HomeMy WebLinkAboutMO # 1567MUNICIPAL ORDER NO. 1567 A MUNICIPAL ORDER AUTHORIZING THE TRANSFER OF AN ENCROACHMENT AGREEMENT FROM DAVID H. DUMMER, JR., TO JAMES F. AND BETTY C. ANDERSON FOR AN ENCROACHMENT UPON A PORTION OF RIGHT OF WAY LOCATED ADJACENT TO 2200 BEIDERMAN STREET WHEREAS, Ordinance No. 96-3-5476, adopted by the Board of Commissioners of the City of Paducah on March 26, 1996, authorized the execution of an Encroachment Agreement between the City and David H. Dummer, Jr., for utilization of a portion of the right of way located adjacent to 2200 Beiderman Street; and WHEREAS, on March 16, 2006, David H. Dummer, Jr., sold this property to James F. and Betty C. Anderson without obtaining the consent of the City to reassign the Encroachment Agreement to Mr. and Mrs. Anderson; and WHEREAS, Mr. and Mrs. Anderson are currently in the process of selling the property and are asking for the City's consent to reassign the Encroachment Agreement to them; and WHEREAS, the City is desirous of permitting the aforesaid reassignment of encroachment to James F. and Betty C. Anderson; and WHEREAS, the City of Paducah and James F. and Betty C. Anderson have now entered into an agreement pertaining to the foregoing and do desire that same be set forth in writing and be made part of the public records of the City of Paducah, Kentucky, and recorded in the office of the County Court Clerk of McCracken County, Kentucky. BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That the City of Paducah hereby authorizes the transfer of an Encroachment Agreement from David H. Dummer, Jr., to James F. and Betty C. Anderson for an encroachment upon a portion of right of way located adjacent to 2200 Beiderman Street. SECTION 2. The City authorizes the City Engineer -Public Works Director to authorize the assignment of all future encroachments upon right of way located adjacent to 2200 Beiderman Street. SECTION 3. This order shall be in full force and effect from and after the date of its adoption. ATTEST: Tammara S.
