A MUNICIPAL ORDER APPROVING AND AUTHORIZING THE
MAYOR'S EXECUTION OF A SANITARY SEWER EASEMENT AND
TEMPORARY CONSTRUCTION EASEMENT BETWEEN THE PADUCAH-
�, MCCRACKEN COUNTY JOINT SEWER AGENCY AND THE CITY OF PADUCAH,
KENTUCKY FOR EASEMENTS ACROSS 5400 AND 5450 COMMERCE DRIVE,
LOCATED IN THE INDUSTRIAL PARK WEST, FOR A PORTION OF THE
MASSAC CREEK SANITARY SEWER INTERCEPTOR PROJECT
WHEREAS, the Paducah -McCracken County Joint Sewer Agency has
requested the conveyance of a sanitary sewer easement over and across property located
at 5400 and 5450 Commerce Drive in the Industrial Park West, and
WHEREAS, this property is owned by the City of Paducah and
McCracken County; and
WHEREAS, it is necessary for the Board of Commissioners to approve
and authorize the Mayor's execution of the Sanitary Sewer and Temporary Construction
Easement.
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah hereby approves and authorizes the
Mayor's execution of a Sanitary Sewer Easement and Temporary Construction Easement
between the Paducah -McCracken County Joint Sewer Agency and the City of Paducah,
Kentucky for easements across 5400 and 5450 Commerce Drive, located in the Industrial
Park West, which consists of three separate 15'-20' permanent sanitary sewer easements
and two 20' wide temporary construction easements for a portion of the Massac Creek
Sanitary Sewer Interceptor Project.
SECTION 2. That the City hereby approves the Easement referred to in
Section 1 above and that the permanent sanitary sewer easements and temporary
construction easements are more particularly described as follows:
SANITARY SEWER EASEMENT "Tract 1"
The sanitary sewer easement located on the south side of Commerce
Drive in Paducah, McCracken County, Kentucky, being 15 feet in total
width, and being contiguous to and on the south side of an existing 30'
utility easement, said 15 foot sanitary sewer easement being more
particularly described as follows:
Beginning in the west line of City of Paducah, Kentucky and County of
McCracken, Kentucky Tract 1, thence said sanitary sewer easement
extends 15' south and runs parallel with said existing 30' utility
easement right-of-way in an easterly direction approximately 256' to a
point in the east property line, said point being the end of the Sanitary
Sewer Easement description which is contiguous to and parallel with
said existing 30' utility easement.
The length of the above described Sanitary Sewer Easement is
approximately 256 feet across said property, more or less. See Exhibit
A hereto attached and made part of this document.
Being a part of the same property conveyed to City of Paducah, Kentucky
and County of McCracken, Kentucky, by deed dated May 26, 2004, of record
in Deed Book 1035, page 452, in the McCracken County Court Clerk's office.
SANITARY SEWER EASEMENT "Tract 2A"
The sanitary sewer easement located on the south side of Commerce
Drive in Paducah, McCracken County, Kentucky, being 15 feet in total
width, and being contiguous to and on the south side of an existing 30'
utility easement, said 15 foot sanitary sewer easement being more
particularly described as follows:
Beginning in the west property line of City of Paducah, Kentucky and
County of McCracken, Kentucky Tract 2, thence said sanitary sewer
easement extends 15' south and runs parallel with said existing 30'
utility easement right-of-way in an easterly direction approximately
716' to a point, said point being the end of the Sanitary Sewer
Easement description which is contiguous to and parallel with said
existing 30' utility easement, said point also being the point of
beginning of sanitary sewer easement "Tract 2B".
The length of the above described Sanitary Sewer Easement is
approximately 716 feet across said property, more or less. See Exhibit
B hereto attached and made part of this document.
Being a part of the same property conveyed to City of Paducah,
Kentucky and County of McCracken, Kentucky, by deed dated May 26,
2004, of record in Deed Book 1035, page 452, in the McCracken
County Court Clerk's office.
SANITARY SEWER EASEMENT "Tract 2B"
The sanitary sewer easement located on the south side of Commerce
Drive in Paducah, McCracken County, Kentucky, being 20 feet in total
width, and being 10 feet on both sides of the sanitary sewer centerline,
as constructed, said centerline of the sanitary sewer easement being
more particularly described as follows:
Beginning at the end point of Tract 2A, thence in a northeasterly
direction approximately 10 feet to the centerline of said sanitary sewer
easement, thence in a southeasterly direction approximately 102 feet to
a point in the existing 40' utility easement, said point being the end of
the Sanitary Sewer Easement centerline description.
The length of the above described Sanitary Sewer Easement is
approximately 102 feet across said property, more or less. See Exhibit
B hereto attached and made part of this document.
Being a part of the same property conveyed to City of Paducah, Kentucky
and County of McCracken, Kentucky, by deed dated May 26, 2004, of record
in Deed Book 1035, page 452, in the McCracken County Court Clerk's office.
TEMPORARY CONSTRUCTION EASEMENT "Tract 1 and Tract 2A"
Being a 20 foot wide temporary construction easement on the south side
of the proposed sanitary sewer easement. Said temporary construction
easement being adjoined to, and parallel with the 15 foot sanitary
easement described above for an additional 20 feet of temporary
easement on the south side as shown on Exhibit A and Exhibit B for use
during the construction period of said sanitary sewer line and
appurtenances in connection therewith.
Being a part of the same property conveyed to City of Paducah,
Kentucky and County of McCracken, Kentucky, by deed dated May 26,
2004, of record in Deed Book 1035, page 452, in the McCracken
County Court Clerk's office.
TEMPORARY CONSTRUCTION EASEMENT "Tract 213"
Being a 20 foot wide temporary construction easement on both sides of
the proposed sanitary sewer easement. Said temporary construction
easement being adjoined to, and parallel with the 15 foot sanitary
easement described above for an additional 40 feet of temporary
easement (20 feet on the north side. 20 feet on the south side) as shown
on Exhibit B for use during the construction period of said sanitary
sewer line and appurtenances in connection therewith.

Being a part of the same property conveyed to City of Paducah,
Kentucky and County of McCracken, Kentucky, by deed dated May 26,
2004, of record in Deed Book 1035, page 452, in the McCracken
County Court Clerk's office.
SECTION 3. This Order will be in full force and effect from and after the
date of its adoption.
