At a Called Joint Meeting of the Board of Commissioners and
the McCracken County Fiscal Court, held in the Commission
Chambers at City Hall, Paducah, Kentucky, at 4:00 p.m.,
Wednesday, October 26, 1994, McCracken County
Judge/Executive Orazine called the meeting to order.
Present were City Commissioners Grumley, Hornsby, Renfro and
Mayor Montgomery (4). McCracken County Fiscal Court members
present were Commissioners Bradford, Cope, McNeil and
Judge/Executive Orazine (4).
Also present were City Attorneys W. David Denton and David
Kelley, McCracken County Attorney Fred Grimes, City Manager
Jerry Hoover and City Clerk Lenita Smith.
R & F NOTICES
Commissioner Grumley offered motion, seconded by Commis-
sioner Hornsby, that the executed copies of the Notice of
Called Meeting to be held at 4:00 p.m., Wednesday, October
26, 1994, be received and filed. Adopted on call of the
roll, yeas, Commissioners Grumley, Hornsby, Renfro and Mayor
Montgomery (4).
Mr. Denton gave a brief history of proceedings to date and
reviewed the terms of the proposed contract between the
City, County and Commercial Waste Disposal Inc. (CWDI) for
disposal of solid waste.
Carlos E. Aguero, President of Continental Waste Industries
Inc. entertained questions from the City and County Boards.
Mr. Aguero gave the following answers to items discussed:
1. Convenience station opening days and hours will be
determined by the City and County.
2. Satellite station locations have not been determined at
this time. This will also be a joint City -County effort.
3. Station locations are subject to change pursuant to the
needs of the City and County.
4. A different leased site will be available if the North
8th Street site is unacceptable to City and County. No
definite plans have been made concerning the 8th street
site.
5. Debris such as junk auto parts will be accepted at the
collection site.
6. A program will be worked out for dead animal disposal.
No problems anticipated, but disposal procedure will require
proper pre -handling of dead animals.
7. Construction (building) time for transfer station is
estimated at 8 weeks. Time from permitting to completion
estimated from 3 to 6 months.
Mayor Montgomery thanked Mr. Aguero for accommodating the
City and County by his attendance at today's meeting.
Mr. Denton suggested that this project begin as soon as
possible. He gave the Commissions an ordinance to consider
for introduction at this time. This ordinance will require
two successive readings, on two different dates. It will
not be necessary that the City and County give the ordinance
its second and final reading at a joint City/County meeting;
i.e., it can be adopted at separate City and County
meetings.
A recess was called at this time for the County to conduct a
further review of the proposed documents.

At the conclusion of the recess, Judge/Executive Orazine
called the meeting back to order.
Commissioner Cope offered motion, seconded by Commissioner
Bradford, that Contract No. 1 between Commercial Waste
Disposal Inc, the City of Paducah, and the County of
McCracken be adopted.
Following are excerpts from discussion held at this time:
Mayor Montgomery stated that the City of Paducah has no
problem with the proposed contract except with the host
fees, which seem to be a tax placed on the citizens of the
City and County in addition to taxes which they already pay.
She said that upon investigation it has been determined that
no other cities in the State of Kentucky have this fee
imposed on them by a County. It is her opinion that this is
an unfair tax placed on the citizens of the City of Paducah,
and regardless of what it is called, it is still a tax, and
the City Commission feels it is unfair to put it on the
citizens of Paducah.
Commissioner McNeil replied that the County has landfill
closing expenses and ongoing expenses for household waste
and toxic waste disposal, and they have no way to raise
money for these expenses except with the host fee, and that
these burdens are borne solely by the County. He said he is
willing to pay an extra fee to help the County fulfill its
landfill obligations.
Mayor Montgomery replied that the City (residents) paid all
costs to close the City landfill, and that City residents
pay County taxes also.
Judge/Executive Orazine said he feels the proposed contract
is good for both the City and County and that the costs for
transferring recyclables to Lyon County can be assumed by
the County in return for assessing the $1 host fee on the
City.
Mayor Montgomery said City citizens paid for closing the
City landfill and have therefore already paid their fair
share of landfill closing costs. She said recycling
expenses are a legitimate charge and feels the City should
probably pay its share of this expense. She suggested that
the City and County discuss the host fee at a later date and
that the ordinance be introduced at this time. She further
suggested that the City and County resolve the host fee
issue between first and second readings of the ordinance.
Commissioner Grumley agreed.
Mr. Denton said a change in the host fee would require
modification of the contract, but that other issues can be
made by Supplemental Agreement.
At this time the County voted unanimously on their motion
to introduce the ordinance by and between the City of
Paducah, McCracken County and Commercial Waste Disposal
Inc., whereby Commercial Waste Disposal Inc. shall serve as
the disposal contractor for solid waste and certain other
wastes. (Motion introduced above)
It was decided that Mayor Montgomery and City Manager Hoover
will represent the City in meetings with the County to
resolve contract issues.
Ray McLellan, an interested citizen, asked if CWDI financial
statements have been considered. Mr. Denton replied in the
affirmative. Mr. Hoover replied that the City is waiting
for additional verifications, and Mayor Montgomery said

positive verifications were received today. Mr. Denton said
CWDI's 1994 viability is extremely good and if the new stock
goes through their net worth will be approximately $30
million. Mr. Hoover said he is satisfied at this time that
CWDI is capable and qualified and that their financial
standing will be noted before the final ordinance reading.
Mr. Grimes said he is of the opinion that CWDI is solid.
ORDINANCE INTRODUCTION

APPROVE SOLID WASTE CONTRACT WITH COMMERCIAL WASTE DISPOSAL
INC. (CWDI) BETWEEN CITY, COUNTY & CWDI
Commissioner Hornsby offered motion, seconded by
Commissioner Grumley, that the Board of Commissioners �.
introduce an ordinance entitled, "AN ORDINANCE AUTHORIZING
THE MAYOR TO EXECUTE A CONTRACT BY AND BETWEEN THE CITY OF
PADUCAH, McCRACKEN COUNTY, AND COMMERCIAL WASTE DISPOSAL,
INC., WHEREBY COMMERCIAL WASTE DISPOSAL, INC., SHALL SERVE AS
THE DISPOSAL CONTRACTOR FOR SOLID WASTE AND CERTAIN OTHER
WASTES".
Upon motion the meeting adjourned at approximately 5:50 p.m.
