ADDITIONS/DELETIONS Ordinances -Adoption Item IV (B) CDBG Award Jackson House Elevator System Project Legally Binding Agreement was removed from the agenda. i PRESENTATIONS TREE PLANTING ON JEFFERSON STREET Cindy Jones, Representative of Paducah Garden Club, gave a presentation about the Club's choice of long-term project "Restoring Tree Canopy on Jefferson Street". The Garden Club will be celebrating its 100th Anniversary in 2013 and wanted a project that would serve the community. They chose the planting of trees along Jefferson Street due to the destruction caused by the 2009 Ice Storm. Their goal is to plant 100 trees along Jefferson Street by the year 2013. Once the trees are planted the Garden Club will continue to maintain the trees. UPCOMING LEGISLATION 2012 SESSION J.D. Chaney, Director of Governmental Affairs for Kentucky League of Cities, gave a legislative update for bills enacted by the 2011 Kentucky General Assembly that affect local governments. He also gave a preview of items of interests that KLC will be discussing in 2012 with legislators such as retirement, classification of cities, revenues and alcohol control. SPOTLIGHT Pam Spencer, Public Information Officer, spotlight was the "Noble Park Pool House Renovations". Renovations were completed by staff from Engineering -Public Works and Parks Departments. MINUTES Commissioner Abraham offered motion, seconded by Commissioner Gault, that the reading of the Minutes for the May 10th and May 17th, 2011, meetings be waived and that the Minutes of said meetings prepared by the City Clerk be approved as written. MUNICIPAL ORDER PERSONNEL CHANGES Commissioner Kaler offered motion, seconded by Commissioner Watkins, that upon the recommendation of the City Manager, the Board of Commissioners of the City of Paducah order that the personnel changes on the attached list be approved. AMEND POSITION AND PAY SCHEDULE FOR FINANCE, INSPECTION, POLICE, FIRE, EPW, PARKS, AND TEMPORARY POSITIONS Commissioner Watkins offered motion, seconded by Commissioner Kaler, that a Municipal Order entitled, "A MUNICIPAL ORDER AMENDING SECTIONS A, B, C, D, E, F, G, H, I, AND M OF THE POSITION AND PAY SCHEDULE TO REFLECT ABOLISHING A POSITION IN THE GENERAL GOVERNMENT DEPARTMENT, FILLING VACANCIES IN THE INSPECTION AND FIRE DEPARTMENTS, SHOWING VACANCIES IN THE FIRE, FINANCE, AND ENGINEERING -PUBLIC WORKS DEPARTMENTS, SHOWING MERIT INCREASES, AND FIRE AND POLICE LONGEVITY CHANGES," be adopted. M.O.#1610; BK8 ORDINANCES — ADOPTION JACKSON HOUSE ELEVATOR REHABILITATION CDBG AWARD PROCUREMENT CODE ADOPTION Commissioner Abraham offered motion, seconded by Commissioner Gault, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE ADOPTING A PROJECT -SPECIFIC PROCUREMENT CODE FOR THE JACKSON HOUSE ELEVATOR REBHABILITATION PROJECT". This ordinance is summarized as follows: This Ordinance authorizes the City of Paducah, Kentucky, to adopt a project - specific procurement code for the purchasing procedures pertaining to the Community Development Block Grant awarded to the City of Paducah for the Jackson House Elevator Rehabilitation Project. Adopted on call of the roll, yeas, Commissioners Abraham, Gault, Kaler, Watkins and Mayor Paxton (5). ORD.# 2011-5-7815; BK 32 PURCHASE PORTABLE RADIOS FOR THE POLICE DEPARTMENT Commissioner Kaler offered motion, seconded by Commissioner Watkins, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY FOR THE SOLE SOURCE PURCHASE AND PROGRAMMING OF PORTABLE RADIOS FOR THE PADUCAH POLICE DEPARTMENT." This ordinance is summarized as follows: That the City of Paducah hereby authorizes the Finance Director to make payment to Motorola Solutions, Inc. in the amount of $21,600.00, for purchase and programming of fifteen portable radios for the Paducah Police Department. ORD.# 2011-5-7816; BK 32 APPROVE PURCHASE OF IN CAR CAMERAS Commissioner Watkins offered motion, seconded by Commissioner Kaler, that the Board of Commissioners adopt an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY L-3 COMMUNICATIONS/MOBILE VISION MAY 24, 2011 FOR THE SOLE SOURCE PURCHASE OF DIGITAL IN -CAR CAMERAS TO BE USED BY THE PADUCAH POLICE DEPARTMENT AND AUTHORIZING THE MAYOR TO EXECUTE ALL DOCUMENTS RELATING TO SAME." This ordinance is summarized as follows: That the City of Paducah hereby authorizes the Finance Director to make payment to L-3 Communications/Mobile Vision, in the amount of $38,360.00, for purchase of eight digital in -car cameras to be used by the Paducah Police Department and authorizes the Mayor to execute all documents relating to same. ORD.# 2011-5-7817; BK 32 ORDINANCES — INTRODUCTION AUTHORIZE PAYMENT TO AES ENVIRONMENT LLC FOR HOUSEHOLD HAZARDOUS WASTE COLLECTED DURING 2011 CLEAN UP DAY Commissioner Abraham offered motion, seconded by Commissioner Gault, that the Board of Commissioners introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING THE FINANCE DIRECTOR TO PAY AES ENVIRONMENTAL LLC, FOR THE DISPOSAL OF HOUSEHOLD HAZARDOUS WASTE COLLECTED DURING THE CITY/COUNTY FREE CLEAN-UP DAY." This ordinance is summarized as follows: That the Finance Director is hereby authorized to pay AES Environmental LLC, in the amount of $29,788.89 for the disposal of household hazardous waste collected during the City/County free Clean -Up Day. LEGALIZATION OF FIREWORKS WITHIN CITY LIMITS Commissioner Gault offered motion, seconded by Commissioner Abraham, that the Board of Commissioners introduce an ordinance entitled, "ORDINANCE REPEALING CHAPTER 46, ARTICLE IV OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH WHICH PREVENTED THE SALE OF FIREWORKS EXCEPT FOR USE IN PERMITTED DISPLAYS; AND IN ITS PLACE ESTABLISHING REASONABLE HOURS BETWEEN WHICH FIREWORKS MAY BE USED WITHIN THE CITY AND FORMULATING A PERMITTING PROCESS FOR THE SALE OF CONSUMER FIREWORKS WITHIN THE CITY OF PADUCAH WHICH SHALL REQUIRE THOSE PERSONS OR ENTITIES ENGAGED IN THE SALE OF CONSUMER FIREWORKS TO OBTAIN A LOCAL BUSINESS LICENSE, APPLY FOR AND BE ISSUED A PERMIT BY THE STATE AND LOCAL FIRE AUTHORITIES, MEET FEDERAL, STATE AND LOCAL SAFETY STANDARDS, AND MAINTAIN, AT THEIR OWN EXPENSE, MINIMAL LEVELS OF LIABILITY INSURANCE; AND SETTING CRIMINAL PENALTIES." This ordinance is summarized as follows: This ordinance repeals Chapter 46, Article IV of the Code of Ordinances of the City of Paducah, relating to the permitted use and sale of fireworks within the City of Paducah. Such article restricted the use of consumer fireworks to permitted displays only and the sale of fireworks for wholesale only. This ordinance establishes set times and dates during which consumer fireworks can be ignited and set- off in the City of Paducah without acquiring a permit, provided that all federal and state laws and regulations are followed. The ordinance also provides a permitting process for the sale of consumer fireworks by retailers provided that the retailer pay a permit fee to the City of Paducah, obtain a business license and obtain a certificate of occupancy. As in the case of the previous ordinance, this ordinance does not regulate ground and hand- held sparkling devices. Instead, the ordinance is aimed at aerial devices such as roman candles and bottle rockets, and audible ground devices such as firecrackers. This ordinance imposes the following criminal penalties: Any person convicted of violating Chapter 46 of the Code of Ordinances of the City of Paducah shall be fined not less than fifty dollars ($50) nor more than one thousand dollars ($1,000), or confined in the county jail for not more than thirty (30) days, or both. Each day a violation occurs shall constitute a separate offense. CITY MANAGER REPORT • Mr. Pederson distributed a handout regarding the 2011 Neighborhood Walks. He has suggested the walks be held the first Saturday of the month except for July (because of the holiday). The first walk will be the neighborhood adjacent to the MAY 24, 2011 property to be developed as part of the MSU campus. The walk will be held on Saturday, June 4th, at 10:00 a.m. Informed the Commission that the insurance costs for property, casualty, and liability insurance will be decreased by $75,000 next year. Due to the resignation of the Human Resources/Budget Analyst, the opportunity is open to change the position to Human Resources Director/Risk Manager. Mr. Pederson will be coming forward with a recommendation in the near future. COMMISSIONER COMMENTS Commissioner Watkins asked that the Lower Town Arts & Music Festival, Human Rights Evening of Performance and Fountain Avenue Neighborhood events not be held on the same weekend next year. PUBLIC COMMENTS C. R. Pulley, III, requested the ordinances that prohibit firearms in public parks be repealed. He feels the ordinances the City has in effect are unenforceable.
