At a Called Meeting of the Board of Commissioners, held in the Commission Chambers
at City Hall, at 5:30 p.m., Wednesday, November 1;5' 2000, Mayor Jones presided, and
upon call of the roll by the City Clerk, the following answered to their names:
Commissioners Coleman, Paxton, Smith Wrye and Mayor Jones (5).
TR & F NOTICES Commissioner Smith offered motion, seconded by Commissioner Paxton, that the
executed Notices of Called Meeting for 5:30 p.m., November 15 2000, be received and
filed. Adopted on call of the roll, yeas, Commissioners Coleman, Paxton, Smith, Wrye
and Mayor Jones (5).
Mayor Jones stated that this meeting was called for purposes of hearing charges filed
against Brian Waid by Redell Benton, Fire Chief, and Terry Denton, Assistant Fire Chief,
of the Paducah Fire Department.
Hon. W. David Denton and Hon. Stacey Blankenship represented the Complainants.
Waid appeared in person with his attorney, Hon. Dennis Null.
Hon. Tom Osborne represented the Board of Commissioners.
Detailed testimony was taken by Sherry Hunerkoch, Court Reporter.
Waid requested a closed hearing. An open hearing was held upon the following vote of
Board of Commissioners: For closed hearing: Yeas, Commissioner Coleman (1). Nays,
Commissioners Paxton, Smith, Wrye and Mayor Jones (4).
There were no opening statements.
Mr. Denton called Complainant Terry Denton as a witness for the City.
Complainants' Exhibits 1-9 were made a part of the record.
Mr. Null stipulated that Mr. Waid filled out all the subscriptions cards which were
introduced as Exhibits 1-9 by the Complainant.
Direct examination of Terry Denton by David Denton and Mr. Null took place at this
time.
Mr. Null entered Exhibit #1 for the Respondent.
Terry Denton was questioned by the Mayor and Commissioners at this time.
David Denton called Brian Waid for direct examination at this time.
The Mayor and Commissioners asked Mr. Waid questions at this time.
Direct examination by Mr. Null took place at this time.
A break was taken at the request of Mayor Jones at this time. There being no objection
by either party, Mayor Jones met with attorneys for both parties at this time.
At the conclusion of the break, and upon the agreement of the attorneys for both parties
and the respondent, the Board of Commissioners went into executive session for
deliberations.
At the conclusion of executive session statements were made by Mr. Null and David
Denton.

Mayor Jones stated that it was his understanding that the Complainants and the
Respondent had agreed that the appropriate punishment to be given Brian Waid would be
six months suspension without pay. Attorneys for both parties agreed this was correct.
Mayor Jones asked the Commission to vote on the following question:
V/ "That the Commission accept the agreement between attorneys for the Complainants and
Respondent that Brian Waid be suspended without pay for six months with all related
conditions, effective immediately." Adopted on call of the roll, yeas, Commissioners
Coleman, Paxton, Smith and Mayor Jones (4). Nays, Commissioner Wrye (1).
Mr. Osborne will prepare Findings of Fact and Order for this action.
Upon motion the meeting adjourned.
