HomeMy WebLinkAbout80-5-1900609 ORDINANCE NO. 80-5-1900 AN, ORDINANCE AMENDING CHAPTER -7, BUILDINGS AND BUILDING REGULATIONS OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, MODIFYING AND ESTABLISHING CHARGES FOR SERVICES CONTAINED THEREIN BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 7-9, Issuance of building permits; building permit fees prescribed, is hereby amended to read as follows: "Sec. 7-9. (a) The building and electrical inspector shall, upon his approval of plans and specifications for buildings and structures and components therein,, in accordance with the provisions of the building codes adopted by this Article and al_I laws and ordinances relating to'the same subject matter, issue a permit required by said building codes to the applicant -therefor upon the payment to the City of the fees set forth; �in Sub=section (d) hereof based upon the cost of construction, alteration or repair .of the building or structure, less the contract price of the electrical contract as determined in Section (b) hereof. A credit aga-inst the fee shall- be given for the fee paid for plan review under Section 7-84 when said plan review fee is paid on the building for which the building permit is issued. (b) For making electrical inspections as provided in this Chapter, there shall be a charge for electrical contractors, where the contract price can be determined and verified, a fee as set forth in Sub -section (d) hereof based on the electrical contract. For all other electrical inspections the fees shall be charged as set forth in Sub -section (e) hereof. (c) The building and electrical inspector shall issue permits for the demolition, wrecking, razing or moving of buildings or other structures, as re- quired by the building code, when the applicant thereof has complied with pro- visions of the building code and the standards of safety adopted by this Article and all laws and ordinances relating+ to. the same subject matter, and has paid to the City the fees set forth in Sub -section- (d) hereof. Fee base to be on the total cost of demolition, wrecking, razing or moving the structure. (d) Subject to the minimum fees -set -out in Section (e) below: 1. If the cost is less than $3,000.00 the fee shall be $20.00. 2. If the -cost is -more than $3,000.00 the fee shall be $20.00 for the first $3,000.00, plus $4.00 for each additional $1,000.00 or fractional- part thereof, up .to and including $100,000.00. 3. If the cost is more than $100,000.00 up to and including $500,000.00 the fee shall be $408.00 plus $3.00 for each additional $1,000.00 up to and including $500,000.00. 610 4. If the cost is more than $500,000.00 up to and including $10,000,000.00, the fee shall be $1,608.00 plus $1.00 for each $1, 000.00 up to and including $10,000,000.00. 5'. If the cost is more than $10;-0-00,000.00 the' fee §ha.11 be $11,108.00 plus $0.50 for each $1,000.00 thereafter. (e) The minimum fee for all electrical inspections shall be: (1) Call back inspections and all others per trip, $15.00. (2) Single family units, two inspections, $60.00. (3) Multi -family units, up to eight (8) units, two inspections per unit, $50.00 per unit. (4) Power Company temporary;. $5.00. {5) Temporary wiring as provided elsewhere in the ordinance, for lights and power, which is not a power company tempo- rary, -or provided for in sub -section (d) herein, $15.00. (6) For each additional inspection trip required 'to be made due to permittees failure to comply with all Electrical Codes and Standards of Safety, each trip, $15.00. (7) For all work performed on Sundays, holidays and after regular working hours, at the request of the permittee, all -fees heretofore :' numerated,. shall be doubled . (8) The Electrical Inspector is hereby authorized to, and shall have the responsibility for setting a reasonable inspection fee for any wiring;, device, apparatus, appliance or equip- ment which is not specifically covered herein. (f) In the event of any construction, razing or moving of any build- ing or structure is commenced before a permit is issued for the same by the building and electrical inspector, a penalty shall be charged for the issuance of a permit in addition to the regular fee, which penalty shall be in the amount of Twenty-five Dollars ($25.00) or in an amount equal to Ten percent (100) of the permit fee, whichever amount is larger. However, the maximum penalty shall not exceed One Thousand Dollars ($1,000.00). SECTION 2. That Sub -section (f) of Section 7-38, License required of electricians, is hereby amended to read as follows: "Sec. 7-38. License required of electricians. (f) Suspension and revocation of license. Any electrician's license issued in accordancewith this section may, after a hearing by the City Inspector, be suspended for a definite length of time, or revoked, if the holder of any such license shall wilfully or by reason of incompetence violate any statute of the National Electrical Coderelating to the installation, alteration, maintenance or repair of electrical wiring as defined in this section, or for the wil- ful violation of any provision of this section. Any person, firm, partnership or corporation may register an appeal with the Electrical Appeals and Review Board. -The Review Board shall proceed to determine if the action complained of was in conformity with the provisions of this section, and shall conduct a hearing into the cause for suspension or -revocation". follows: 611 SECTION 3. That Section 7-50, Fees, is hereby amended to read as "Sec. 7-50. Same - Fees. The fee for a permit required by section 7-48 shall be based on, the cost of the sign and be computed under Section 7-9(d) herein". SECTION 4. That Section 7-83, Temporary signs, is hereby amended to read as follows: "Sec. 7-83. Plans and specifications of buildings. The Chief Inspector of the Department of Building, Electrical, Construction and Code Enforcement is responsible for all examinations, approval or disapproval of plans and specifications for buildings as set forth in KRS 198B.060". .SECTION 5. That Section 7-84, Fees for examination and approval of plans be; and they are hereby, created to read as fo-llows: "Sec. 7-84. Fees for examinations and approval of plans. The building and electrical inspector shall, upon application being made for approval or disapproval of plans and specifications for buildings in accordance with Section 7-82 of the Kentucky- Building Code and all .other laws and ordinances relating thereto shall collect a fee for the City as follows: (1) New construction pian review fees -for the City of Paducah will be based on .1 of 1% or .001 of the cost of construction per square foot. The costs per square foot for occupational uses are: Residential Assembly Occupancies Nightclubs/Restaurants All other assembly Educational Day Care Centers Business Mercantile Industrial . Factories Warehouses Institutional Frozen Food Plants High Hazard All other non-residential $2.0.00 per square foot 35.00 per square foot 30.00 per square foot 20.00 per square foot 20.00 per square foot 20.00 per square foot 20.00 per square foot 20:00 per square foot 11.00 per square foot 25.00 per square foot 20.00 per square foot 30.00 per square foot 20.00 per square foot For additions to existing buildings that will not involve a change of use for the entire building, or result in any other situation which would require the entire building to conform to the Kentucky Building Code, then only the cost of the additional square footage will be used to cal- culate the fee. For an existing building that will result in a change of use or occupancy, the rate will be based upon the new occupancy use and the total square footage for the entire building or structure will be used to calculate the fee. For any alterations or repairs as set out in Article I, Section 1, Paragraph (9), Article I, Section 4, and Article I; Section 6 of the Kentucky Build- ing Code, a fee will be charged. The owner or his representative will submit the contractor's costs and the .1 of 10 or .001 multiplier will be applied to that figure to determine the fee. 612 Plan review and inspection fees will be included with plans at the time of submission for approval. The Building and Electrical Inspector will check all plans prior to review to ensure that the proper fees have been paid. (2) AUTOMATIC SPRINKLER REVIEW FEE: The fee for the sprinkler review is based on the number of sprinkler heads in the system. Sprinkler Heads Plan Review Fee A. 1 - 200 $ 50.00 B. 201 - 300 60.00 C. 301 - 400 80.00 D. 401 - 750 100.00 E. over 750 $100.00 plus 104', per sprinkler over 750 F. For hydraulically designed systems multiply the above fee by 2. Stand- pipes using the. same supply as _the automatic sprinklers are included in the fee. (3) A. Fire Protection System Review Fee - $10.00 per 5,000 square feet up to 70,000 square feet; over 70,000 square feet - $140.00 plus $15.00 per each additional 20,000 square feet. B. Standpipe Plan Review Fee - $30.00 (Combination Standpipe and Risers plans will be reviewedunder automatic sprinkler review fee schedule.) C. Carbon Dioxide Suppression System Review Fee - 1 to 175 pounds of agent - $35.00; over 175 pounds of agent - $35.00 plus 20G per pound in excess of 175 pounds. D. Halon 1301 Suppression System Review Fee - Up to 35 pounds of agent - $35.00; over 35 pounds -.$35.00 plus 50C per pound in excess of 35 pounds: - E. Foam Suppression System Review Fee - $35.00 per 50 gallons of foam concentrate. F. Range Hoods Review Fee - $20.00 per hood. G.' Tanks Installation Plan Review Fee - $25.00 for the first tank and $5.00 for each additional tank. H.' Expiration - All approval of plans for commencement of construction shalt expire at the expiration of one year after the date of approval unless a building permit is obtained under Section, 7-9. SECTION 6, That Section 7-50, Fees, be amended to read as follows: "Sec.'! -50.- Fees. The 'fee for a permit required by Section 7-48 shall be computed under the fee schedule contained in Section '7-9(d)' of this Code and shall be based upon the total cost of the sign including installation". SECTION 7. That the following sections 'of the Code of Ordinances of the City of Paducah be, and they are hereby; repealed: 7-11, Issuance of and fee for demolition, moving, etc., permit; 7-38(j), License required of electrcians - penalty for- violation of section; 7-83, Temporary Signs. 613 SECTION 8. This ordinance shall be introduced and remain on file for one week. for public inspection .in thecompleted. form in which it shall be put upon its final passage,- and if adopted shall be --in full force and effect ten (10) days thereafter.
