ORDINANCE NO. 76-10-1332
AN ORDINANCE CREATING SECTION 7-19 "FENCING OF OUTDOOR
SWIMMING POOLS" OF CHAPTER 7 "BUILDINGS~AND BUILDING REGULATIONS"
OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH , KENTUCKY
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. There is hereby created as a part of Chapter 7, "Buildings
and Building Regulations" of the Code of Ordinances of the City of Paducah, Kentucky,
a new section to be known as Section 7-19 "Fencing of Outdoor Swimming Pools" , which
shall read as follows:
"Sec. 7-19. Fencing of Outdoor Swimming Pools.
(a) Every outdoor swimming pool or family pool within the corporate
boundaries of the City of Paducah shall be completely surrounded by a fence or wall not
less than five (5) feet in height, which shall be so constructed as not to have openings,
holes, or gaps larger than four (4) inches in any dimension except for doors and gates;
and if a picket fence is erected or maintained, the horizontal dimension shall not exceed
four (4) inches. A dwelling house or accessory building may be used as part of such
enclosure .
(b) All gates or doors opening through such enclosure shall be equipped
with aself-closing and self-latching device for keeping the gate or door securely locked
at all times when not in actual use, except that the door of any dwelling which forms a
part of the enclosure need not be so equipped .
(c) This requirement shall be applicable to all new swimming pools or
family pools hereafter constructed, other than indoor pools, and shall apply to all
existing pools which have a minimum depth of twenty-four (24) inches of water. No
person in possession of land within the city, either as owner, purchaser, lessee, tenant
or a licensee , upon which is situated a swimming pool or family pool having a minimum
depth of twenty-four (24) inches shall fail to provide and maintain such fence or wall
as herein provided.
(d) The Department of Building and Electrical Construction and Code
Enforcement may make modifications in individual cases , upon a showing of good cause
with respect to the height , nature or location of the fence , wall , gates or latches , or the
necessity therefor , provided the protection as sought hereunder is not reduced thereby .
The Department of Building and Electrical Construction and Code Enforcement may
permit other protective devices or structures to be used so long as the degree of

protection afforded by the substitute devices or structures is not less than the
protection afforded by the wall , fence , gate and latch described herein . The Depart-
ment of Building and Electrical Construction and Code Enforcement shall allow a
reasonable period within which to comply with the requirements of this Section."
SECTION 2. This ordinance shall be in full force and effect from and
after the date of its adoption .
