A MUNICIPAL ORDER RATIFYING THE MAYOR'S SIGNATURE
FOR PRELIMINARY APPROVAL TO RECEIVE COMMUNITY DEVELOPMENT
BLOCK GRANT FUNDS THROUGH THE COMMONWEALTH OF KENTUCKY,
OFFICE OF THE GOVERNOR, DEPARTMENT FOR LOCAL GOVERNMENT IN
THE AMOUNT OF $1,000,000 FOR THE PADUCAH JACKSON HOUSE
ELEVATOR REHABILITATION PROJECT CDBG#10-109
WHEREAS, the Office of the Governor, Department for Local
Government by letter dated April 4, 2011, granted preliminary approval to the City for
the Paducah Jackson House Elevator Rehabilitation Project based upon the acceptance of
conditions within the letter attached hereto; and
WHEREAS, the letter was executed on April 6, 2011, and it is necessary
to ratify the Mayor's acceptance of the conditions.
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby ratifies the Mayor's
signature accepting the conditions as set out by letter dated April 4, 2011, attached
hereto, from the Office of the Governor, Department for Local Government, for the
Paducah Jackson House Elevator Rehabilitation Project CDBG#10-109. This acceptance
of conditions will affirm to the Department for Local Government to proceed with a grant
agreement for Community Development Block Grant funds in an amount not to exceed
$1,000,000.
SECTION 2. This Order shall be in full force and effect from and after
the date of its adoption.

On behalf of Governor Steven L. Beshear and the staff of the Department for Local
Government (DLG), we wish to congratulate you on your selection as a recipient of Community
Development Block Grant (CDBG) funds. Preliminary approval has been granted for the above
referenced project in an amount not to exceed $1,000,000. This approval is contingent upon your
acceptance of the conditions outlined below:
1. The applicant provides assurance that it will enter into a grant
agreement by May 31, 2011.
2. The applicant will accept the funding level shown above.
3. The applicant will bear all cost overruns.
4. The applicant will provide assurance that the project will be advertised for
bid within three (3) months and a contract awarded within four (4) months
from the date of the executed grant agreement. If the project cannot be
advertised for bid and under contract within this time frame, the applicant
will inform DLG that it will not accept the funding, but will instead re-
apply when the project is ready to bid.
5. The applicant will provide assurance that the project's design is in
compliance with all Americans with Disabilities Act (ADA) and Uniform
Federal Accessibility Standards (UFAS) requirements.
6. The applicant will enter into a legally binding agreement with the West
Kentucky Seniors Center Union Labor Housing Corporation regarding the
occupancy, programming, administration, maintenance, repair, and

insurance of the facility. The agreement must also clearly establish the
terms and conditions under which the CDBG funding is provided and
establish a legal basis for action if those terms and conditions are not
met.—Finally,--the-agreement-should contain the five (5) year after closeout
provisions and program income provisions, if applicable.
Please indicate your acceptance of these conditions by signing below. Please return
this signed document to our office by April 29, 2011. Following receipt of your signature a
grant agreement will be prepared. Once the grant agreement has been drafted, DLG staff will
contact you to schedule a grant agreement meeting.
Please note that you may not incur any costs to be reimbursed with CDBG funds, except
for certain costs relating to planning and architectural services, until you have entered into a
grant agreement with the Commonwealth and received Environmental Clearance. Also, you
cannot obligate any other project funds until you have received Environmental Clearance from
DLG. Any costs incurred or obligations made prior to receiving a fully executed copy of the
grant agreement are at your own risk.
