MUNICIPAL ORDER NO. 1879
A MUNICIPAL ORDER OF THE CITY OF PADUCAH, KENTUCKY,
APPROVING THE ESTABLISHMENT OF AN ACCOUNT WITH FREEDOM
WASTE SERVICE, LLC FOR THE HANDLING AND DISPOSAL OF
MUNICIPAL SOLID WASTE
WHEREAS, as of December 31, 2015, the City of Paducah's contractual
arrangement with Republic Services of Kentucky, LLC, terminated; and
WHEREAS, as of January 1, 2016, the City of Paducah will be direct hauling all
municipal solid waste to the Mayfield facilities of Freedom Waste Service, LLC ("Freedom");
and
WHEREAS, the City of Paducah must establish an account with Freedom so that
Freedom may receive, handle and dispose of the City of Paducah's municipal solid waste.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF PADUCAH, KENTUCKY, AS FOLLOWS:
SECTION I. Recitals and Authorization. The City hereby approves the
establishment of an account with Freedom Waste Services, LLC, for the receiving, handling and
disposal of the City of Paducah's municipal solid waste. The City Manager is hereby authorized
to execute any and all documentation necessary for the establishment of this account.
SECTION 2. Severability. If any section, paragraph or provision of this
Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or
unenforceability of such section, paragraph or provision shall not affect any of the remaining
provisions of this Ordinance.
SECTION 3. Compliance With Open Meetings Laws. The City Commission
hereby finds and determines that all formal actions relative to the adoption of this Order were
taken in an open meeting of this City Commission, and that all deliberations of this City
Commission and of its committees, if any, which resulted in formal action, were in meetings
open to the public, in full compliance with applicable legal requirements.
SECTION 4. Conflicts. All ordinances, resolutions, orders or parts thereof in
conflict with the provisions of this Order are, to the extent of such conflict, hereby repealed and
the provisions of this Order shall prevail and be given effect.
SECTION 5. Effective Date. This Order shall be in full force and effect on and
after the date as approved by the Board of Commissioners of the City of Paducah, Kentucky.
