ORDINANCE NO. 77-3-1400
AN ORDINANCE' AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK
TO ENTER INTO A LEASE WITH UNITED HOME FURNISHINGS, INC . , FOR THE RIGHT TO
CONSTRUCT A CANOPY, OR OVERHANG, OVER THE SIDEWALK AREA ADJOINING THE
COMMERCIAL BUILDING KNOWN AS ETHAN ALLEN CARRIAGE HOUSE LOCATED AT 114 NORTH
THIRD STREET, PADUCAH, KENTUCKY
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That the Mayor: and -C-ity Clerk -.-be; and they are hereby,
authorized and directed to enter into a' Lease with United Home Furnishings, Inc. to construct
a canopy, or overhang, over -the sidewalk area adjoining the commercial- building known
as Ethan Allen Carriage House, located at 114 North Third Street, Paducah Kentucky, for
an indefinite term, and shall be subject to cancellation and termination by the City of Paducah
at any time, upon thirty (30) days written notice of cancellation. ,
SECTION 2. United Home Furnishings-, Inc. shall construct said canopy,
or overhang, so as not to endanger the general public in any way, or create a hazard or
obstruct the sidewalk as: to interfere with the normal and adequate passageway of the
public. All construction shall provide -for the safety,' consideration and well being of
the general public.
SECTION 3. United Home Furnishings, Inc . - shall hold the, City of Paducah
free,.and clear of any and all liability to -the general public as a result of any injuries or
accidents caused to the person or property :by the granting ' of this Lease. United
Home Furnishings, Inc. shall maintain adequate and sufficient liability insurance against any
loss or damages arising out of this Lease Agreement and the terms thereof.
SECTION 4. The aforesaid Lease is attached hereto and by reference
incorporated herein, and all the terms and provisions thereof are approved.
SECTION 5. This ordinance- shall be- in -full force and effect from and after
the date of its adoption.
