AN- ORDINANCE REVERSING THE FINAL REPORT OF THE PADUCAH PLANNING
COMMISSION ON THE.-. PROPOSED: REZONING OF, PROPERTY LOCATED ALONG TWENTY-
FIRST STREET..AND "B" STREET; AND DIRECTING AN- AMENDMENT TO THE PADUCAH
ZONING ORDINANCE - 1976, SO AS TO CHANGE THE ZONE CLASSIFICATION FROM R=3,
MEDIUM,DENSITY-`RESIDENTIAL ZONE TO B=3., GENERAL BUSINESS ZONE
WHEREAS-, the Paducah Planning .Commission; at a meeting held on April 17, 1978,
considered a proposal to amend the Paducah Zoning -Ordinance 1976, so as to -change
the
zone classification
of certain property located .along South
Twenty-first Street
and
"B"
Street from R-3,..:Medium
Density Residential Zone ao B-32
General Business
Zone,
and
WHEREAS ; the aforesaid. proposal failed . by- reason of -a tie vote, and
WHEREAS, ;:-the -Board-: of :Coihmission6rs.-of the City of Paducah, Kentucky, at
a meeting held -:an_-July 1x;:1.978; after publication of.Notice,pursuant to law., duly
reconsidered" the- said .proposal land: heard and considered. testimony; objections and
suggestions- of all- interested parties who appeared at saidmeeting, and
WHEREAS, - after considering the evidence submitted and being thoroughly
advised in .the premises the -Board -of Commissioners 'does by this :ordinance over-
rule and reverse the action of the Paducah .Planning . Commission .' .

NOW .THEREFORE, -BE- .IT ORDAINED BY THE BOARD OF- COMMISSIONERS OF
THE CITY OF.PADUCAH,,, KENTUCKY:
SECTION 1. The Board of Commissioners finds, relative to the proposed
amendment ,as follows:
1. The subject, property- is 7located in 'an area which -Pias. -an ever- increasing
traffic- flow; on: South Twenty-first Street..
.. -2.. The .subject -propery adjoins property zoned and used- for- B-3 purposes
and it. was, :and is, difficult to establish a differing zone classification between them
considering all factors, including uses and nature of .the - property .
3-: - There, have been no ..substantial -residential developments= -in and around the
area involved and because of the increased traffic and adjoining business use it appears
unlikely that the subject property was, or is, suitable for residential development.
4. Territory recently annexed by the City of Paducah now supplies the need
for new residential development in more appropriate areas then that herein involved.
5. The agreement of the landowner to use the property in a manner which
will have a minimum inconvenience on his adjoining neighbors would, in all- probability,
eliminate most of the objections voiced by the two residents who appeared and spoke
against the amendment.

6. In view of the foregoing, the original zoning classification given to the
property was inappropriate Arid improper' and -there have beenmajor changes of an
economic; physical Arid social -nature within- the area involved which -were not antici-
pated in- the Community's Comprehensive .Plan and which - have substantiall�r altered- -
-the basic character of : the area
SECTION 2-. That the Paducah. -.Zoning "Ordinance - 1976,- be 'amended' so as
to changer the zone classification for .the following property from R- 3;. Medium Density
Residential Zone to B-3, .General Business Zone:
-Beginning at 'the, intersection .of the center- lines,. of South:21st •
Street and "B" Street; thence in an easterly direction with the
center line of South 21st Street an .approximate distance of
274 feet to the existing west boundary line of the B-3 Zone;
thence in a southerly direction with the existing west boundary
line of the B-3 Zone approximately 190 feet to a point; thence
in 'a westerly-, direction :with . the existing: B-3 Zone boundary
line approximately 85 feet to a point; thence in a southerly
direction with the existing ' B=3-- Zone .boundary -1 line, .an- approxi-
mate distance of 220 feet to a point in the south right of way
- line -of, South. 22nd Street; -thence in a _westerly direction -with
the south right of way line of South 22nd Street an approxi-
mate- distance . of 80 feet to a point in the west boundary- line
of the existing B-3 Zone; thence in a southerly direction with
the ., existing B-3 Zone. Boundary: an approximate distance of - -= - -
183 feet to the south right of way line of an alley; thence in a
westerly `direction with the south right of way. line of 'said
alley an approximate distance of 115 feet to a point in the
.center. -line- of. -"B" Street; .:.thence do "a northerly direction- with
the center line of "B" Street an approximate distance of 595
feet to. -the point- of beginning. =
That the zone classification change .and• the map amendment as
set forth above are hereby declared to be in agreement - with the Comprehensive Plan
of the- City" of Paducah:: .
SECTION 4. That if any section, paragraph, or provision of this ' or'dinarice
shall be -:found to be inoperative; ineffective or invalid for any cause, -'the deficiency
or invalidity of such section, paragraph or provision shall -hot affect any other section,
paragraph' -or provision hereof, it being the -purpose:-and intent .of this ordinance to
make- each -and- every. section, paragraph _and provision hereof'.separable..from- all other
sections, paragraphs - and provisions.
SECTION- 5 This ordinance shall be in full force and' effect from and after
- its- : adoption . -.
