At a Called Meeting of the Board of Commissioners, held at
3:00 p.m., Tuesday, August 8, 1995, Mayor Montgomery presided,
and upon call of the roll by the City Clerk, the following
answered to their names: Commissioners Coleman, Grumley,
Hornsby, Renfro and Mayor Montgomery (5).
R & F NOTICES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Notices of Called Meeting for 3:00 p.m.,
August 8, 1995, be received and filed. Adopted on call of the
roll, yeas, Commissioners Coleman, Grumley, Hornsby,Renfro and
Mayor Montgomery (5).
EXECUTIVE SESSION
Commissioner Renfro offered motion, seconded by Commissioner
Grumley, that the Board go into closed session for discussion
of matters pertaining to the following topics:
1. Issues which might lead to the appointment, dismissal,' or
disciplining of an employee, as permitted by KRS
61.810(1)(f).
Adopted on call of the roll, yeas, Commissioners Coleman,
Grumley, Hornsby, Renfro and Mayor Montgomery (5).
At the conclusion of the Executive Session the Board reconvened
in Open Session, whereupon the Mayor announced there was no
further business.
Upon motion the meeting adjourned.

MINUTES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the reading of the Minutes for August 1, 1995, be
waived and that the Minutes of said meeting prepared by the
City Clerk be approved as written. Adopted on call of the
roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and
Mayor Montgomery (5).
APPOINTMENTS
PADUCAH GOLF COMMISSION
Mayor Montgomery made the following appointment: "WHEREAS, the
terms of Fred Kettler and William B. Sturgis as members of the
Paducah Golf Commission expired on March 26, 1995; and
WHEREAS, subject to the approval of the Board of Commissioners,
I hereby reappoint Mr. Kettler and Mr. Sturgis to said
e/ Commission, which terms will expire March 26, 1999."
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners approve the action of
Mayor Montgomery in reappointing Fred Kettler and William B.
Sturgis as members of the Paducah Golf Commission. Adopted on
call of the roll, yeas, Commissioners Coleman, Grumley,
Hornsby, Renfro and Mayor Montgomery (5).
HISTORICAL AND ARCHITECTURAL REVIEW COMMISSION
Mayor Montgomery made the following appointment: "WHEREAS,
subject to the approval of the Board of Commissioners, I hereby
reappoint Michael D. McDowell as a member of the Historical and
Architectural Review Commission, which term will expire June 4,
J 1999".
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners approve the action of
Mayor Montgomery in reappointing Michael D. McDowell as a
member of the Historical & Architectural Review Commission.
Adopted on call of the roll, yeas, Commissioners Coleman,
Grumley, Hornsby, Renfro and Mayor Montgomery (5).
PADUCAH PUBLIC LIBRARY BOARD OF TRUSTEES
Mayor Montgomery made the following appointment: "WHEREAS,
subject to the approval of the Board of Commissioners, I hereby
reappoint W. David Denton as a member of the Paducah Public
Library Board of Trustees, which term will expire June 14,
1999".
Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board of Commissioners approve the action of
Mayor Montgomery in reappointing W. David Denton as a member of
the Paducah Public Library Board of Trustees. Adopted on call
of the roll, yeas, Commissioners Coleman, Grumley, Hornsby,
Renfro and Mayor Montgomery (5).
MUNICIPAL HOUSING COMMISSION
Mayor Montgomery made the following appointment: "WHEREAS,
subject to the approval of the Board of Commissioners, I hereby
reappoint Frances Cooper as a member of the Municipal Housing
Commission, which term will expire July 22, 1999."

Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners approve the action of
Mayor Montgomery in reappointing Frances Cooper as a member of
the Municipal Housing Commission. Adopted on call of the roll,
yeas, Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor
Montgomery (5).
PADUCAH AREA TRANSIT AUTHORITY
Mayor Montgomery made the following appointments: "WHEREAS,
subject to the approval of the Board of Commissioners, I hereby
�l reappoint Michael W. Gish as a member of the Paducah Area
Transit Authority, which term will expire June 30, 1999; and
I hereby appoint Shirley Bunch as a member of said Board to '
fill the unexpired term of Debra Winmon, who has resigned.
This term will expire June 30, 1997.
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board approve the action of Mayor Montgomery
in reappointing Michael W. Gish and in appointing Shirley Bunch
as members of the Paducah Transit Authority. Adopted on call
of the roll, yeas, Commissioners Coleman, Grumley, Hornsby,
Renfro and Mayor Montgomery (5).

Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners approve the sale of
the attached cemetery lot(s) and authorize the City Clerk to
execute a Deed of Conveyance:
1. Hester Bonds, Old Addition to Oak Grove Cemetery,
Sec. 30D, Lot 105, in the amount of $225, receipt no.

2. Anna P. Senter, Rushing Addition to Oak Grove

Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners introduce and adopt an
ordinance entitled, "AN ORDINANCE AUTHORIZING THE PURCHASE OF
THREE 1995 FORD CROWN VICTORIA AUTOMOBILES FOR PAUL MILLER FORD INC.
✓ IN THE AMOUNT OF $48,532.50 FOR USE BY THE POLICE DEPARTMENT, AND
AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME.". The

Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 2-47, NONCIVIL SERVICE
Y/ GENERALLY, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY". This ordinance is summarized as follows: Increasing the
number of clerical assistants from one to five and creating the
one position for data entry operator in the Police Department.

Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A DEED
FOR THE PURCHASE OF REAL PROPERTY BY THE CITY OF PADUCAH FROM
IRENE WYNN FOR THE SUM OF $4,500, LOCATED AT 1201 SOUTH 4TH
STREET IN THE CITY OF PADUCAH, McCRACKEN COUNTY, KENTUCKY, WHICH
PROPERTY WILL BE USED FOR THE COMBINED SEWER OPERATION PLAN FOR THE
HUSBANDS STREET LIFT STATION". The foregoing title summarizes the

ADD WASTEWATER TREATMENT ACCOUNT TO EQUIPMENT RENTAL CONTRACT
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners introduce an ordinance ✓
entitled, "AN ORDINANCE AMENDING ORDINANCE NO 95-7-5313
AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE A CONTRACT WITH
CENTRAL PAVING CO. OF PADUCAH INC. FOR RENTAL OF VARIOUS EQUIPMENT
FOR THE 1995-96 FISCAL YEAR". This ordinance is summarized as
follows: Authorizing an additional budgetary account number for
the rental of various equipment.
ADOPT ALL FUTURE EDITIONS OF BOCA NATIONAL PROPERTY MAINTENANCE
CODE UPON ISSUANCE OF SAME
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance ✓
entitled, "AN ORDINANCE ADOPTING ALL FUTURE EDITIONS OF THE
BOCA NATIONAL PROPERTY MAINTENANCE CODE UPON ISSUANCE OF SAME,
AND AMENDING SECTION PM -110.1 OF THE EXISTING CODE". This
ordinance is summarized as follows: Adopting all future
editions of the BOCA National Property Maintenance Code upon
issuance of same, and amending Sec. PM -110.1 (Property
Maintenance) as relating to the upgrade or repair of existing
structures.
AMEND SEC. 15-4 & 15-5 AND CREATE SEC. 15-7 OF CHAPTER 15,
HEALTH
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 15-4 AND 15-5 AND
CREATING SECTION 15-7 OF CHAPTER 15, HEALTH, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is
summarized as follows: Amending Sec. 15-4, "Accumulation of
rubbish or excessive growth of grass or weeds -declared unlawful",
by increasing the fine for violation of same, amending provisions
of Sec. 15-5, "Notice to remedy situation, action by city upon
noncompliance by owner", and creating Sec. 15-7, which establishes
a citation policy and a fine for violation of this policy.
AMEND CHAPTER 7, BUILDINGS & BUILDING REGULATIONS
Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE CREATING A NEW SECTION UNDER ARTICLE
I., CHAPTER 7, BUILDINGS AND BUILDING REGULATIONS, OF THE CODE
OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This
ordinance is summarized as follows: Establishing requirements and
regulations for registration of residential rental property with the
City of Paducah Department of Planning and Building.
AMEND CHAPTER 17 1/2, LITTER
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 17 1/2-21 AND CREATING
SECTION 17 1/2-23 OF CHAPTER 17 1/2, LITTER, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance is
summarized as follows: Amending Sec. 17 1/2-21, "Clearing of litter
from open private property by city", and creating Sec. 17 1/2-23,
which establishes a citation policy and a fine for violation of this
policy.
AMEND SEC. 19-4 OF CHAPTER 19, MISCELLANEOUS OFFENSES AND
PROVISIONS
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 19-4 OF CHAPTER 19,
MISCELLANEOUS OFFENSES AND PROVISIONS, OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY". This ordinance
was read in full. (This section is entitled, "Advertisements
on utlity poles or trees on or along streets, sidewalks,
etc."

AMEND CHAPTER 19, MISCELLANEOUS OFFENSES AND PROVISIONS
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 19-106 AND CREATING
SECTION 19-114 OF CHAPTER 19, MISCELLANEOUS OFFENSES AND
PROVISIONS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY". This ordinance is summarized as follows: Amending Sec.
19-106 by decreasing the number of days allowed for a property owner
to abate a public nuisance before said nuisance is removed and
abated by the city, and creating Sec. 19-114, which establishes a
citation policy and a fine for violation of this policy.
REZONE PROPERTY AT 3100 JACKSON STREET
Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND
V PRELIMINARY DEVELOPMENT PLAN FOR RESA DANESH LOCATED AT THE
CORNER OF JACKSON & LONE OAK RD; 3100 JACKSON, FROM R-4, HIGH
DENSITY RESIDENTIAL ZONE, TO B-1, CONVENIENCE AND SERVICE ZONE,
AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH
REZONING". This ordinance is summarized as follows: Changing
the zone at 3100 Jackson Street from R-4, High Density
Residential, to B-1, Service and Convenience Zone, and amending
the Paducah Zoning Ordinance so as to effect such rezoning.
REZONE 2703 TENNESSEE STREET
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE APPROVING THE FINAL REPORT OF THE
PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONE CHANGE AND
✓ PRELIMINARY DEVELOPMENT PLAN FOR PADUCAH SERVICE COMPANY LOCATED AT
2703 TENNESSEE STREET FROM R-2, LOW AND MEDIUM DENSITY RESIDENTIAL
ZONE, TO B-3, GENERAL BUSINESS ZONE, AND AMENDING THE PADUCAH
ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING". This ordinance i
summarized as follows: Changing the zone at 2703 Tennessee Street
from R-2, Low and Medium Density Residential, to B-3, General
Business Zone, and amending the Paducah Zoning Ordinance so as to
effect such rezoning.
ANNEX PROPERTY ON BLANDVILLE ROAD
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE FINALIZING THE ANNEXATION OF CERTAIN
VJ PROPERTY LYING ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF
PADUCAH, AND DEFINING ACCURATELY THE BOUNDARY OF SAID PROPERTY
TO BE INCLUDED WITHIN THE SAID CORPORATE LIMITS". This
ordinance is summarized as follows: Annexing property into the
City of Paducah adjacent to the present city limits along
Blandville Road.
DISCUSSIONS
1. Bob Cherry, Jr. discussed his concern with the ordinance
requiring landlords to register their rental property used for
residential purposes, as well as the other ordinances that were
introduced relating to real estate.
2. Ralph DeMartino, a landlord and real estate agent, said he
supports the City's cleanup efforts but hopes landlords are not
being "branded for prosecution" through the registration
process. He also said he hopes the codes are enforced on a
uniform basis for landlords and homeowners alike.
3. Gladman Humbles addressed the following topics:
A. His concern about landlord registration.
B. Semi -trailer truck taking a shortcut down Burnheim
Street to Park Avenue
C. A hold in the sidewalk at 1006 North 12th which he
first reported two years ago

Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board go into closed session for discussion
of matters pertaining to the following topics:
1. Future sale or acquisition of a specific parcel(s) of
real estate, as permitted by KRS 61.810(1)(b)
2. Collective bargaining with public employees, as
permitted by KRS 61.810(1)(e)
3. Issues which might lead to the appointment,
dismissal, or disciplining of an employee, as
permitted by KRS 61.810(1)(f).
At the conclusion of the Executive Session the Board reconvened
in open chambers and held a workshop.
Upon motion the meeting adjourned.
