AN ORDINANCE AUTHORIZING AND DIRECTING THE FINANCE
DIRECTOR TO MAKE PAYMENT TO JIM SMITH CONTRACTING, LLC, FOR
THE EMERGENCY LABOR, MATERIALS, AND EQUIPMENT REQUIRED TO
PROTECT THE JULIAN CARROLL CONVENTION CENTER AND THE EXPO
CENTER DURING THE 2011 FLOOD
WHEREAS, the City of Paducah, in April of 2011, experienced
significant rainfall causing flooding within the City limits; and
WHEREAS, the Julian Carroll Convention Center and Expo Center were
both in jeopardy of flooding due to their location along the riverfront; and
WHEREAS, on Monday, April 24, 2011, the Mayor issued a State of
Emergency for the City of Paducah, in accordance with Sec. 30-2 of the Paducah Code of
Ordinances, due to the river forecasts; and
WHEREAS, knowing that time was of the essence for protection measures
to the Convention Center and Expo Center, a temporary levy was built to protect the
public's investment; and
WHEREAS, due to the State of Emergency proclaimed, procurement
procedures as set forth within the Paducah Code of Ordinances were not feasible.
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby authorizes and directs the
Finance Director to make payment in the amount of $420,004.55 to Jim Smith
Contracting, LLC, for the emergency labor, materials, and equipment required to protect
the Julian Carroll Convention Center and the Expo Center during the 2011 Flood.
SECTION 2. This expenditure authorized in Section 1 above shall be
charged to the 2011 Flood Account, Project No. FW0004.
SECTION 3. This ordinance shall be read on two separate days and will
become effective upon summary publication pursuant to KRS Chapter 424.
SECTION 4. This ordinance shall become effective upon the first reading
of this Ordinance.
