ORDINANCE NO. 79-6-1748
AW ORDINANCE AUTHORIZING THE SALE OF RIGHT OF WAY BY THE CITY
OF PADUCAH , KENTUCKY, TO THE COMMONWEALTH OF KENTUCKY FOR THE USE AND
BENEFIT OF THE DEPARTMENT OF TRANSPORTATION IN THE CONSTRUCTION OF THE
RIVERFRONT ACCESS ROAD, SECTION 73-6577-9R2
BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF
PADUCAH, KENTUCKY:
SECTION 1. That for and in consideration of the sum of $550.00 the City
of Paducah, Kentucky, does hereby authorize the sale to the Commonwealth of Kentucky
for the use and benefit of the Department of Transportation, a parcel of land lying
and being in McCracken' County, Kentucky and being a portion of the same tract of
land conveyed to the party of the first part by S. B. Pulliam, et al, by deed bearing
date of 13th day of May, 1941, which is duly recorded in Deed Book No. 209 at
page 364 in -the office of the County Court Clerk of McCracken County, Kentucky, said
parcel being described as follows:
Beginning at a point in the grantors southeast property corner,
said point, also being;. in the, .existing. east right., of way line -of-
5th Street, said point also being 0.16 feet left of Riverfront Ac-
cess Road Sta. 151+.67.41; thence -N 29.;degrees n_minutes_ 08 seconds.,...,
W, along the east right of way line of 5th Street, 39.76 feet to
a point 43.00 feet left of Riverfront Access- Road Sta. 151+46.60
thence S 63 degrees 06 minutes E 23.71 feet to a point 33.00 feet left
of Riverfront,_Access Road. Sta. 151+68.10,.„thence S,-,8.8 degrees -..02::
minutes 35 seconds E 38.04 feet to a point in the grantors south pro-
perty line, said point being 33.00 feet left of Riverfront. Access .Road
Sta. 152+06.14; thence S 60 degrees 20 minutes 32 seconds W, along
the grantors south property line, 45.48 feet to the point of beginning.
The above described Parcel 109 contains 713 square feet.
It is the specific intent of the grantors herein to convey in fee
simple the property described above and designated as Parcel 109
containing 713 s . f . of which 713 s . f . is new right of way to be
acquired and 0.._0.0. (none)„s.f. is .existing right of way. _
Also a tract ..of land lying -immediately, ,adjacent. to ,and on- the,. left
or north `side of Parcel 109 and more particularly described as
follows:
(a) Beginning at a point in the existing east right of way line of
5th Street, said point also being 43.00 feet left of Riverfront Ac-
cess Road Station 151+46.60; thence S 88 degrees 02 minutes 35 seconds
E. 75.78 feet to a point in the grantors south property line, said
point being 43.00 feet left of Riverfront Access Road Sta. 152+22.38;
thence S 60 degrees 20 minutes 32 seconds W 19.08 feet to a point
33.00 feet left of Riverfront Access Road Sta. 152+06.14; thence
N 88 degrees 02 minutes 35 seconds W 38.04 feet to a point 33.00 feet
left of Riverfront Access Road Station 151+68.10; thence N 63 de-
grees 06 minutes W 23.71 feet to the point of beginning.
The above described Parcel (a) contains 569 s . f .
It is the intent of the grantors herein to convey a construction
easement to the above described Parcel (a) for the purpose of
constructing backslopes and said easement terminates and re-
verts upon completion of same.

The acquisition of right of way for this project was authorized
by the Ky. Bureau of Highways Official Order No. 82967. The
control of access on the project shall be by _permit as required _
and set forth in Sec. 5 of the Ky. . Administrative Regulations
(603 KAR 5:010).
The proposed public road extends, from US 45 to.. 3rd, 4th and
Monroe Streets'.
SECTION 2. That the Mayor be, and he is hereby, authorized and directed
to enter into a deed of conveyance for the aforesaid purpose.
SECTION 3. This ordinance shall be introduced and remain on file for one
week for public inspection in the completed form in which it shall be put upon its
final passage, and if adopted shall be in full force and effect ten (10) days there-
after.
