ORDINANCE NO. 80-4-1891
AN. ORDINANCE AUTHORIZING PAYMENT OF JUDGMENT OF McCRACKEN
CIRCUIT COURT, IN FAVOR OF WESTERN. KENTUCKY SENIOR CITIZENS UNION LABOR
HOUSING, INC.
WHEREAS, the Western Kentucky Senior Citizens Union Labor Housing,
Inc., paid real estate taxes to the City of Paducah, in the years 1973, 1974, 1975,
1976 and 1977 in the total sum of $59,170.85, as determined by Judge Price,
McCracken Circuit Court, and
WHEREAS, the above mentioned taxes were ordered refunded by the
McCracken Circuit Court in Civil Action No. 16,736 due to the finding of the Court
that the Western Kentucky Senior Citizens Union Labor Housing, Inc . , is tax
exempt under the constitution for the Commonwealth of Kentucky, and
WHEREAS, it was further ordered by the Court that the City of Paducah
pay to Western Kentucky Senior Citizens Union Labor Housing, Inc . , the sum of
$16,302.65 in interest, and
WHEREAS, the City of Paducah has entered into negotiations with Western
Kentucky Senior Citizens Union Labor Housing, Inc . , in which it was agreed that
the interest payment would be reduced to the sum of $2,500.00, and
WHEREAS, it is the recommendation of the Corporation Counsel that said
judgment be satisfied by payment of $61,670.85, including the taxes paid and interest.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City Manger be directed to satisfy the judgment
entered by the McCracken Circuit Court in Civil Action No. 16,736 by refunding
to Western Kentucky Senior Citizens Union Labor Housing, Inc . , the total sum of
$61,670.85 which includes taxes paid and interest. The City Treasurer is hereby
authorized to disburse the above amount to Western Kentucky Senior Citizens Union
Labor Housing, Inc.
SECTION 2. The Corporation Counsel is authorized to execute any and all
legal documents necessary to dismiss the law suit pending in McCracken Circuit
Court filed by Western Kentucky Senior Citizens Union Labor Housing, Inc . , against
the City of Paducah.
SECTION 3. The payments made as authorized in Section 1 hereby should
be charged to the following accounts: General Fund Tax Distribution, $42,496.69;
Sinking Fund, $3,088.27; Interest on Voted Bonds, $3,849.26, Appointive Employees'
Pension Fund, $886.62; Kentucky Retirement Fund, $3,899.03; Public Library,
$4,950.99; Account No. 1565, Suits and Claims, $2,500.00; total $61,670.85.

SECTION 4. This ordinance shall be introduced and remain on file for
one week for public inspection in the completed form in which it shall be put upon
its final passage, and if adopted shall be in full force and effect ten (10) days
thereafter.
