A MUNICIPAL ORDER ACCEPTING THE TRANSFER OF REAL
PROPERTY LOCATED NORTH OF KENTUCKY HIGHWAY 305 (OLD CAIRO
ROAD), NORTHEAST OF PERKINS CREEK, AND THE SOUTH END PORTION OF
SECTION "A" OF THE PADUCAH FLOODWALL, FROM THE PADUCAH &
LOUISVILLE RAILWAY, FOR THE GREENWAY TRAIL PROJECT PHASE III,
FOR AND IN CONSIDERATION OF THE SUM OF ONE DOLLAR ($1.00), AND
AUTHORIZING THE MAYOR TO EXECUTE A QUITCLAIM DEED FOR SAME
BE IT ORDERED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. The City of Paducah hereby accepts the transfer of real
property located north of Kentucky Highway 305 (Old Cairo Road), northeast of Perkins
Creek, and the south end portion of Section "A" of the Paducah Floodwall, from the
Paducah & Louisville Railway, for the Greenway Trail Project Phase III, for and in
consideration of the sum of One Dollar ($1.00).
SECTION 2. That the property authorized in Section 1 above, heretofore
approved for acceptance, is more particularly described as follows:
A parcel of land located North of Kentucky Highway 305 (a.k.a. Old Cairo
Road), Northeast of Perkins Creek, and on the South terminus of a portion of the
Paducah Floodwall Section "A", Paducah, McCracken County, Kentucky, and
being more particularly described as follows:
Commencing at a 5"x5" concrete monument in the centerline of the Paducah
Floodwall Section "A" with a brass disk stamped 133+13.50;
Thence, North 76°43'51" East a distance of 55.11 feet to an iron pin with cap set
this survey in the West right of way line of the Paducah floodwall;
Thence, with the West right of way line of the Paducah floodwall, South
16°;53' 10" West a distance of 753.08 feet to an iron pin with cap set this survey
and the true `point of beginning, said beginning point having Kentucky State
Plane South Zone coordinates of North 1,930,729.3 and East 798,546.4;
Thence, from the point of beginning and with a line common to the lands owned
by the City of Paducah as shown by the deed of record in Deed Book 200 Page
222 of the records of the McCracken County Court Clerk, North 82°28'10" E a
distance of 109.82 feet a point in a line common to the lands now or formerly
owned by B&D Rentals, Inc. as shown by the deed of record in Deed Book 937
Page 381 of the records of the McCracken County Court Clerk;
Thence, with the said common line with B&D Rentals, Inc., N 82°28'10" E a
distance of 43.93 feet to an iron pin with cap set this survey at a corner common
to the lands now or formerly owned by Chambers Roofing Co., LLC as shown by
the deed of record in Deed Book 1082 Page 538 of the records of the McCracken
County Court Clerk;
Thence, with a line common to Chambers Roofing Co., LLC, South 16°53'10"
West a distance of 109.82 feet to an iron pin with cap set this survey;
Thence, continuing with a line common to Chambers Roofing Co., LLC, South
82°28'10" West a distance of 43.93 feet to an iron pin with cap set this survey in
the line common to the lands owned by the City of Paducah as shown by the deed
of record in Deed Book 1082 Page 538 of the records of the McCracken County
Court Clerk;
Thence, with a line common to the City of Paducah, South 82°28'10" West a
distance of 109.82 feet to an iron pin with cap set this survey at a corner common
to the lands now or formerly owned by Chambers Roofing Co., LLC as shown by
the deed of record in Deed Book 1082 Page 538 of the records of the McCracken
County Court Clerk;
Thence, with a line common to Chambers Roofing Co., LLC, North 16053'10"
East 109.82 feet to a 2 inch magnail set this survey in the root of a 24 inch
Hackberry tree;
Thence, with a line common to Chambers Roofing Co., LLC, North 82°28'10"
East 43.93 feet back to the point of beginning.
The above-described parcel of land contains 0.4538 acres more or less (19,768
sq.ft.).
All bearings referred to are based on the Kentucky State Plane South Zone (NAD
1983) obtained by Global Positioning System (GPS) observations.
All iron pins referred to in the above description ate 18" long %z" ribbed steel
rebar with a 1 ''/z" aluminum cap marked "LS 3901" and were set September 10,
2009.
Being a part of the same property conveyed to Grantor by deed dated August 27,
1986, and recorded in Deed Book 691, Page 342, McCracken County Court
Clerk's Office. Also, see deed dated August 27, 1986, and recorded in Deed
Book 717, Page 403, in aforesaid Clerk's Office.
SECTION 3. The Mayor is hereby authorized to execute a Quit -Claim
Deed and any necessary documents relating to same to accept the real property from
Paducah & Louisville Railway, Inc.
SECTION 4. This Order shall be in full force and effect from and after
the date of its adoption.
