Association„ Robert, Ray Smith, Claudine Smith, and Shelton Metrology Laboratory, , .Inc .r, .are necessary, for the construction and maintenance of a- 16. inch, water , main. by .Paducah Water., Works:.,Commission, and WHEREAS , the :Paducah .Water Works Commission by resolution dated March 26, 1979, requested the instituting of condemnation. proceedings on its be- half , and _. - - .- . WHEREAS , it does not appear that a purchase or. easement agreement can be reached at this time with the owners of the subject property, and WHEREAS , the Board of Commissioners of the City of Paducah , Kentucky , does therefore agree with the request of the Paducah Water Works Commission that it will be necessary to institute condemnation proceedings pursuant to the Kentucky Revised Statutes to acquire easements across said properties; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE CITY OF PADUCAH_, KENTUCKY: - _ _ . SECTIQN..1. , That..the Corporation. Counsel.b.e-,. and,he :is hereby, ordered and directed to institute condemnation proceedings in the McCracken Circuit Court in the name of the City for arri on behalf of the Paducah Water Works Commission against Home Federal Savings and Loan Association, Robert Ray Smith, Claudine Smith and Shelton Metrology Laboratory, Inc. , and all other parties in interest, to acquire the necessary easement rights across the subject properties owned by the aforesaid parties . SECTION 2. That the easements to be acquired are more particularly described as follows: TRACT I -HOME FEDERAL SAVINGS AND LOAN ASSOCIATION TRACT: "Being a portion of a tract of land conveyed to Home Federal Savings and Loan Association by deed recorded in Deed Book 575, page 845, in the McCracken County Court Clerk's Office and being further described as a ten (10) foot wide strip of land extending along the south boundary of the entire afore- mentioned tract and adjacent to the North right-of-way line of U . S . Highways 60-62-68 (Beltline Highway) . The subject property is further described by a plat attached hereto and marked Exhibit 'A' ." 128 TRACT II -ROBERT RAY SMITH AND CLAUDINE SMITH TRACT: "Being a portion of a tract of land conveyed to Robert Ray ___ _ _ _ Smith .and Claudine.
