ROLL CALL
At Regular Meeting of the Board of Commissioners held in the
Commission Chambers at City Hall at 7:00 p.m., Tuesday,
April 26, 1994, Mayor Montgomery presided, and upon call of the
roll by the City Clerk, the following answered to their names:
T Commissioners Coleman, Grumley, Hornsby, Renfro, and Mayor
Montgomery (5).
MINUTES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the reading of the minutes for April 12 and 19,
1994, be waived that the minutes of said meetings prepared by
the City Clerk be approved as written. Adopted on call of the
roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro,
and Mayor Montgomery (5).
EXECUTIVE SESSION
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners go into Executive
Session for discussions concerning a meeting or meetings
between public agencies and industrial prospects, as permitted
by KRS 61.810(7). Adopted on call of the roll, yeas,
Commissioners Coleman, Grumley, Hornsby, Renfro and Mayor
Montgomery (5).
At the conclusion of the Executive Session the Board reconvened
in Open Session, whereupon the Mayor called the meeting back to
order.

Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the following bids for various vehicles for
various departments be received and filed:

CEMETERY LOTS
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners approve the sale of
the attached cemetery lot and that the City Clerk is hereby
authorized to execute a Deed of Conveyance for said cemetery
lot.
1. Althlee Blanton, Rushing Addition to Oak Grove Cemetery,

EXECUTIVE SESSION FOR EMPLOYEE GRIEVANCE HEARING
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners go into closed session
to discuss issues which might lead to the appointment,
r/ dismissal or disciplining of an employee; as permitted by KRS
61.810(1)(f). Adopted on call of the roll, yeas, Commissioners
Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5).
The notes taken by the City Clerk during this session are
contained in a separate file.
At the conclusion of the Executive Session, the Board
reconvened in Open Session, whereupon the Mayor called the
meeting back to order.
MUNICIPAL ORDERS
PERSONNEL CHANGES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners of the City of Paducah
orders that the personnel changes on the attached list be
approved.

CITY TO JOIN LYON COUNTY RECYCLING CENTER
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that a Municipal Order entitled, "A MUNICIPAL ORDER
AUTHORIZING THE CITY OF PADUCAH TO JOIN WITH McCRACKEN COUNTY
f IN BECOMING A MEMBER OF THE LYON COUNTY RECYCLING CENTER", be
adopted. Adopted on call of the roll, yeas, Commissioners
Coleman, Grumley, Hornsby, Renfro and Mayor Montgomery (5).
Lyon County Judge/Executive McKinney welcomed the City to their
recycling program and expressed his interest in having the City
of Paducah as a partner in this endeavor.
ORDINANCES - INTRODUCTION
AMEND 1993-94 BUDGET
Commissioner Hornsby offered motion, seconded by Commissioner
Renfro, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AMENDING ORDINANCE 93-6-4956, ENTITLED,
V/ "AN ORDINANCE ADOPTING THE CITY OF PADUCAH, KENTUCKY, ANNUAL
BUDGET FOR THE FISCAL YEAR JULY 1, 1993, THROUGH JUNE 30, 1994,
BY ESTIMATING REVENUES AND RESOURCES AND APPROPRIATING FUNDS
FOR THE OPERATION OF CITY GOVERNMENT". This ordinance is
summarized as follows: Reappropriating various funds in the
1993-94 budget.
AMEND CIVIL SERVICE SEC. 10-59(b)
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE CREATING SUBSECTION (b) OF SECTION
10-59, CIVIL SERVICE, OF THE CODE OF ORDINANCES OF THE CITY OF
PADUCAH, KENTUCKY". This ordinance is summarized as follows:
Creating the position of lead person in the Parks and Leisure
Services Department.

DEED OF RELEASE OF EASEMENT
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE A DEED
OF RELEASE OF EASEMENT GRANTING A PERMANENT, PERPETUAL UTILITY
EASEMENT UNTO THE CITY OF PADUCAH FOR A PORTION OF 22ND STREET
AND AN UNNAMED ALLEY OFF 21ST STREET NEAR BROOKS STADIUM AND
MAYFIELD ROAD". This ordinance is summarized as follows:
Authorizing the Mayor to execute a Deed of Release of Easement for
property in the vicinity of 22nd Street and 21st Street near Brooks
Stadium and Mayfield, Road, and authorizing the Corporation Counsel
to prepare said Deed of Release of Easement.
FIRE FIGHTER CONTRACT
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners introduce an ordinance
entitled, "AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN
AMENDMENT OF AGREEMENT WITH THE PROFESSIONAL FIRE FIGHTERS OF
PADUCAH, LOCAL 168, INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS,
AMENDING AN AGREEMENT ENTERED INTO ON SEPTEMBER 1, 1978, AND LAST
AMENDED ON JULY 1, 1991". This ordinance is summarized as follows:
Authorizing the Mayor to execute an Amendment of Agreement with the
Professional Fire Fighters, Local 168, International Association of
Fire Fighters, retroactive to July 1, 1993.

Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE AMENDING SEC. 22-1 OF ARTICLE I,
CHAPTER 22, PARKS AND RECREATION, OF THE CODE OF ORDINANCES OF THE
CITY OF PADUCAH, KENTUCKY". This ordinance is summarized as
follows: Amending the method by which opening hours of City public
parks may be determined, and amending the penalty for violation of
entering or remaining in said parks during closed hours.

entitled, "AN ORDINANCE ACCEPTING THE PROPOSAL OF PECK FLANNERY
GREAM WARREN INC. IN AN AMOUNT NOT TO EXCEED $12,500.00 FOR
ARCHITECTURAL SERVICES FOR PHASE I OF AN IN-DEPTH STUDY OF CITY HALL
STRUCTURE, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR

Commissioner Coleman offered motion, seconded by Commissioner

CONTRACTORS INC. IN THE AMOUNT OF $39,287.00 FOR RENOVATION OF

DISCUSSIONS
A. PUBLIC FORUM
1. Charles Luney, International Union Representative for
AFSCME, asked the Commission to open talks with AFSCME
✓ employees and read a letter which he gave the Commission. A
copy of this letter is contained in the Minute File for this
date.
B. CITY MANAGER DISCUSSIONS:
1. Discussed acquisition of vehicles for:
Community Development -Sec. 8 1 vehicle
Public Works 1 vehicle (van)
DEES 2 vehicles
Police Dept. -Animal Warden 1 vehicle (truck)
'Z Paul Erickson, Purchasing Agent, explained reasons for the
necessity to make these purchases at this time (i.e., state
contract prices to expire).
The City Manager gave copies of ordinances for the above
purchases to the Board, which were distributed by the City
Clerk.
Mayor Montgomery instructed Mr. Erickson to bid all future
purchases to enable local merchants to have the opportunity to
bid.
Mr. Pennington recommended making these purchases at this time.
2. Mileage Reimbursement for use of personal car for city
business. Recommended increasing reimbursement from 22 to 29
cents per mile to comply with Federal regulations. Mayor
Montgomery inquired about room and meal allowances and asked
that they also be reviewed. Mr. Pennington will present a
revised travel policy which will comply with Federal per diem.
3. Police and Fire Fighter Pension Fund. Reported that the
Police and Fire Fighter Pension Board has recommended a 3% COLA
increase, per memo from the Pension Board. City Manager
requested instruction from the Commission, who directed him to
proceed with an ordinance granting the 3% increase. The
Commission (Board) further instructed Mr. Pennington to have
the Finance Director provide the required city funds for this
increase.
MOTION TO PAY 3% COST OF LIVING INCREASE TO RETIRED POLICE AND
FIRE FIGHTERS
Commissioner Hornsby offered motion, seconded by Commissioner
v1 Coleman, that the Board of Commissioners direct the City
Manager to instruct the City Treasurer to pay a 3% increase to
the Police and Fire Fighters Pension Fund. Adopted on call of
the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro
and Mayor Montgomery (5).
C. COMMISSION:
COMMISSIONER COLEMAN DISCUSSIONS:
1. Household Hazardous Waste Collection. Read bulletin
from LWD concerning this subject. Collection
scheduled for Saturday, April 30, 1994.

2. Neighborhood Empowerment Committee Meetings. Gave
upcoming meeting schedule for these meetings which
will be at various times and locations in the
community.
COMMISSIONER GRUMLEY DISCUSSIONS:
1. National Day of Prayer on May 5, 1994.
2. Need for two-way TV Network by Fire Department.
/'- Comcast will install if City will purchase.
MOTION AUTHORIZING PURCHASE OF 2 -WAY TV NETWORK FOR FIRE DEPT.
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners authorize the purchase
of a 2 -way TV network for the Fire Department with funds from
the franchise fees which are paid by Comcast Cable. Motion
received unanimous approval of the Board of Commissioners.
COMMISSIONER HORNSBY DISCUSSIONS:
1. Discussed a letter concerning an award selecting the
Forester Grant as the No. 1 grant proposal for Tree
Planting Grants. He read a letter complimenting Ken
Heppner for this grant.
COMMISSIONER RENFRO DISCUSSIONS:
1. APWA letter concerning inclement weather last
January. City Clerk does not have copy of letter.
2. Tapes concerning flood gate installation, etc.
MAYOR MONTGOMERY DISCUSSIONS:
1. Kiwanis Club quonset but on Broadway. Agreement
between Kiwanis and City for use of this building.
They proposed using it for Childwatch for for St.
Francis Clinic. Instructed City Manager to write a
letter authorizing this facility for these
activities. Commission concurred.
2. Use of Jetton Building. Requested input to be
discussed at a meeting to be held at City Hall.
3. City -County joint meeting tomorrow (Feb. 27) at 4:30
p.m. at City Hall. Read agenda aloud.
4. Thanked groups and individuals for their cooperation
and assistance during last week's Quilt Show.

$13,011.83 FOR USE BY THE PUBLIC WORKS DEPARTMENT, FACILITY
MAINTENANCE DIVISION, AND AUTHORIZING THE MAYOR TO EXECUTE A

Commissioner Hornsby offered motion, seconded by Commissioner

entitled, "AN ORDINANCE AUTHORIZING THE PURCHASE OF TWO 1994
FORD TAURUS AUTOMOBILES FROM BILL COLLINS FORD IN THE AMOUNT OF
$26,032.00 FOR USE BY THE DEPARTMENT OF ENVIRONMENTAL AND
ENGINEERING SERVICES, AND AUTHORIZING THE MAYOR TO EXECUTE A

EXECUTIVE SESSION
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board go into closed session for discussion
of matter pertaining to the following topic:
f 1. Issues which might lead to the appointment, dismissal
or disciplining of an employee; as permitted by KRS
61.810(1)(f).

REASSIGN POLICE CAPT. BILL GORDON TO NARCOTICS UNIT
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, to allow Chief McGinty to reassign Captain Bill Gordon
to the Narcotics Unit, but without any internal investigation
powers; and Chief McGinty should select some other employee to
immediately begin training to fill in or eventually be able to
act as commander. Adopted on call of the roll, yeas,
Commissioners Coleman, Grumley, Hornsby and Mayor Montgomery
(4). Commissioner Renfro voted nay (1).
