Home My WebLink About80-5-1906619 ORDINANCE NO. 80-5-1906 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING 'COMMISSION AMENDING SECTION 40.21, PARAGRAPH C(4) OF THE PADUCAH ZONING" ORDINANCE - 1976, SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE' BOARD OF COMMISSIONERS- OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a resolution adopted by the Paducah Planning Com- mission on May 5, 1980, entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED AMENDMENT OF SECTION 40.21, PARAGRAPH C(4) OF THE PADUCAH ZONING ORDINANCE - 1976", be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That Section 40.21, Paragraph C(4), of the "Paducah Zoning Ordinance - 1976. be, and the same is hereby, amended and reordained so that said Section :as amended and reordained shall hereafter read as follows: "Section `40.21. Sign Regulations. (c) (4) No portion of any. sign and no portion of the mounting' -or mast of any sign within the public right-of-way shall be placed at an elevation of less than ten (10) feet above the sidewalk or above the surface of the land adjacent to the roadway,, whichever is; higher,. Nor shall .any portion of_ any such sign, mast or mounting (in the space above ten (10) feet) be placed ,nearer to the traveled portion of the roadway (or the verticle place above the traveled portion of the roadway) then two' (2) feet, as measured, fr6ib the face of the curb or, if there is no curb, from the edge of the pavement." SECTION: 3..: That all other =provisions of Section 40.21 are hereby re- affirmed and reordained as if fully copied herein. SECTION 4. That if any section, paragraph or provision of this ordi- nance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or _invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and in- tent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs- and provisions. - SECTION 5. This ordinance shall be in. full force and effect from and after the date of its adoption.
