travel expenses to partici-
pate in the parade. Mayor Jones also urged employers to allow
time off for their employees who are eligible to be in the
parade.
ORDINANCES - ADOPTION
ATTORNEY FEES FOR DEMOLITIONS
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE AUTHORIZING THE CITY TO COLLECT AND
JRECOVER REASONABLE ATTORNEY FEES AND OTHER COSTS AND EXPENSES
INCURRED IN THE COLLECTION AND ENFORCEMENT OF LIENS FOR THE
REASONABLE VALUE OR LABOR AND MATERIALS USED IN ABATING
NUISANCES". This ordinance is summarized as follows:
Authorizing the City to collect and recover from any
responsible party or parties reasonable attorney fees and other
costs and expenses incurred by the City by reason of the
collection upon and the enforcement of the responsible party or
parties' liability, and the lien which secures same, which
shall include liens for abatement of nuisance by demolition.

Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE ESTABLISHING THE AMOUNT TO BE CHARGED
FOR CONNECTING TO CITY SANITARY SEWERS CONSTRUCTED BY THE CITY
KNOWN AS LITTLEVILLE SANITARY SEWER EXTENSION, PHASE I, AND
PROVIDING FOR THE ISSUANCE OF CONNECTION PERMITS, PROVIDING FOR
THE PAYMENT OF CONNECTION CHARGES, AND PROVIDING PENALTIES FOR
VIOLATION OF THE PROVISIONS HEREOF". The foregoing title

Commissioner Hornsby offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE ESTABLISHING THE AMOUNT TO BE CHARGED
FOR CONNECTING TO CITY SANITARY SEWERS CONSTRUCTED BY THE CITY

II, PROVIDING FOR THE ISSUANCE OF CONNECTION PERMITS, PROVIDING

EXERCISE AN OPTION TO RENEW A CONTRACT WITH CENTRAL PAVING CO.
OF PADUCAH INC. FOR RENTAL OF VARIOUS EQUIPMENT FOR THE 1996-97

Commissioner Hornsby offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE PROVIDING FOR THE CONDEMNATION OF LANDS
NECESSARY TO CONSTRUCT A PUBLIC RIGHT-OF-WAY FROM U.S. HIGHWAY 60
ACROSS PROPERTY OWNED BY KENTUCKY OAKS MALL COMPANY, TEACHERS
RETIREMENT SYSTEM OF THE STATE OF KENTUCKY, AS LEASED TO WAL-MART
STORES, INC. AND SERVICE MERCHANDISE COMPANY INC. AND ANY NECESSARY
TEMPORARY CONSTRUCTION EASEMENTS AND DEMONSTRATING THE NEED FOR
SAID CONDEMNATION". This ordinance is -.summarized as follows:
Directing the corporation counsel to institute or to continue
condemnation proceedings in McCracken Circuit Court in the name of
the City of Paducah against Kentucky Oaks Mall Company, Service

possessory interests in the land over which the public right-of-way

Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A
CONSIDERATION CERTIFICATE FOR KENTUCKY AVENUE BETWEEN 27TH
STREET AND 28TH STREET". This ordinance is summarized as follows:
Authorizing and directing the Mayor to execute a Consideration
Certificate included in a Quitclaim Deed whereby the Commonwealth
of Kentucky conveys to the City of Paducah that portion of

AMEND ORDINANCE FOR "NON -TRANSPORTATION USE OF VEHICLES AND
TRAILERS IN DOWNTOWN BUSINESS DISTRICT"
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 19-173(C) OF ARTICLE
IX, 'NON -TRANSPORTATION USE OF VEHICLES AND TRAILERS IN THE
DOWNTOWN BUSINESS DISTRICT' OF THE CODE OF ORDINANCES OF THE
CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as
follows: Setting forth guidelines for issuance of permits for use
of vehicles and trailers in the Downtown Business District.

Commissioner Hornsby offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE FIXING THE LEVIES AND RATES OF TAXATION
ON ALL PROPERTY IN THE CITY OF PADUCAH, KENTUCKY, SUBJECT TO
TAXATION FOR MUNICIPAL PURPOSES AND FOR SCHOOL PURPOSES FOR THE
JPERIOD FROM JULY 1, 1996, THROUGH JUNE 30, 1997, WITH THE
PURPOSES OF SAID TAXES THEREUNDER DEFINED".

ORDINANCES - INTRODUCTION
RENAME TOURIST COMMISSION
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 33.195, BY RENAMING THE
PADUCAH-McCRACKEN COUNTY RECREATIONAL TOURIST AND CONVENTION
COMMISSION, OF TITLE III, ADMINISTRATION, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is
summarized as follows: Changing the name of Paducah -McCracken
County Recreational Tourist and Convention Commission to
"Paducah -McCracken County Convention and Visitors Bureau".
REDUCE MINIMUM SEWER & WATER RATE INSIDE CITY LIMITS
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners introduce an ordinance
entitled:

"AN ORDINANCE AMENDING SECTION 51.164 OF CHAPTER 51,
'SEWERS', OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY
"BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
"SECTION 1. That Section 51.164, 'Rates Established
for Premises Inside City Limits', of Chapter 51, 'Sewers', of the
Code of Ordinances of the City of Paducah, Kentucky, is hereby
amended to read as follows:
'Rates and charges for use of the service and facili-
ties of the municipal sewer system for premises
inside the corporate limits of the City as such
limits presently exist and as the same may be ex-
tended from time to time in the future, shall be at
the rate of $2.50 per 1,000 gallons of water used,
provided the minimum sewer bill shall be $10/00 7.50
per month for the first SJOOO 3,000 gallons or less
of water consumption.'
"SECTION 2. These decreases shall become effective

Commissioner Hornsby offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE CHANGE ORDER NO. 1 IN THE AMOUNT OF $5,494.15 WITH
MURTCO INC. FOR LITTLEVILLE SEWER EXTENSION -PHASE I". The
foregoing title summarizes the contents of this ordinance.
DEMOLITION FINDINGS
Commissioner Hornsby offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners receive the following
disclosures, adopt the following findings, and make said
disclosures and findings a part of the official public records
of the City of Paducah:
1. The following property located in the City of Paducah is in
a state of disrepair, is beyond rehabilitation, and poses a
threat to public health and safety:

referenced structures for and on behalf of the City, is in
the best interest of the City by virtue of price,
experience and immediate availability.
4. During performance of the agreement contemplated herein,
Howle shall be acting as an independent contractor of the
city and performing said services in an off-duty capacity.

ACCEPT HOWLE DEMOLITION BIDS
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the bid of Kenneth Howle, a city employee acting
as an independent contractor in an off-duty capacity, be
accepted as being in the the best interest of the City of
Paducah by virtue ofprice, experience and immediate
availability, and that an ordinance accepting this bid and
authorizing that a contract be presented for enactment by the
City Commission. Adopted on call of the roll, yeas,

Commissioner Hornsby offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE ACCEPTING THE BID OF KENNETH HOWLE IN
THE AMOUNT OF $1,600 FOR DEMOLITION OF A CONDEMNED STRUCTURE
LOCATED AT 827 SOUTH STH STREET IN THE CITY OF PADUCAH, AND
AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". This
ordinance is summarized as follows: Accepting the bid of Kenneth
Howle in the amount of $1,600 for demolition of a condemned
structure located at 827 South 5th Street, and authorizing the
Mayor to execute a contract for same.
EXECUTIVE SESSION
J Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board go into closed session for discussion
of matters pertaining to the following topics:

1. Future sale or acquisition of a specific parcel(s) of real
estate, as permitted by KRS 61.810(1)(b).

At the conclusion of the executive session the Board reconvened
in open session, whereupon the Mayor announced there was no
further business.
Upon motion the meeting adjourned.

Commissioner Hornsby offered motion, seconded by Commissioner Grumley, that
the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE

UNDER THE MARTIN LUTHER KING , JR., AREA HOUSING INITIATIVE PROJECT IN THE
CITY OF PADUCAH, AND AUTHORIZING THE MAYOR TO EXECUTE CONTRACTS FOR SAME".
This ordinance is summarized as follows: Accepting the bids of Kenneth
Howle in the aggregate amount of $15,600 for demolition of condemned
structures under the Martin Luther King, Jr., Area Housing Initiative
Project, and authorizing the Mayor to execute contracts for same.
