Commissioner Watkins was absent (1). MUNICIPAL ORDERS ADOPT FY2011-2012 POSITION AND PAY SCHEDULE Commissioner Abraham offered motion, seconded by Commissioner Gault, that a Municipal Order entitled, "A MUNICIPAL ORDER ADOPTING THE FY2011-2012 POSITION AND . PAY SCHEDULE FOR THE EMPLOYEES OF THE CITY OF PADUCAH, KENTUCKY," be adopted. Adopted on call of the roll, yeas, Commissioners Abraham, Gault, Kaler, and Mayor Paxton (4). MO.#1614; BK 8 ADOPT FY2011-2012 PAY GRADE SCHEDULE Commissioner Gault offered motion, seconded by Commissioner Abraham, that a Municipal Order entitled, "A MUNICIPAL ORDER ADOPTING THE FY2011-2012 PAY GRADE SCHEDULE FOR THE EMPLOYEES OF THE CITY OF PADUCAH, KENTUCKY," be adopted. MO#1615; BK 8 ESTABLISH SOLID WASTE RECYCLING PILOT PROGRAM Commissioner Kaler offered motion, seconded by Commissioner Abraham, that a Municipal Order entitled, "A MUNICIPAL ORDER PERTAINING TO A PILOT PROGRAM TO EXPLORE, STUDY AND INVESTIGATE THE INTEREST IN, NEED FOR AND FEASIBILITY OF CURBSIDE COLLECTION OF SOLID WASTE RECYCLABLES IN THE CITY OF PADUCAH, KENTUCKY," be adopted. Adopted on call of the roll, yeas, Commissioners Abraham, Gault, Kaler, and Mayor Paxton (4). MO.#1616; BK 8 ORDINANCE — EMERGENCY 2011/2012 KY RECYCLING GRANT AWARD Commissioner Kaler offered motion, seconded by Commissioner Abraham, that the Board of Commissioners introduce and adopt an ordinance entitled, "AN ORDINANCE OF THE CITY OF PADUCAH APPROVING A GRANT AGREEMENT WITH THE KENTUCKY ENVIRONMENTAL AND PUBLIC PROTECTION CABINET, DIVISION OF WASTE MANAGEMENT, FOR A 2011-2012 KENTUCKY RECYCLING GRANT; APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF PADUCAH AND McCRACKEN COUNTY FISCAL COURT FOR THE CITY'S ADMINISTRATION OF FUNDS RECEIVED FOR THE RECYCLING GRANT TO PURCHASE EQUIPMENT FOR THE VOLUNTEER OPERATED RECYCLING DROP-OFF CENTER LOCATED AT 1830 NORTH 8TH STREET AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS FOR THE RECYCLING AWARD ". This ordinance is summarized as follows: The City of Paducah hereby approves a recycling grant agreement with the Kentucky Environmental and Public Protection Cabinet, Division of Waste Management, for a 2011-2012 Kentucky Recycling Grant in the amount of $41,605 for the purchase of equipment to be used at the volunteer drop-off recycling center located at 1830 North 8`'' Street. A local match of $15,450 is required with the City of Paducah and County of McCracken contributing $7,725 each and Paducah Water Works providing in-kind donation of facility use of $7,790. The City of Paducah hereby accepts and agrees to administer the funds in an amount up to $41,605. Further, the City approves an Interlocal Agreement between the City and McCracken County for the City to act as the legal recipient and fiscal agent for the Recycling Grant funds and authorizes the Mayor to execute a contract for same. ORD#2011-6-7820; BK 32 -- - JUNE 21, 2011 ORDINANCES - ADOPTION LEGALIZATION OF SALE OF ALL FIREWORKS WITHIN CITY LIMITS Commissioner Gault offered motion, seconded by Commissioner Abraham, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE REPEALING CHAPTER 46, ARTICLE IV OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH WHICH PREVENTED THE SALE OF FIREWORKS EXCEPT FOR USE IN PERMITTED DISPLAYS; AND IN ITS PLACE ALLOWING ONLY THE USE OR IGNITION OF GROUND AND HAND-HELD SPARKLING DEVICES WITHIN THE CITY, EXCEPT FOR PERMITTED DISPLAYS PREVIOUSLY ALLOWED, AND FORMULATING A PERMITTING PROCESS FOR THE SALE OF CONSUMER FIREWORKS WITHIN THE CITY OF PADUCAH WHICH SHALL REQUIRE THOSE PERSONS OR ENTITIES ENGAGED IN THE SALE OF CONSUMER FIREWORKS TO OBTAIN A LOCAL BUSINESS LICENSE, APPLY FOR AND BE ISSUED A PERMIT BY THE STATE AND LOCAL FIRE AUTHORITIES, MEET FEDERAL, STATE AND LOCAL SAFETY STANDARDS, AND MAINTAIN, AT THEIR OWN EXPENSE, MINIMAL LEVELS OF LIABILITY INSURANCE; AND SETTING CRIMINAL PENALTIES." This ordinance is summarized as follows: This ordinance repeals Chapter 46, Article IV of the Code of Ordinances of the City of Paducah, relating to the permitted use and sale of fireworks within the City of Paducah. Such article restricted the use of consumer fireworks to permitted displays only and the sale of fireworks for wholesale only. As in the case of the previous ordinance, this ordinance allows the use of ground and hand-held sparkling devices and fireworks in permitted displays. This ordinance also provides a permitting process for the sale of consumer fireworks by retailers provided that the retailer pay a permit fee to the City of Paducah, obtain a business license and obtain a certificate of occupancy. This ordinance imposes the following criminal penalties: Any person convicted of violating Chapter 46 of the Code of Ordinances of the City of Paducah shall be fined not less than fifty dollars ($50) nor more than one thousand dollars ($1,000), or confined in the county jail for not more than thirty (30) days, or both. Each day a violation occurs shall constitute a separate offense. Adopted on call of the roll, yeas, Commissioners Abraham, Gault, Kaler and Mayor Paxton (4). ORD#2011-6-7821; BK 32 ORDINANCE — INTRODUCTION WALL TO WALL MURAL MAINTENANCE CONTRACT Commissioner Kaler offered motion, seconded by Commissioner Gault, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY FOR THE SOLE SOURCE PURCHASE FOR ANNUAL MAINTENANCE OF THE WALL-TO-WALL MURALS LOCATED ON THE CITY OF PADUCAH'S FLOODWALL ALONG WATER STREET." This ordinance is summarized as follows: That the Finance Director of the City of Paducah, Kentucky, is hereby authorized to pay to Herb Roe the total amount of $22,050, for annual maintenance of the Wall-toWall murals located on the City of Paducah's floodwall along Water Street. CITY MANAGER REPORT No report was given COMMISSIONER COMMENTS Commissioner Kaler read an email she received from John and Carla Berry. Mr. and Mrs. Berry thanked the Fire Department for its response to extinguish a fire at an apartment located on Minnich Avenue.
