ORDINANCE NO. 80-1-1841
AN ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT
BETWEEN THE CITY OF PADUCAH AND SANITATION DISTRICT NO. II, McCRACKEN
COUNTY, KENTUCKY, FOR SEWER SYSTEM EVALUATION SURVEY WORK
WHEREAS, Sanitation District No. II, McCracken County, Kentucky, (herein-
after referred to as the District) intends to conduct a Sewer System Evaluation Survey
(SSES) as required by the 201 Facilities Plan for the planning area designated under
Section 201 of the Federal Water Pollution Control Amendment of 1972 (P. L. 92-500),
and
WHEREAS, the City of Paducah (hereinafter referred to as the City) is the
lead applicant for the Paducah -McCracken County 201 Facilities Plan, and
WHEREAS, an application for a SSES, which is an amendment to Step 1, must
be made through the City of Paducah as lead applicant, and
WHEREAS, the City of Paducah shall not have any financial or managerial
responsibilities for said project.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor be, and he is hereby, authorized to execute
an agreement with Sanitation District No. H, whereby the District applies for E. P. A.
funding for a Sewer System Evaluation Survey under the following terms and con-
ditions:
A. By a letter of instruction from the City, all correspondence, after filing
the application, shall be directed to the District.
B. The application, which must be executed by the Mayor of the City of
Paducah, and all supporting documentation shall be prepared by the
District.
C. The City shall not be responsible for any work, management or
financial obligations for the project.
D. The City shall have no input or voice in the performance or results
of the project.
E. The District shall be responsible for all management and financial
aspects of the project.
F. Checks for the EPA share (75%) of the project :shall be made payable
to the City and upon receipt, shall be transferred immediately (within
three (3) days) to the District.
G. All correspondence (if any) from the City to the District shall be to
Eugene DeJarnett, Chairman and Hunter H. Martin & Associates, Engineer
for the District.

SECTION 2. This ordinance shall be in full force and effect from and after
after the date of its adoption.
