ORDINANCE NO. 76-6-1289
AN ORDINANCE PROPOSING ANNEXATION OF CE&TAiN PROPERTY LYING
ADJACENT TO THE CORPORATE LIMITS OF THE CITY OF PADUCAH , KENTUCKY ,
DEFINING ACCURATELY THE BOUNDARY OF THE TERRITORY PROPOSED TO BE
ANNEXED ; AND DECLARING THE DESIRABILITY AND NECESSITY OF SUCH
ANNEXATION
WHEREAS , there is now pending in the McCracken Circuit Court , Civil
Action No . 1312E , an action remonstrating against. the annexation of a large tract
of land by the City of Paducah, of which the hereinafter described tract of land
is a portion thereof ; and
WHEREAS, KRS 81.275, enacted~by the General Assembly in 1966, provides
that
"Whenever any city has enacted an ordinance proposing to annex any
territory and the annexation of the territory is being challenged in the
manner provided by law , the city may proceed to annex. "any land
contained in the area proposed to be annexed, which is contiguous
to the borders of the city, if the owner of such land consents to the
annexation . "
WHEREAS , the hereinafter described tract of land is owned in part by
McCracken County, Kentucky, and in part by the Greater Paducah Industrial
Development Association and said owners being the only owners thereof, and
WHEREAS , each of the aforesaid owners have requested that the City of
Paducah proceed to annex the hereinafter described land and consent to said
annexation .
NOW THEREFORE , BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. It is hereby proposed that certain land lying adjacent and
contiguous to the corporate limits , more particularly described hereinafter , be
annexed to the City of Paducah, Kentucky, and that said property so proposed to be
annexed is accurately described as follows:
TRACT 1
Beginning at the northeast corner of the McCracken County Park
property (as recorded in Deed Book 503, page 480 in the McCracken
County Court Clerk's Office) said point also being in the existing
west corporate limits of the City of Paducah; thence in a southerly
direction along said west corporate limits and east property line of the
McCracken County Park to a point in the south boundary of said property,
same being the northeast corner of property now or formerly owned by
John Hamra (as recorded in Deed Book 546, page 676 in the McCracken
County Court Clerk's Office)~;-;thence in a south and westerly direction along
said south boundary of the McCracken County Park to a point in the west

boundary line of said property, same being the north corner of the White
Oak Cemetery and being in the east property line of the Larry L. Lax
property (as recorded in Deed Book 484, page 261 in the McCracken County
Court Clerk's Office); thence north along.. said west boundary line of the
McCracken County Park property (said line being common to the Larry L .
Lax property) to.. a point in .the, south right-of-way line of the abandoned
ICRR (now owned by McCracken County) ; thence in a westerly direction
along said south right-of-way line of the abandoned ICRR, said line being
the north property line of the Larry L. Lax property (and its projection)
to a,_point in the., west right-of-way line of Coleman.. Road;. thence; in a
northerly direction along said west right-of-way line of Coleman Road
(a portion of said line being ahe east boundary of the Greater Paducah
Industrial Development Association, Inc . property (as recorded in Deed
..Book 454,.page_303 in the McCracken County Court Clerk's Office) to. its
intersection with the north right-of-way line of the abandoned ICRR; thence
in an easterly direction along said north .right-of-way line,.of the abandoned
ICRR to a point in the west boundary line of the McCracken County Park
property,, said point being the southeast corner of McCracken County
property recorded in Deed Book 563, page 308 in the McCracken County
Court Clerk's Office;. thence north.. along the west boundary of the McCracken
County Park to the northwest corner of said property , said point also being,
the southwest corner. of the Dexter Howell property (as recorded in Will Book
"P" , page 131); thence in an easterly direction along the north boundary of
_ the 1VIcCracken County Park to a point. in ,the west right-of-way line of Legeay
Lane; thence in a northerly di"rection and along said west right-of-way line of
Legeay Lane to_ a point,in,the north.boundary of the. McCracken .County Park
property, if projected, across Legeay Lane, said point also being the
.northeast corner of the Dexter Howell tract; thence in an easterly direction
along the projection of the north boundary line of the McCracken County Park
across Legeay Lane and. continuing with said boundary to the point of _...
beginning .
TRACT. 2
Beginning at a point in the west right-of-way line of .Coleman. Road,
said point also being the southeast corner of a tract owned by the
Greater Paducah Industrial Development Association , Inc . (as
described in Deed Book 454, page 303 in the McCracken County
Court Clerk's Office) and said point being the northeast corner of
a tract owned by the Electric Plant Board (as described in Deed Book
512, page 44 in the McCracken County Court Clerk's Office); thence in
a westerly direction along the south boundary line of Greater Paducah
Industrial Development Association, Inc . to the northwest corner of the
aforementioned Electric .Plant .Board, ,property; thence in a southerly
direction along the Electric Plant Board's west property line to the
southwest corner of said. Electric Plant, Board; thence .in an easterly
direction along the south property line of said Electric Plant Board to
a point in the north right-of-way line of the abandoned ICRR; thence
in a westerly direction along said north right-of-way line of ICRR, same
being a common line to a tract owned by the Greater Paducah Industrial
Development Association, Inc. (as recorded in Deed Book 466, page 160
in the McCracken County Court Clerk's Office) , to a point in the north
right-of-way line of the P & I RR; thence along said north right-of-way
line of the P & I RR and in a westerly direction to a point in the east
right-of-way line of I-24; thence in a northerly direction along said east
right-of-way line of I-24, same being the west property line of the Greater
Paducah Industrial Development Association, Inc. , to a point in the west
property line of a tract now or formerly owned by Mont Edwards (as
recorded in Deed Book 223, page 133 in the McCracken County Court
Clerk's Office); thence in a southerly direction along said Mont Edwards
west property line , same being a common line to the Greater Paducah
Industrial Development Association, Inc. (as recorded in Deed Book 528,
page 171 in the McCracken County Court Clerk's Office) , to the Mont
Edwards southwest corner; thence in an easterly direction along the north
boundary line of the Greater Paducah Industrial Development Association, Inc .
to the northeast corner of said tract (as recorded in Deed Book 555, page 525

in the McCracken County Court Clerk's Office) , said point being in the west
right-of-way line of Coleman Road; thence in a southerly direction with the
east boundary of the Greater Paducah Industrial Development. Association , Inc .
property same being, the west right-of-way. line of Coleman Road to the point
of beginning..
SECTION 2. It is hereby declared that extending„the boundary of the City
of ..... ,
Paducah.,,Kentuck b nnexing the property described in Section lhereof is

SECTION 3. This ordinance shall be published in the Sun-Democrat, a
newspaper in Paducah, Kentucky, as provided' for and required by Section 424.130
of Kentucky Revised Statutes , and the extension of the city limits as herein proposed
shall. not become ,effective until the adoption of an ordinance annexing the property
described in;Sectionrtl.,hereof;, and such ordinance shall not be adopted until after
publication of this ordinance as provided herein and until the expiration of a
period of. thirty days after the enactment of this ordinance.
_ Notice is hereby given .under the provisions of Section 81.110 of Kentucky
Revised Statutes that one or more .residents or freeholders of the herein territory
proposed„ to. be annexed may, within thirty days after the enactment of this ordinance,
file a petition~n the Circuit Court of McCracken County, Kentucky, setting forth
the reason why said territory, or any part of it, shall not be annexed.
SECTION 4. This ordinance shall be in full force and effect from and after
the date of its adoption . _
