AN ORDINANCE APPROVING AND ACCEPTING A CONTRACT FOR
COMPLETE INTERIOR RENOVATION OF 333 NORTH 16" STREET AND AUTHORIZING THE
MAYOR TO EXECUTE A CONTRACT FOR SAME
WHEREAS, the City's Procurement Code does not address what action may be taken
when no bids are received from a responsive and responsible bidder. Therefore, the City must look to the
Kentucky Model Procurement Code which has been adopted by the City (See Section 2-642). According
to KRS 45A.375(4) when competitive bidding has been sought and no response from bidders have been
received the local public agency may proceed to acquire the services through non-competitive
negotiations in accordance with KRS 45A.380; and
WHEREAS, KRS 45A.380(3) allows non-competitive negotiations when a written
determination is made that competition is not feasible and the contract is for the services of a licensed
professional such as a carpenter. Obviously, competition is not feasible since the City has advertised for
bids, conducted a pre-bid walk through with six local contractors, and has received no bids. Also, the
contractor who the city is considering awarding the contract is a locally licensed carpenter/contractor;
and
WHEREAS, in light of the foregoing, the city has elected to proceed with the negotiation
of the contract on a non-competitive basis in accordance with KRS 45A.380(3).
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves and accepts a contract as
attached hereto with Kepman Construction for the complete interior renovation of 333 North 16t" Street
in the amount of $68,759.00.
SECTION 2. The Mayor is hereby authorized to execute a contract with Kepman
Construction as approved and accepted in Section 1 above for the complete interior renovation of 333
North 17'11 Street.
SECTION 3. This expenditure shall be charged to Project Account Fountain Avenue
Project (CD -0040).
SECTION 4. This City Commission hereby finds and determines that all formal actions
relative to the adoption of this Ordinance were taken in an open meeting of this City Commission, and
that all deliberations of this City Commission and of its committees, if any, which resulted in formal
action, were in meetings open to the public, in full compliance with applicable legal requirements.
SECTION 5. This ordinance shall be read on two separate days and will become
effective upon summary publication pursuant to KRS Chapter 424.
