ORDINANCE NO. 76-10-1329
AN ORDINANCE AMENDING SECTION 2-106 OF ARTICLE V "MEETINGS
OF BOARD OF COMMISSIONERS!' AND ..SECTION. 2-128 OF ARTICLE VI "LEGAL
DEPARTMENT" OF, THE CODE OF- ORDINANCES OF THE CITY OF PADUGAH, .KENTUCKY
BE -IT ORDAINED BY THE BOARD OF .COMMISSIONERS OF THE, CITY
OF PADUCAH, KENTUCKY:
SECTION 1. That Section 2-106 of Article V "Meetings of Board of.
Commissioners" of the -Code of •Ordinances of the City of Paducah,. Kentucky, be
amended and reordained so that said section as amended. and reordained shall here-
after read as follows:
"Sec . 2-106. .Reading of- motions,. resolutions and ordinances;.
declaration of result of vote; failure of presiding officer to
act on question .
No motion, resolution or ordinance shall be placed upon its passage until
it has first been read at length or by a summary as .provided. by law;. After a vote has
been taken, the presiding officer shall declare the result and if he should fail or refuse
to put a question to a vote, or declare the result of a vote, as provided in these rules,
prescribed in this article, the mover of such question may rise in his place and put the
question and announce the result of the vote thereon , and the failure or refusal of the
presiding officer to put such. question, or to declare the result of the vote shall be.
noted in the minutes ." -.
SECTION 2. That Section 2-128 of Article VI "Legal Department" of the
Code of Ordinances of the City of Paducah, Kentucky, be amended and reordained so that
said section as amended and reordained shall hereafter read as follows:
"Sec. 2-128. Duties.
The corporation counsel shall attend all regular and special meetings of the
board of commissioners, as well as any other meetings or conferences when his services
are requested. He shall prepare all motions, resolutions and ordinances for the board
of commissioners, all contracts in which the city is a party, and such other writings or
documents as may be required by the mayor and board of commissioners or by the city
manager . He shall have the responsibility of advising with and giving opinions to the
mayor, the members of the board of commissioners, the city treasurer, and all other
officials and employees of the city, with the exception of those designated in section 2-130.
In the absence of the assistant corporation counsel assigned to the handling of civil
matters , or when he is not available , the corporation counsel shall perform all of the

duties imposed upon such assistant.
It shall also be the duty of the corporation counsel to represent the
city as attorney in litigation in suits in all state and federal courts wherein the city
is party complainant or a defendant, or a party in interest, if such suit involves the
question as to the validity of any motion, ordinance, resolution or other measure
adopted by the mayor and the board of commissioners, including any other suit which
is ordered to be filed by the mayor and the board of commissioners, but he shall have
the right to call upon and to be assisted by the assistant corporation counsel or by
the special counsel in the prosecution or the defense of any such suit."
SECTION 3. Section 1 amends Section 10 of an ordinance adopted by the
Board of Commissioners on December 4, 1951, and Section 2 amends Section 2 of an
ordinance adopted on April 24, 1951.
SECTION 4. This ordinance shall be in full force and effect from and
after the date of its adoption .
