Home My WebLink About80-11-2021860 ORDINANCE NO. 80-11-2021 AN ORDINANCE CREATING SECTION 12-49, APPOINTEES; PROBATIONARY PERIOD; DISCIPLINARY ACTIONS, TO CHAPTER 12, FIRE PREVENTION AND PROTECTION OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH AND REPEALING SECTION 12-47 OF SAID CHAPTER 12 BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a new section 12-49, Appointees; Probationary Period; Disciplinary Actions, be, and it is hereby, created to Chapter 12, Fire Prevention and Protection of the Code of Ordinances; said section to read as follows: "Section 12-49. Appointees; Probationary Period; Disciplinary Actions. (a) All appointments to the Fire Department shall be for an initial probationary period of one hundred twenty (120) days. During the one hundred twenty (120) days probationary period, the candidate shall be an appointee to the Fire Department, not a member as the term is used in KRS 95.450. No appointee shall be deemed a member of the Fire Department until such time as the appointee has satisfactorily serve the one hundred twenty (120) days probationary period. At such time as the appointee may have successfully completed one hundred twenty (120) days of service, he shall become a permanent employee of the Fire Depart- ment and, therefore, a member of the Fire Department entitled to the procedures of KRS 95.450. (b) Until the one hundred twenty (120) days probationary period has elapsed, the appointment shall be conditional. As such, the appointee shall not be entitled to the discipline procedures of KRS 95.450. At any time during the appointee's probationary period, he may be summarily removed by the Board of Commissioners of the City of Paducah, Kentucky". SECTION 2. That Section 12-47, Trainee not member of department; discharge of trainee, be, and it is hereby, repealed in its entirety. SECTION "3. This ordinance shal'P be read on two separate days and will be effective upon publication of title and a certified summary thereof.
