ORDINANCE NO. 79-10-1809
AN ORDINANCE AMENDING THE EXISTING WATER RATE ORDINANCE
OF THE CITY OF PADUCAH, KENTUCKY, SO AS TO MODIFY THE WATER RATES
FOR WATER SERVICE TO LONE OAK WATER DISTRICT, A CUSTOMER OF THE
PADUCAH WATER WORKS.
WHEREAS, the City has made an extensive study of the needs of the
Paducah Water Works and -has determined that major renewals, replacements,
additions, extensions and improvements of the existing Water Works should be
undertaken in order to reasonably serve the customers of such Water Works, and
because of the necessity to finance such major capital improvements, and because
of the rising operating expenses and declining surplus income of the Paducah
Water Works, the Board of Commissioners of the City of Paducah, Kentucky, deems
it necessary and desirable to amend the existing Water Rate Ordinance, enacted
on November 14, 1978, so as to modify the water rates and charges to customers
of said Water Works, both inside and outside the corporate limits of the City,
pursuant to recommendations of the Commissioners of the Water Works.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COMMISSIONERS
OF THE CITY OF PADUCAH, KENTUCKY, AS FOLLOWS:
SECTION 1. That the City of Paducah accept the recommendation of the
Commissioners of the Paducah Water Works, and that Ordinance No. 78-11-1641,
enacted on November 14, 1978 (the 111978 Rate Ordinance") , is hereby amended so
as to charge the Lone Oak Water District $1.18 per 1,000 gallons of water for the
first one million gallons of water per month, and $0.86 per 1,000 gallons for all
water over one million gallons per month, such water to be furnished to such
District pursuant to a Contract between the City and such District dated March
31, 1947, which expires July 1, 1982.
SECTION 2. That all other provisions of the 1975 Rate Ordinance are
hereby re-enacted and reaffirmed, and made a part hereof, the same as if copied
in full herein, except to the extent that such 1975 Rate Ordinance may be other-
wise amended by another ordinance or ordinances which has or have become
effective or may become effective, since the effective date of such 1975 Rate
Ordinance.
SECTION 3. That the foregoing water rates and charges shall become
effective beginning with the monthly or bi-monthly billing period following the
expiration of the current billing period with reference to such District.

SECTION 4. That the foregoing rates are rates to be charged by the
Paducah Water Works, and any applicable State sales tax shall be added to each
bill as a separate charge.
SECTION 5. That if any clause, provision, paragraph or section of
this ordinance shall be ruled void or unenforceable by any court of competent
jurisdiction, the remainder hereof is intended to be enacted and shall be in
full force and effect notwithstanding.
SECTION 6. That all ordinances and parts of ordinances in conflict
herewith are, to the extent of such conflict, hereby repealed.

SECTION 7. That this ordinance shall be introduced at a meeting of
the Board of Commissioners and remain on file for at least one week for
public inspection in the completed form in which it shall be put upon its final
passage, and, if adopted, shall be in full force and effect ten (10) days there-
after.
