ORDINANCE NO. 79-10-1812
AN ORDINANCE AMENDING THE FRANCHISE AGREEMENT WITH COMCAST
CABLE OF PADUCAH, INC . , BY DELETING THE REQUIREMENT OF A SIGNAL LEVEL
AND FAULT REPORTING SYSTEM.
WHEREAS, the Franchise Agreement between the City of Paducah and
Comcast Cable of Paducah, Inc . , calls for a signal level and fault reporting system, and
WHEREAS, Comcast Cable of Paducah, Inc . , has requested the City of
Paducah to approve a variance in the Franchise Agreement, eliminating the require-
ment for a signal level and fault reporting system, and
WHEREAS, the Paducah Cable Communications Authority, on August 16,
1979, recommended that the City of Paducah waive the requirement in the Franchise
Agreement for theJ signal level and fault reporting system, and
WHEREAS, ComcastCable of Paducah, Inc . , has offered to provide the
City of Paducah with funds equal to the amount of the purchase and operation of the
signal level and fault reporting system, which equal $19, 000, and
WHEREAS, it would be advantageous for the City of Paducah to use the
funds toward the purchase of production equipment for the operation of the Govern-
mental Access Channel.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the Franchise Agreement between the City of Paducah,
Kentucky and Comcast; -Cable ,of Padaxcah, Inc...-, dated the .lst day of, April, -1975, be
and it is hereby,. -amended by. deleting. from paragraph- IV of_ attachment B. the follow-
ing:
"Be initially constructed and energized to include a signal level and
fault reporting system via the "A" cable return path and also ..... "
SECTION 2. Comcast Cable of Paducah, Inc . , shall pay to the City of
Paducah, in consideration of the deletion of the signal level and fault reporting
system requirement, the sum of $19,000 which represents a savings to Comcast Cable
of Paducah, Inc . , in equipment and operating expenses for the term of the franchise
agreement.
SECTION 3. This ordinance shall be introduced and remain on file for
one week for public inspection in the completed form in which it shall be put
upon its final passage, and if adopted shall be in full force and effect ten (10) days
thereafter.
