ROLL CALL
At a Regular Meeting of the Board of Commissioners held in the Commission Chambers at City
Hall at 6:00 p.m., Tuesday, May 28, 1996, Mayor Jones presided, and upon call of the roll by the
Asst. City Clerk, the following answered to their names: Commissioners Coleman, Grumley,
Hornsby, Renfro and Mayor Jones (5).
DISCUSSIONS
Gayle Frye, Director of the Dept. of Parks, along with Dale Gentner and Pat Earles, explained the
programs offered for children at different areas throughout the City called the Summer �.
Playground Program and Nutrition Program. There will be a new program starting in the
afternoons at the housing projects called the Neighborhood Sports Program.
Rick Murphy, Director of Dept. of Engineering, explained the issue of dilapidated alleys in the
City. They are a major concern. He feels the major problem has been a lack of maintenance.
John Bichon, Grounds Resource Specialist for the Dept. of Parks and Bob Shapiro, concerned
citizen, discussed the issue of the removal and replacement of trees along Broadway.
Problems of the treeb- are as follows:
1. Planters and sidewalks are being cracked by roots.
2. Trees are hanging over buildings.
3. Size of trees are too big to be safe.
MINUTES
Commissioner Coleman offered motion, seconded b Commissioner Grumley, that the reading of
the Minutes for April 23, May 6 and May 14, 19967 be waived and that the Minutes of said
meeting prepared by the City Clerk be approved as written.

CEMETERY LOTS
Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of
Commissioners approve the sale of the attached cemetery lot(s) and authorize the City Clerk to
execute a Deed of Conveyance.
1. Elizabeth S. Brown, Mausoleum Addition to Oak Grove Cemetery, Sec. 3, Lot
20 grave 7, in the amount of $375.00 (receipt no. 22286).
2. Vivian George, Rushing Addition to Oak Grove Cemetery, Sec. 6, Lot 133 NW,
in the amount of $225.00 (receipt no. 22283).

Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that upon the
recommendation of the City Manager, the Board of Commissioners of the City of Paducah orders
that the personnel changes on the attached list be approved.

NEGOTIATE SALE OF PROPERTY AT SOUTH 2ND STREET
Commissioner Coleman offered motion, seconded by Commissioner Grumley, that a municipal

DISPOSE Olt PROPERTY ON SOUTH 2ND STREET", be adopted.

EXECUTE AGREEMENT FOR THE WOODLANDS SUBDIVISION
Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of
Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING
AND DIRECTING THE MAYOR TO EXECUTE AN AGREEMENT, EASEMENT AND
QUITCLAIM DEED BY AND BETWEEN THE WOODLANDS, INC., ET AL, AND THE
CITY OF PADUCAH FOR THE WOODLANDS SUBDIVISION". The foregoing title
summarizes the contents of this ordinance.

POLICE & FIRE FIGHTERS' PENSION FUND
Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of
Commissioners adopt an ordinance entitled, "AN ORDINANCE INCREASING THE
MINIMUM MONTHLY PAYMENT FOR PARTICIPANTS IN THE POLICE AND FIRE
FIGHTERS' RETIREMENT FUND OF THE CITY OF PADUCAH, KENTUCKY". This
ordinance is summarized as follows: Increasing the minimum monthly payment to $400 for any
participant in the Police and Fire Fighters' Retirement Fund, effective June 1, 1996.

Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of 9 -
Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTIONS
10-52 & 10-59, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH, KENTUCKY". This ordinance is summarized as follows: Increasing the salary of
the positions of Maintenance Person #1 in the Public Works Dept./Facility Maintenance Division
and the Department of Parks from $11.05 to $11.57, and decreasing the number of positions of
Maintenance Person #1 in the Department of Parks from 4 to 2.

AUTHORIZE CONTRACT FOR CODE SUPPLEMENTS
Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of
Commissioners adopt and ordinance entitled, "AN ORDINANCE AUTHORIZING AND ✓
DIRECTING THE MAYOR TO EXECUTE A PROFESSIONAL SERVICES CONTRACT
WITH MUNICIPAL CODE CORPORATION FOR SUPPLEMENTING THE CODE OF
ORDINANCES FOR THE CITY OF PADUCAH, KENTUCKY". The foregoing title
summarizes the contents of this ordinance.

Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of
Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE
INSTITUTION OF LEGAL PROCEEDINGS ON BEHALF OF THE ELECTRIC PLANT
BOARD OF THE CITY OF PADUCAH, D/B/A PADUCAH POWER SYSTEM TO ACQUIRE ✓
BY CONDEMNATION THE ELECTRIC PLANT AND FACILITIES OF JACKSON
PURCHASE ELECTRIC COOPERATIVE CORPORATION LYING WITHIN THE
MUNICIPAL BOUNDARIES OF THE CITY OF PADUCAH, KENTUCKY." This ordinance
is summarized as follows: This ordinance is made in response to the request by the Electric Plant
Board of the City of Paducah for the City's initiation of condemnation proceedings, on behalf of
the Electric Plant Board, the proceedings will seek to acquire, for the Electric Plant Board, the
Electric Plant and facilities of Jackson Purchase Electric Cooperative Corporation lying within the
municipal boundaries of the City of Paducah.
Bill Graves, spoke on behalf of Ballard County, because their rates will go up if ordinance is
passed.
Ray McLennan, spoke on behalf of Paducah Power System.
A spokesperson for JPECC asked that JPECC be able to present their side of the issue to the
Board at the next meeting. The Mayor agreed and set the following ground rules:

One spokesperson for Paducah Power System could speak first for 15 minutes at the next meeting
and one spokesperson could speak for JPECC for 15 minutes. Then Paducah Power System will
be allowed a 5 minute rebuttal.
AMEND CHAPTER 101, STREETS AND SIDEWALKS
Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of
Commissioners adopt an Ordinance entitled, "AN ORDINANCE CREATING SECTIONS
101.15 THROUGH 101.21, 101.3 5 THROUGH 101.3 6, 101.40 THROUGH 101.442 AND
101.60 THROUGH 101.61 OF CHAPTER 101, STREETS AND SIDEWALKS OF THE CODE
OF ORDINANCES OF PADUCAH, KENTUCKY." This ordinance is summarized as follows:
Defines responsibilities within the City's right of way in regards to sidewalks, curb and gutter,
entrances, driveway pipes, etc., defines bonding and insurance responsibilities in regards to
construction within the City right of way, establishes notice and lien procedure, and gives the City
Engineer the ability to enforce and/or suspend any unauthorized work as it relates to Section 101
- Streets and Sidewalks.
AMEND CHAP. 110, GROSS RECEIPTS TO LICENSE TAX
Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the
that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING
SECTION 110.115(D) OF CHAPTER 110, GROSS RECEIPTS TO LICENSE TAX OF THE
PADUCAH CODE OF ORDINANCES REDEFINING "GROSS RECEIPTS." This ordinance is
summarized as follows: Redefining the term gross receipts to include the owners' cost of
construction as determined by the Building and Electrical Inspector.
AMEND SECTION 110.115(A) OF CHAP. 110, GROSS RECEIPTS TO LICENSE TAX
Commissioner Hornsby offered motion, seconded by Commissioner Renfro, that the Board of
Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION
110.115(A) OF CHAPTER 110, GROSS RECEIPTS TO LICENSE TAX OF THE PADUCAH
CODE OF ORDINANCES REDEFINING BUILDERS/CONTRACTORS/TRADESMEN."
This ordinance is summarized as follows: Redefining the term builders/contractors/tradesmen to
include an owner who performs functions under this section excepting owners who construct their
own residence.
AMEND SECTION 150.30(A) OF CHAP. 150, BUILDING REGULATIONS
Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of
Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 150.30
(A) OF CHAPTER 150, BUILDING REGULATIONS, OF THE CODE OF ORDINANCES OF
THE CITY OF PADUCAH, KENTUCKY, REDEFINING "COST OF CONSTRUCTION".
This ordinance is summarized as follows: Costs of construction shall be determined by the
Building and Electrical Inspector.
AMEND SECTION 90.04 OF CHAP. 90, ABANDONED VEHICLES AND APPLIANCES
Commissioner Coleman offered motion, seconded by Commissioner Grumley, that the Board of
Commissioners adopt an Ordinance entitled, "AN ORDINANCE AMENDING SECTION 90.04
OF CHAPTER 90, ABANDONED VEHICLES AND APPLIANCES, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY, AUTHORIZING THE
RECOVERY OF ATTORNEY FEES AND COSTS." This ordinance is summarized as follows:
Amending ordinance to entitle the City to recover attorney fees and other associated costs.

Commissioners adopt an ordinance entitled, "AN ORDINANCE AMENDING SECTION 99.04
OF CHAPTER 99, NUISANCES, OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH, KENTUCKY, AUTHORIZING THE RECOVERY OF ATTORNEY FEES AND
COSTS." This ordinance is summarized as follows: Amending ordinance to entitle the City to
recover attorney fees and other associated costs.
APPROVE CONTRACT FOR TREE AND BRUSH GRINDING
Commissioner Renfro offered motion, seconded by Commissioner Hornsby, that the Board of
Commissioners introduce an ordinance entitled, "an ordinance accepting the bid of environmental
wood recycling in an amount not to exceed $25,000, for tree and brush grinding at the City of
Paducah compost site, and authorizing the Mayor to execute a contract for same". The
foregoing title summarizes the contents of this ordinance.
AMEND CIVIL SERVICE SECTION 10-62, PLANNING AND BUILDING
Commissioner Coleman offered motion, seconded by Commissioner Grumley that the Board of
Commissioners introduce an ordinance entitled, "AN ORDINANCE AMENDING SECTION 10-
62, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY." This ordinance is summarized as follows: Increasing the number of positions of
Deputy Building Inspector from 3 to 4.
AUTHORIZE PAYMENT FOR SUMMER FOOD PROGRAM
Commissioner Grumley offered motion, seconded by Commissioner Coleman, that the Board of
Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE
CITY OF PADUCAH TO PAY TO THE PADUCAH INDEPENDENT SCHOOL SYSTEM AN
AMOUNT NOT T 0 EXCEED THE $46,800 FOR THE SUMMER FOOD PROGRAM FOR
CHILDREN'S LUNCHES." The foregoing title summarizes the contents of this ordinance.
