AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE
A QUITCLAIM DEED WITH JAMES ROBERT HARPER AND WIFE, JULIA HARPER,
CLARIFYING THE BOUNDARY LINE BETWEEN PROPERTY OWNED BY JAMES ROBERT
HARPER AND WIFE, JULIA HARPER, AND THE CITY OF PADUCAH, KENTUCKY
WHEREAS, James Robert Harper and wife, Julia Harper, own real
estate located at 3400 Jefferson Street within the City of Paducah, Kentucky, and
WHEREAS, there is a discrepancy as to the exact location of the boundary
line between the properties owned by James Robert Harper and wife, Julia Harper,
and the right of way of the City of Paducah, and further the discrepancy is to the
boundary line between the real estate owned by James Robert Harper and Julia
Harper, and Emmett E. Clark and wife, Eureda W. Clark, who reisde at 3260
Jefferson Street, Paducah, Kentucky, and
WHEREAS, it is the desire of the Board of Commissioners of the City of
Paducah to clarify the boundary line.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Mayor and City Clerk, for the consideration of $1.00,
be authorized to execute a Quitclaim Deed to James Robert Harper and wife, Julia
Harper, describing the boundary line existing between the real estate owned by
James Robert Harper and wife, Julia Harper, and the right of way line of the City
of Paducah, more particularly described as follows:
Beginning at a 4" x 4" concrete marker in the east property line
of the Harper property South 31 degrees 30 seconds East, 19.3
feet from the southerly right of way line of West Jefferson Street,
said 4" x- 4" concrete marker ..also: being -at the -intersection of - the
northerly right of way line of West Jefferson, if extended, and the
easterly right .of way line: of,NQrth 35th. -Street, if -extended; thence
North 31 degrees 30 seconds west a distance of 19.3 feet to the
southerly right of way line of West Jefferson; thence in a westerly
direction along the southerly right of way line of West Jefferson
a distance of 83.8 feet to a point; thence in an easterly direction
along the southerly right of way of West Jefferson, if extended, a
distance of 90 feet more or less to the point of beginning.
Being in all respects, a part of that property reflected in Block
Map. No. 9, page 47, Paducah City Engineer's Office, and further,
a part of that property conveyed to the parties of the third part
by deed dated August 8, 1979, of record in Deed Book 620, page
791, McCracken County Court Clerk's Office.
SECTION 2. This ordinance shall be introduced and remain on file for one
week for public inspection in the completed form in which it shall be put upon its
final passage, and if adopted shall be in full force and effect ten (10) days there=
after.
