AN ORDINANCE AMENDING ORDINANCE NO. 2003-3-6631.
WHEREAS, the Reidland Water -Sewer District ("District") at one time owned
and operated a water treatment facility and distribution system that provided water services to
residential and commercial customers located within its territory ("Reidland Customers"); and
WHEREAS, pursuant to the recommendation of the Commissioners of
Waterworks ("Water Commission"), the City entered into a written agreement with the District
dated June 30, 1999, whereby the City acquired the District's facility and system, and agreed to
operate that facility and system through its Water Commission; and
WHEREAS, pursuant to Section 8.3 of that agreement, the City agreed to provide
water services to the Reidland Customers under the District's then existing rate structure
("Reidland Rate Structure") for a period of ten (10) years ("Moratorium Period"), subject to
City's right to adjust the rate structure in accordance with the same percentage of increase that
City made to the rate structures of its other customers; and
WHEREAS, the Moratorium Period under the agreement has now expired, and in
accordance with its rights under Section 8.3, the City has the right and authority to gradually
merge the Reidland Rate Structure into the City's next lowest system rate, which is the City's
standard rate structure presently in effect; and
WHEREAS, the Water Commission has recommended that the Reidland Rate
Structure be gradually merged into the City's standard rate structure in annual increments over a
two (2) year period; and
WHEREAS, the City Commission finds that the Water Commission's
recommendation is in compliance with the City's long standing goal of establishing one unified
rate structure for all residential and commercial customers; and
WHEREAS, the City Commission also finds that the Water Commission's
recommendation is beneficial to the Reidland Customers since the proposed merger of rates will
generate additional revenues that will help fund the construction of a new reservoir and
transmission line system that will replace the District's old and deteriorating facilities that
currently serve these customers.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH,
KENTUCKY, AS FOLLOWS:
SECTION 1. Acceptance of Proposed Rate Structure. The City hereby
accepts the recommendation of the Water Commission to (i) merge the Reidland rate structure
into the City's standard rate structure, and (ii) to implement the merger in two annual increments.
SECTION 2. Amendment to Water Rates. Subsection (c) "Reidland
residential and commercial customers " of Section 2, Water Rates, is hereby amended to read as
follows:

Each amended rate schedule shall become effective on the effective date that is designated for
that schedule, and shall apply to all water bills rendered on or after that effective date. All water
product provided under those bills shall be billed in accordance with that rate schedule regardless
of when the water was supplied. The Water Commission shall have the authority to revise these
rates under Section 7 of this ordinance, including the authority to adjust the rates for increases in
the Consumer Price Index as provided under that Section.
SECTION 3. Amendment to Minimum Monthly Charges. Subsection (c)
"Reidland residential and commercial customers" of Section 3, Minimum Monthly Charges, is
hereby amended to read as follows:
