ORDINANCE NO. 80-6-1921
AN ORDINANCE AUTHORIZING THE SALE OF RIGHT OF WAY BY THE CITY
OF PADUCAH; KENTUCKY, (ON BEHALF -OF THE PADUCAH WATER WORKS) , TO THE
COMMONWEALTH OF KENTUCKY -FOR THE USE -AND BENEFIT OF THE DEPARTMENT
OF TRANSPORTATION IN CONSTRUCTION OF THE RIVERFRONT ACCESS ROAD
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That for and in consideration of the sum of $36,200.00 the
City of Paducah; Kentucky, (on behalf of the Paducah Water Works) does hereby
authorize the sale to the Commonwealth of Kentucky for the use and benefit of the
Department of Transportation, parcels of land lying and being in McCracken County,
Kentucky, and being a portion of the same tract of land conveyed to the party of
the first part by Harry Harris, et al by deed bearing -date of 'February 21, 1968,
which is duly- recorded in -Deed..Book No. 495 at: page 334 in the office of the County
Court Clerk;, .and 'by James C. Jobnsom et al 'by deed bearing date of ,May 5, 1967
and recorded in Deed Book 486 at page 657 in the McCracken County Court Clerk's
Office.
PARCEL 129:
Beginning at a point 27.72 feet right of Park Avenue Station 161+28.88;
said point being the grantors northwest property corner; said point also
being in the Harrison Street right of way line; thence N 60 degrees 20
minutes 56 seconds E, along the grantors north property line and cross-
ing the Park Avenue centerline at Station. .161+46-08; 71'.46 feet to a .
point 33.00 feet left of Park Avenue Station 161+66.56; thence S 61 de-
grees 28 minutes 24 seconds E, 192.81 feet to a point 33.00 feet left of
Park Avenue Station 163+59.37; said point being in the grantors east
property line; said point also being in the west right of :way line' of
Third Street; thence S 29 degrees 36 minutes 24 seconds E along the
grantors east property- line -67.-17 feet to a point 0:88 feet Left of'. Park
Avenue Station 164+16.44; said point being the grantors southeast pro-
perty corner; thence S-, 60 degrees 20 minutes 56 seconds ,W, along the
grantors east property line, and crossing the Park Avenue centerline
at. Statron- 1-64+16.051-37_53- feet to a point 33.00_ feet��righli of Park Avenue
Station 163+99.57; thence in a northwesterly direction and parallel with
the Park�Avenue= centerline _along an arc turning to the left:30".71 feet
to a point 33.00 feet right of Park Avenue Station P.C. Station 163+65.91;
thence N -61 degrees 29 minutes 24 second's W, 228.53 feet to a- point 33.
00 feet right of Park Avenue Station 161+37.38; said point being in the
grantors west property I.ine; - thence N 29 degrees 36 minutes 24 seconds
W, along the grantors west property line 10.01 feet to the point of
beginning.
The above described parcel contains 16,639 S.F.
It is the specific intent of the grantors herein to convey in fee simple
the property described above and -designated -as Parcel, 129 containing
16,639 S.F. of which 16,639 S.F. is new right of way to be acquired
and 0.00 (none) s..f. is existing right: of way.
Also a parcel of land lying -immediately adjacent to and on the right
and south side of the above described Parcel 129 and more particularly
described as follows:

(a) A 10 foot strip of land parallel to the Park Avenue centerline begin-
ning at a point 33.00 feet right of Park Avenue "Station 161+37.38; said
point being in the grantors west property line; thence in a southeaster-
ly direction :along the Park Avenue proposed right :of wayto a point
33.00 feet right of Park Avenue Station 163+99.57 said point being in
the grantors south property" Fine; thence along the grantors south pro-
perty line to a point, said point being 10.00 feet perpendicularly from
Park Avenue proposed -eight of way; thence in' a northwesterly direction
and parallel with the Park Avenue proposed right of way to a point in
the grantors west property line;. thence in a northwesterly direction
along the grantors west property line to the point of beginning.
The above described Parcel (a) contains 2670 s.f.
Also a parcel of land lying immediately adjacent to and on the left and
north -side of the above -described Parcel 129 and more particularly
described as follows:
(b) A 10 foot strip of land parallel to the Park Avenue centerline begin-
ning.at a point 33.00 feet left of Park Avenue Station 161+.66.56; said point
being in the grantors north property line; thence in a southeasterly
- direction along• the Park Avenue proposed right of way to a point 33.00
feet left of Park Avenue Station 163+59.37, said point being in the grantors
east property line; thence along the grantors east property line to a point,
said point being 10.00 feet perpendicularly from the Park Avenue proposed
right of way; thence' in a northwesterly direction and parallel with the
Park Avenue proposed right of way to a point in the grantors north pro-
perty line; thence -in a southwesterly direction ,along the grantors north
property line to the point of beginning.
The above described Parcel (b) contains 1850 s.f.
It is the specific intent of the grantors herein to convey a construction
easement to the property described above and designated as Parcel °(a)
and (b) for the purpose of backslope construction and said easement
terminates and reverts upon completion of same.
The acquisition of right of way for this project was authorized by the
Kentucky Bureau of Highways Official Order No. 82.967. The control
of access on the project shall be by Permit as required and set forth
in Section 5 of the- Kentucky Administrative Regulations (603 KAR 5: 010) .
The proposed public road extends from U. S. 45 to 3rd; 4th and Monroe
Streets (S -P 73-6577-9112) .
SECTION 2. That the Mayor be, and he is hereby, authorized and
directed to enter into a deed of conveyance for the aforesaid purpose.
'SECTION 3. An emergency is declared to exist and this ordinance shall
therefore be introduced and remain on
file
for
public inspection for at
least one week
in the completed form in' whi'ch it shall
be
put
upon its final passage,
and if adopted
shall be in fult-Jorce and effect immediately thereafter.
