HomeMy WebLinkAbout2015-04-8230186610 ORDINANCE 2015-4-8230 AN ORDINANCE AUTHORIZING THE CITY TO EXECUTE A FIRST 209 AMENDMENT TO MEMORANDUM OF LEASE AND THE THIRD AMENDMENT TO TOWER OPTION AND LEASE AGREEMENT WITH AT&T FOR THE BENEFIT OF THE CITY WHEREAS, the City of Paducah previously leased space on the 800 MHz tower to AT&T and a 900 square foot parcel of real estate located at 510 Clark Street; and WHEREAS, AT&T has approached the City of Paducah regarding the renewal of said lease; and WHEREAS, AT&T has requested the lease to be extended for a term of five (5) years to be automatically renewed up to five (5) separate consecutive additional periods of five (5) years unless terminated by either AT&T or the City; and WHEREAS, in exchange for this Agreement, AT&T has agreed to increase the monthly rent to $1,633.50; and WHEREAS, it has been determined that it is beneficial to the City to agree to enter into this Lease. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: - SECTION 1. The City Commission hereby authorizes and approves the City of Paducah to enter into an Agreement with AT&T for the lease of space on the 800 MHz tower and the lease of real estate located at 510 Clark Street upon the terms and conditions as negotiated by Corporation Counsel, a copy of which has been provided to the Commission. SECTION 2. The Mayor is hereby authorized to execute said lease agreements between the City and AT&T. SECTION 3. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: jwvyllwl"f� Tammara S.
