ORDINANCE NO. 78-11-1644
AN ORDINANCE AMENDING THE EXISTING WATER RATE ORDINANCE OF
THE CITY OF PADUCAH , KENTUCKY, SO AS TO INCREASE WATER RATE AND MINIMUM
CHARGES- FOR WATER- SERVICE TO CUSTOMERS -OF THE PADUCAH WATER WORKS
BOTH INSIDE AND OUTSIDE THE CORPORATE .LIMITS OF THE CITY
- WHEREAS , the City has made an: extensive study of the needs of the
Paducah. Water Works -and has determined that major renewals, replacements, additions,
extensions 'and improvements of the existing Water Works should be undertaken in order
to reasonably serve the customers. of such Water- Works, and- because of the rising
operating expenses and declining surplus income of the Paducah Water Works, the
Board of Commissioners of the City of Paducah, Kentucky, deems it necessary and
desirable to amend the existing Water Rate Ordinance, enacted on September 23, 1975,
so as to increase the water rates and charges to customers of said Water Works, both
inside and outside the corporate limits of the City, pursuant to recommendations of
the Commissioners of the Water Works,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD -OF COMMISSIONERS
OF THE CITY OF PADUCAH , KENTUCKY ; AS FOLLOWS:
SECTION 1. That the City of Paducah accept the recommendation of the
Commissioners of the Paducah Water Works, and that Ordinance No. 75-9-1174, en-
acted on September 23, 1975 (the 111975 Rate Ordinance") , is hereby amended to
increase water rates and minimum charges for water service to customers both inside
and outside the corporate limits of the City of Paducah, as follows:
1. NEW WATER RATES.
That the rates for water service furnished by the Paducah Water Works
are hereby fixed and established as follows:

The minimum monthly charge to customers inside the City Limits having a
5/8 inch meter shall be $2.70 per month, and each such customer shall be entitled
to 1,500 gallons of water per month for such minimum charge. The minimum monthly

charge for all size meters and the applicable water consumption to which such
customer shall be entitled for such minimum monthly charge, are_ as follows:

(e) Minimum Bi -Monthly Charges
The minimum bi-monthly water bill shall be $5.40, and each customer
shall be entitled to 3,000 gallons of water for a bi-monthly period for such minimum
rate.

(b) Minimum Monthly, Charges
The minimum monthly charge to customers -outside the City Limits, having
a 5/8 inch meter, shall be $5.22 per month, and each customer shall be entitled to
2,500 gallons of water per month for such minimum charge. The minimum monthly
charge to customers outside the City Limits for all size meters and the applicable

water consumption to which such customers shall be entitled for such minimum monthly
charge, are as follows:

In addition to the rates and charges set out in 1B (a). (b) and (c).
above, a surcharge shall be added to the monthly bills of customers in certain
areas outside the City limits, as follows:

The proceeds of the surcharge in, the, respective areas shall be applied
to retire indebtednesses incurred by the Paducah Water Works (and/or bonds
issued by the City) in extending_ water mains into , the '. respective county areas.
SECTION 2. That all other provisions of the 1975 Rate. Ordinance are
hereby re-enacted and reaffirmed, and made a part hereof the same._ as if copied
in full herein.
SECTION 3. That the foregoing water rates and charges shall be.
effective beginning with the monthly or bi-monthly billing pe - riods immediately fol-
lowing the period during which this Ordinance becomes effective.
SECTION 4. That the foregoing rates are rates to be charged by the
Paducah Water Works, and any applicable State sales tax shall be added to each
bill as a separate charge.

SECTION 5. That nothing in this Ordinance shall be construed to affect
any contract, between the Paducah Water Works and any water district relative to
the amount__ and. method of -charging such water, district for water furnished by the
Paducah Water _ Works.
SECTION ,6. That if any clause,. -provision, paragraph or section of _.
this Ordinance _ shall be ruled. void or ,unenforceable by any. court of competent
jurisdiction,, the ,remainder _hereof is intended to be enacted .and, shall be.,in full
force and effect notwithstanding .
SECTION 7. That all ordinances, and parts of. ordinances in conflict
herewith are, to the extent of such, conflict, hereby -repealed. .
SECTION 8. That this .Ordinance shall be introduced at a meeting of
the Board of Commissioners and remain on file for at least one week. for public -
inspection, in the completed form in which. it .shall be put .on its final passage, and,
if adopted , shall be in full force and effect ten days thereafter.
