HomeMy WebLinkAbout2010-11-7764ORDINANCE NO. 2010-11-7764 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING DESIGNATION OF M-2 (HEAVY INDUSTRIAL ZONE) AND INDUSTRIAL LAND USE OF THE LAND USE PLAN OF THE CITY OF PADUCAH'S COMPREHENSIVE PLAN FOR PROPERTY GENERALLY EXTENDING FROM BECHTDOLT ROAD SOUTH TO INTERSTATE HIGHWAY 24, WEST OF POOL ROAD AND EAST OF SCHNEIDMAN ROAD, MCCRACKEN COUNTY, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING WHEREAS, on November 1, 2010, the Paducah Planning Commission adopted Findings of Fact on the proposed map amendment; and WHEREAS, the City desires to adopt the recommendation of the Planning Commission for the zoning designation of M-2 (Heavy Industrial Zone) for the property generally extending from Bechtdolt Road south to Interstate Highway 24, west of Pool Road and east of Schneidman Road in McCracken County, Kentucky. BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution passed by the Paducah Planning Commission on November 1, 2010, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING DESIGNATION OF M-2 (HEAVY INDUSTRIAL ZONE) AND INDUSTRIAL LAND USE TO THE LAND USE PLAN OF THE CITY OF PADUCAH'S COMPREHENSIVE PLAN FOR PROPERTY GENERALLY EXTENDING FROM BECHTDOLT ROAD SOUTH TO INTERSTATE HIGHWAY 24, WEST OF POOL ROAD AND EAST OF SCHNEIDMAN ROAD, MCCRACKEN COUNTY," be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the City accepts the Findings of Fact adopted by motion by the Paducah Planning Commission on November 1, 2010, as incorporated herein. SECTION 3. That the zone classification and the map amendment proposed in said resolution be, and the same are hereby, declared to be in agreement with the comprehensive plan of the City of Paducah. SECTION 4. That the zone classification M-2 (Heavy Industrial Zone) be designated for properties generally extending from Bechtdolt Road south to Interstate Highway 24, west of Pool Road and east of Schneidman Road, and being more particularly described as follows: An area of land contiguous to the Southern line of the City of Paducah, Kentucky, extending from Bechtdolt Road south to Interstate Highway 24, West of Pool Road and East of Schneidman Road, McCracken County, Kentucky, and being more particularly described as follows: Beginning at a point in the Southern City Limits line of the City of Paducah, said City Limits line being defined as the "North property line of Bechtdolt Road extended" by the McCracken County Circuit Court Judgment of Annexation to the City of Paducah, Kentucky dated April 29, 1927. The above described bounded area contains 173.7690 acres more or less. That the City of Paducah approves and adopts the attached zoning map and incorporated herein previously approved by the Paducah Planning Commission pursuant to KRS 100.209 on November 1, 2010. SECTION 6. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions.
