ORDINANCE NO. 79-12-1827
AN ORDINANCE APPROVING THE FINAL REPORT OF THE PLANNING COM-
MISSION AMENDING SECTION 40.021 OF THE PADUCAH ZONING ORDINANCE - 1976
SO AS TO EFFECT SUCH REZONING
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That a resolution;, adopted by the Paducah Planning Commission
on ' December 3, 1979, ' entitled " A RESOLUTION CONSTITUTING THE FINAL REPORT
OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED AMENDMENT OF 'SECTION
40.021, OF THE PADUCAH ZONING ORDINANCE - 1976", be approved as' the final
report of said Commission respecting the matter therein set forth.
SECTION 2. That Section 40.021 of the ' Paducah . Zoning , Or'dinance - 1976
be, and the'sa ne is hereby, amended and reordained so that said Section 'as amended
and reordained shall hereafter read as follows:
40.021 Nonconformin- Uses
A nonconforming use or structure existing at the time of the adoption
of this Ordinance, which -was conforming at the time of its erection,
may be continued in use, although such use does not conform to the
provisions of such regulations.
With the formal authorization of the Board of Adjustment granted - after
a public hearing duly' advertised and after its determination that the
properties `in the general vicinity will ,not be -adversely affected b_ y
the change, an existing nonconforming use, may be changed to a new
nonconforming use in the same or more restrictive zone -classification.
A building or structure which is the subject of a nonconforming use
may" be ' maintained and repaired, but may not be enlarged or' moved
on the lot on which it is -situated..
A building or structure which does not comply .-with the dimensional
requirements of this' Ordinance may be maintained, repaired, `altered,
or moved, provided that every portion so enlarged. or moved ,,shall
be made to conform to all the regulations of the zone in which the
structure is located.
A building or structure which is nonconforming, either with respect
to its use 'or with -respect to dimensional requirements on the lot where
it is situated, which_ is damaged or destroyed „by any_ cause to the
extent of more than 75% =of its value- or � area -shall not; be repaired or
rebuilt except in conformance with the provisions_ of this Ordinance.
40.022. Delete
SECTION 3. That if any section, paragraph or provision of this ordinance
shall be found to be inoperative, ineffective or invalid for any cause, the deficiency
of invalidity of such section, paragraph or provision shall not affect any other
section, paragraph or provision hereof, it being' the purpose and intent of this

ordinance to make each and every section, paragraph and provision hereof separable
from all other sections, paragraphs and provisions.
SECTION 4. This ordinance shall be in fiill force and effect from and
after the date of its adoption.
