ROLL CALL
At a Regular Meeting of the Board of Commissioners held in the
Commission Chambers at City Hall at 7:00 p.m., Tuesday,
March 21, 1995, Mayor Montgomery presided, and upon call of the
roll by the City Clerk, the following answered to their names:
Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor
Montgomery (5).
WITHDRAW ABC ORDINANCE
Commissioner Hornsby made the following request: "Mayor, I
request permission to withdraw a motion introduced on March 14,
1995, amending Chapter 3, Alcoholic Beverages, of the Code of
Ordinances of the City of Paducah".
Mayor Montgomery replied, "Unless there is object (pause) the
motion is withdrawn.
There being no objection, the motion was withdrawn.
DELPHINE OPERLE AND MAYOR MONTGOMERY reported on their trip to
Washington, D.C. on March 10 to attend a National League of
Cities Conference. Commissioner Grumley also attended this
conference with them.
Ms. Operle reported that the Mayor's and her airline tickets
were not paid for by the Cit . Mayor Montgomery won these
tickets at the Southern Gr Governors' Meeting in Nashville
last summer. Orrowiv
Mayor Montgomery reported that President Clinton was the major
speaker of the day. He spoke on Unfunded Mandates.
The Mayor also attended a Neighborhood Empowerment Seminar.
Commissioner Grumley will give his report at a later date.
MINUTES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the reading of the Minutes for March 14, 1995, be
waived and that the Minutes of said meeting prepared by the
City Clerk be approved as written. Adopted on call of the
roll, yeas, Commissioners Coleman, Grumley, Hornsby Renfro and
Mayor Montgomery (5).

Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners approve the sale of

ACCEPT'LETTER OF CREDIT FOR JULIANNE HEIGHTS (HIGDON PROPERTY)
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that a Municipal Order entitled, "A MUNICIPAL ORDER
APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION
RESPECTING THE PROPOSED SUBDIVISION OF PROPERTY OF PHILIP
HIGDON FOR JULIANNE HEIGHTS, LOCATED ON MINNICH AVENUE,,
ACCEPTING DEDICATION OF PUBLIC EASEMENTS AND A LETTER OF CREDIT
IN THE AMOUNT OF $16,000, be adopted. Adopted on call of the

ORDINANCES - ADOPTION
AMEND SEC. 28-10(a), SKATEBOARDS & LIKE DEVICES
Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE AMENDING SECTION 28-10(a) OF ARTICLE I,
CHAPTER 28, STREETS AND SIDEWALKS, OF THE CODE OF ORDINANCES OF
THE CITY OF PADUCAH, KENTUCKY". This ordinance is summarized
as follows: Amending Section 28-10(a) to prohibit any person
to ride upon or otherwise operate a skateboard or other like
device at the waterfront in the Downtown Business District.

WITHDRAW ORDINANCE TO PURCHASE AERIAL LIFT TRUCK FROM NAVISTAR
Commissioner Renfro made the following request: "Mayor, I
request permission to withdraw a motion introduced on January
10, 1995, accepting the bid of Navistar International
Corporation in the amount of $81,276 for the purchase of a 1995
refuse truck chassis with trash loader for use by the Solid
Waste Division."
Mayor Montgomery replied, "Unless there is object (pause) the
motion is withdrawn.

ORDINANCES =.:.INTRODUCTION
CHANGE ORDER NO. 1 - COMPOST EXPANSION
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE CHANGE
ORDER NO. 1 IN THE AMOUNT OF $7,246.15 FOR THE COMPOST FACILITY
EXPANSION PROJECT CONTRACT WITH A & K CONSTRUCTION, INC.,
INCREASING THE TOTAL CONTRACT AMOUNT TO $138,181.15, AND
AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The
foregoing title summarizes the contents of this ordinance.
ACCEPT TREE PLANTING BID
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE ACCEPTING THE BID OF JAMES SANDERS
NURSERY INC. IN THE AMOUNT OF $10,601 FOR TREE PLANTING IN
VARIOUS CITY PARKS AND ON VARIOUS CITY PROPERTY, AND AUTHORIZING
THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The foregoing title
summarizes the contents of this ordinance.
DISCUSSIONS
MAYOR MONTGOMERY announced that Dogwood Trail and Quilt
Festival Brochures are available at the Tourist Commission
Office.
COMMISSIONER COLEMAN discussed the problem with semi -trucks
traveling through residential neighborhoods and gave pertinent
data to the City Manager. Commissioner Coleman said he has
brought this problem to the Commission before.
CITY MANAGER HOOVER said the Traffic Commission is looking at
this problem. He said information needed is: Name and number
of truck, Trucking Company name, approximate time of day and
location of violation.
MAYOR MONTGOMERY asked if proper signage has been ,put up
prohibiting semi -trucks from restricted areas.
COMMISSIONER RENFRO said the Spring Clean Up date should be
announced again since some residents are already placing items
out to be picked up.
MAYOR MONTGOMERY re -read a News Release on this subject which
had been read at a previous Commission Meeting. There will be
free dumping at the landfill on April 1 and 8. There will be a
#2 charge per tire. Freon must be removed from all appliances
before being taken to the landfill.
CITY MANAGER HOOVER announced the following Fire Department
Commendations:
1. He read a letter from Bob Ruoff, Principal of Kentucky
Tech -Paducah Center, which was published in the February 26
edition of The Paducah Sun commending the actions of Assistant
Chief John Bohannon and Platoon No. 2, and also Assistant Fire
Chief Dick McNeil on February 1 during a school fire.
According to records, the response time was two minutes.
2. Read a letter from Fire Chief Gerald Stewart to Capt.
Ronald Hyatte, Lt. Ronald Alston and Firefighter Gregory
Buchanan commending them for their actions above and beyond the
call of duty after responding to an alarm on February 7.
Copies of the above commendations will be placed in each
employee's personnel file.
RAY McLENNAN, a City resident, told the Commission he is in
favor of reducing sewer, especially to Senior Citizens. He

would also like to see a 3,000 gallon minimum rate, which would
in effect reduce,.water bills by about $5.00. He would also
like to see''tfie`Commission explore the possibility of reducing
other user fees.
ED JONES of Barnett Street, discussed various topics, including
his attempt to clean up his property on Barnett Street.; He
objected to someone calling City Hall to report him piling
debris in his yard, as well as a letter he received from the
City concerning "unsightly debris, litter, etc. in his yard.
He complained because he could not find out who had called City
Hall and reported him. He also complained that someone had
reported him to the Fire Department for burning leaves on
Sunday, and complained because the Fire Department had put out
his fire. ,.o
Mayor Montgomery told Mr. Jones that the City has no
jurisdiction over the Clean Air Act which governs burning in
the City, and that it is controlled by the State.
City Manager Hoover told Mr. Jones he could call his office and
obtain a telephone number to call to register his complaints
about burning with the State.
EXECUTIVE SESSION
Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board go into closed session for discussion of
matters pertaining to the following topics:
1. A specific proposal by a business entity where public
J discussion of the subject matter would jeopardize the location,
retention, expansion or upgrading of a business entity, as
permitted by KRS 61.810(1)(g).

At the conclusion of the Executive Session the Board reconvened
in Open Session and held a Workshop.
Upon motion the meeting adjourned.
