ROLL CALL
At a Regular Meeting of the Board of Commissioners held in the
Commission Chambers at City Hall at 7:00 p.m., Tuesday,
October 18, 1994, Mayor Montgomery presided, and upon call of
_ the roll by the City Clerk, the following answered to their
names: Commissioners Coleman, Grumley, Renfro and Mayor
Montgomery (4). Commissioner Hornsby was absent (1).
PADUCAH MAIN STREET REPORT
Lorraine Schramke, Chairperson of Paducah Main Street,
expressed her thanks and appreciation to the Board of
Commissioners for their support of Paducah Main Street. She
introduced Marilyn Cassity, Executive Director of Paducah Main
Street. Ms. Cassity also thanked the Commission for their
support. She reported that occupancy of downtown buildings is
at 93% and there have been 45 new businesses in the past year.
She gave the Commission informational packets, which included
the history of the Main Street program.
Ms. Cassity introduced Randy Davis of Peck Flannery Gream and
Warren, Architects. Together they presented history of
downtown building use, depicting building facade deterioration,
restoration and improvements through the utilization of a scale
model of an historical downtown building. They reported that a
Facade Improvement Program and an Economic Restructuring
Program are available to downtown merchants.
George Nelson presented information on downtown activities such
as business relocations, etc.
Andy Horner gave an overview of the Paducah Main Street
Program.
Ms. Cassity exhibited a "For Sale" sign for use by downtown
businesses which has been approved by the Main Street Program.
MINUTES
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the reading of the Minutes for October 18 and 20,
1994, be waived and that the Minutes of said meetings prepared
by the City Clerk be approved as written. Adopted on call of
the roll, yeas, Commissioners Coleman, Grumley, Hornsby, Renfro
and Mayor Montgomery (5).

Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the following bids be received and filed:

CEMETERY LOTS
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board of Commissioners approve the sale of
the attached cemetery lot(s) and authorize the City Clerk to
execute a Deed(s) of Conveyance.

ORDINANCE - EMERGENCY
COMPOST FACILITY EXPANSION
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners introduce and adopt an
ordinance entitled, "AN ORDINANCE ACCEPTING THE BID OF A & K
CONSTRUCTION, INC. IN THE AMOUNT OF $130,935 FOR THE COMPOST
FACILITY EXPANSION PROJECT LOCATED AT 1560 NORTH 8TH STREET,
AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME". The
foregoing title summarizes the contents of this ordinance.

ORDINANCES - ADOPTION
NOBLE PARK TREE PLANTING PROJECT
Commissioner Renfro offered motion, seconded by Commissioner
Hornsby, that the Board of Commissioners adopt an ordinance
entitled, "AN ORDINANCE ACCEPTING THE BID OF BOB WILLIAMS
NURSERY IN THE AMOUNT OF $16,140 FOR NOBLE PARK TREE PLANTING
PROJECT, AND AUTHORIZING THE MAYOR TO EXECUTE A CONTRACT FOR SAME".
✓ This ordinance is summarized as follows: Accepting the bid of Bob
Williams Nursery in the amount of $16,140 for the Noble Park Tree
Planting Project and authorizing the Mayor to execute a contract for
same. The City of Paducah will be reimbursed the sum of $10,000 by
the Kentucky Division of Forestry for this project. Adopted on
call of the roll, yeas, Commissioners Coleman, Grumley,
Hornsby, Renfro andMayor Montgomery (5).

SEWER CHARGE INCREASE
Commissioner Coleman offered motion, seconded by Commissioner
Grumley, that the Board of Commissioners adopt the following
ordinance: (Ordinance read in full).
"AN ORDINANCE AMENDING SECTION 33-67 OF CHAPTER 33,
SEWERS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH,
KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. Section 33-67, Rates Established for
Premises Inside City Limits, is hereby amended to read as
follows:
OCTOBER 25, 1994
'Rates and charges for use of the service and
facilities of the municipal sewer system for
premises inside the corporate limits of the City
as such limits presently exist and as the same
may be extended from time to time in the future,
shall be at the rate of $Z/90 $2.50 per 1,000
gallons of water used, provided the minimum
sewer bill shall be $7120 $12.50 per month for
the first 5,000 gallons or less of water
consumption.'
SECTION 2. These rates shall become effective
December 1, 1994.
SECTION 3. This ordinance shall be read on two
separate days and will become effective upon publication in
full."

NOTE: Before a vote was ten on the above sewer ordinance Ray
McLellan addressed the Commission about his concerns regarding
this increase. He handed out his comparison of sewer rates for
the following cities: Hopkinsville, Owensboro, Henderson and
Paducah. A copy of this comparison is in the minute file.
City Manager Hoover asked John Chlarson, City Engineer, to
address this subject. Mr. Chlarson gave a synopsis of the
project, including the 201 Facilities Plan, future upgrades,
etc. City Manager Hoover thanked Mr. Chlarson, Jonathan
Perkins and Kevin Murphy for their endeavors in putting this
package together.
DISCUSSIONS
( MAYOR MONTGOMERY ANNOUNCEMENTS:
1. The Finance Department will rotate working scheduled in
order to remain open from 7:30 a.m. until 5:30 p.m. during the
month of November for tax collection. She also reminded the
public that a drop box for tax collections is located by the
5th Street entrance door to City Hall.
2. The City's Recycling Center received an award from the
Governor.
3. Handed out a copy of the Constitutional Amendment which
will be on the November ballot re local government. This
amendment enables the General Assembly to adopt laws which will
affect citizens of the Commonwealth; i.e., proposed Sec. 157
will improve the way local governments can finance capital
projects in that it:
A. Demands a balanced budget for cities
B. Places debt limits on cities
C. Repeals and replaces Sec. 156 of Constitution which
establishes classes of cities
D. Will allow form of government to be based on population,
geographical location, etc.
E. Will specify and authorize, but not require, local control
or Home Rule by cities
Mayor Montgomery asked the Commission to read this amendment
and vote "yes" on election day because it is in the best
interest of our citizens and local government.
COMMISSIONER GRUMLEY ANNOUNCEMENTS:
1. There will be a news conference next Tuesday morning
announcing National Pornography Awareness Week.

2. A Thanksgiving Dinner to replace the one held by the former
Pasto Vino restaurant will be sponsored this year by Martha's
Vineyard. The group will meet at the First Presbyterian Church
at 200 North 7th Street to plan the event. Volunteers are
needed.
CITY MANAGER HOOVER:
1. Commended City Government for its work. He has been
visiting various departments. He visited the Fire Department
last night (Firehouse No. 1) and rode to the scene of a fire
alarm with Assistant Chief Rudell Benton (in a Surburban). He
highly commended the action taken by the Fire Department during
last evening's events and also commended their professionalism.
EXECUTIVE SESSION
Commissioner Grumley offered motion, seconded by Commissioner
Coleman, that the Board go into closed session for discussion
✓ of matters pertaining to the following topics:
1. Future sale or acquisition of a specific parcel(s) of real
estate, as permitted by KRS 61.810(1)(b);
2. Issues which might lead to the appointment, dismissal, or
disciplining of an employee; as permitted by KRS 61.810
(1)(f)• .

At the conclusion of the Executive Session the Board reconvened
in Open Session, whereupon the Mayor announced there was no
further business.
