ORDINANCE NO. 83-12-2449
AN ORDINANCE CREATING SECTIONS 20-250 THROUGH 2O-290 TO CHAPTER 20, MOTOR VEHICLES
AND TRAFFIC, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Section 20-250 be created to read as follows:
'>SEC. 20-250. Traffic Commission created; membership; compensation;
general duties.
(a) There is hereby established a traffic commission to serve without compensation,
consisting of the City Manager, Chief of Police, a member of the Police Department designated
by the Chief of Police, and a representative of the City Engineer's Office.
(b) It shall be the duty of the Commission, and to this end it shall have the -
authority within the limits of the funds at its disposal, to coordinate traffic activities; to
carry on educational activities in traffic matters; to supervise the preparation and publi-
cation of traffic reports; to receive complaints having to do with traffic matters; to recom-
mend to the Board of Commissioners and City Officials ways and means for improving traffic
conditions and the administration and enforcement of traffic regulations".
SECTION 2. That section 20-251 be created to read as follows:
"SEC. 20-251. Authority to order installation of traffic devices; duty
to install; maintain.
(a) The traffic commission shall order the installation of official traffic -control
devices, including crosswalks, when and as required under the traffic ordinances of the City
to make effective the provisions of said ordinances, and may order the installation of such
additional official traffic -control devices as it may deem necessary to regulate, warn or
guide ,traffic under the traffic ordinances of the City or the state vehicle code or the laws
of: t^he: state.
(b) It shall be the responsibility of the Maintenance Department to install and
maintain all traffic control devices and markings".
SECTION 3. That section 20-252 be created to read as follows:
"SEC. 20-252. Obedience to traffic -control devices required; exceptions.
The driver of any vehicle shall obey the instructions of any official traffic
control, -device- applicabTe - the-reto, placed -in = acdordanc,d with - the :provi-sions- of this chapter or
state law, unless otherwise directed by a police officer, subject to the exceptions speci-
fically'gxanted the driver of an authorized emergency vehicle".
SECTION 4. That section 20-253 be created to read as follows:
"SEC. 20-253. Driving to avoid traffic signals.
It shall be unlawful for the operator of any vehicle to undertake to avoid the
effectjof a traffic signal light or other traffic -control device, by leaving the street or
passing through any business establishment lot or other vacant space or corner".
SECTION 5. That section 20-254 be created to read as follows:
"SEC. 20-254. When traffic -control devices required for enforcement
purposes, exception.
No provision of this chapter for which official traffic -control devices are required
shall be enforced against an alleged violator if at the time and place of the alleged
violation an official device is not in proper position and sufficiently legible to be seen by
an ordinarily observant person. Whenever a particular section does not state that official
traffic -control devices are required, such section shall be effective even though no devices
are erected or in place".
RECTION 6. That section 20-255 be created to read as follows:
"SEC. 20-255. Rebuttable presumption that traffic -control devices are
legally placed.
(a) Whenever official traffic -control devices are placed in position approximately
conforming to the requirements of this chapter, such devices shall be presumed to have been so
placed by the official act or direction of lawful authority, unless the contrary shall be
established by competent evidence.
(b) Any official traffic -control device placed pursuant to the provisions of this
chapter or any state law and purporting to conform to the lawful requirements pertaining to "
such devices shall be presumed to comply with the requirements of this chapter, unless the
contrary shall be established by competent evidence".
SECTION 7. That section 20-256 be created to read as follows:
"SEC. 20-256. Authority to establish, designate play streets.
The traffic commission shall have the authority to declare any street or part
thereof a play street and to place appropriate signs or devices in the roadway indicating and
helping to protect the same".
SECTION 8. That section 20-257 be created to read as follows:
"SEC. 20-257. Driving on play streets restricted.
Whenever authorized signs are erected indicating any street or part thereof as a
play street, no person shall, -drive a vehicle upon any such street or portion thereof except
drivers of vehicles having business or whose residences are within such closed area, and then
any said driver shall exercise the greatest care in driving upon any such street or portion
thereof".
SECTION 9. That section 20-258 be created to read as follows:
"SEC. 20-258: Traffic commission to designate crosswalks and establish
safety zones.
The traffic commission is hereby authorized to do the following:
(a) Designate by appropriate devices, marks or lines upon the surface of
the roadway,,crosswalks at intersections where in its opinion there
is particular danger to pedestrians crossing the roadway, and at such
other places <as it may deem necessary.
(b) Establish safety zones of such kind and character and at such places
as it `may deem necessary for the protection of pedestrians.
SECTION 10. That section 20-259 be created to read as follows:
"SEC. 20-259. Traffic commission authorized to have traffic
.:lanes marked.
The traffic commission may authorize the marking of traffic lanes upon the,.roadway
of any street or:highway where a regular alignment of traffic is necessary".

"SEC. 20-260. Authority to designate through streets.
The traffic commission may designate streets or parts of streets as through

SECTION 12. That section 20-261 be created to read as follows:
"SEC. 20-261. Duty to place, maintain signs at through streets.
Whenever, the.,traffic,commisaion designates and.described a through street, it shall
be-,the„duty, of the maintenance department: to place, and .maintain. a, stop sign .,or ',a, yield !sign• on
each apd ,every street intersecting such through street, unless traffic at any such inter-
section,is..controlled at. all times by traffic -control signals; provided, however, that at the
intersection of two (2) such through streets or at the intersection of a through street and a
heavy, traffic street not so designated, stop signs shall be erected at the approaches of
either_of..Y ,said streets as may be determined by the traffic commission".

,r .._SECTION 13. That section 20-262 be created to read as follows:
"SEC. 20-262. Authority to designate, install stop, yield signs on
other than through streets.
The traffic commission is authorized to determine and designate intersections where
particular hazard exists upon other than through streets and to determine:
(a) Whether vehicles shall stop at one or more entrances to any such inter-
section, in which event it shall cause to be erected a stop sign at every
such place where a stop is required, or
(b) Whether vehicles shall yield the right-of-way to vehicles on a different
street at such intersection, in which event it shall cause to be erected a
yield sign at every place where obedience thereto is required".
SECTION 14. That section 20-263 be created to read as follows:
"SEC. 20-263. Authority to designate one-way streets;
installation of signs.
The traffic commission may designate one-way, streets or alleys and authorize the
installation of signs giving notice thereof, and no such designation shall be effective unless
such signs are in place. Signs indicating the direction of lawful traffic movement shall be
placed at every intersection where movement of traffic in the opposite direction is pro-
hibited".
SECTION 15. That.section 20-264 be created to read as follows:
"SEC. 20-264. Obedience to one-way signs required.
Upon those streets and parts of streets and in those alleys designated as one-way,
vehicular traffic shall move only in the indicated direction when signs indicating the di-
rection of traffic are erected and maintained at every intersection where movement in the
opposite direction is prohibited".
SECTION 16. That section 20-265 be created to read as follows:
"SEC. 20-265. Authority to restrict direction of movement during
certain periods; installation of signs.
The traffic commission is authorized to determine and designate streets, parts of
streets or specific lanes thereon upon which vehicular traffic shall proceed in one direction
during one period and the opposite direction during another period of the day and shall
authorize the installation of appropriate markings, signs, barriers or other devices to give
notice thereof. The traffic commission may authorize the installation of signs temporarily
designating lanes to be used by traffic moving in a particular direction, regardless of the
center line of the roadway".

SECTION 17. That section 20-266 be created to read as follows:
"SEC. 20-266. Signals.
(a) No person shall turn a vehicle from a direct course upon a highway unless and
until such movement can be made with reasonable safety, and only after a clearly audible
signal has been given by sounding the horn if any pedestrian shall be affected by the move-
ment. No persons shaII;4o''fuifi any vehicle without giving -an appropriate signal in the manner
hereinafter provided in the event any other vehicle may be affected by such movement'.
(b) A signal of -the- intention to turn right or left shall be given con- tinuously
for not less than the last one'hundred (100) feet traveled by the vehicle before turning.
(c) No person shall'stop or suddenly decrease the speed of a vehicle without first
giving an appropriate signal in the manner provided herein to the operator of any vehicle
immediately in the rear when there is opportunity to give such signal.
(d) All signals required herein shall be given either by means of the hand and arm
or by a signal lamp or lamps or a mechanical signal device, except that the operator of a
motor vehicle used for'the transportation of persons for hire, with taxicabs excluded, the
operator of a school or church bus, and the operator of any vehicle so constructed or loaded
that a hand and arm 'signal would not be visible both to the front and rear of such vehicle
shall indicate an intention to turn by use of a signal lamp or lamps or mechanical signal
device and must indicate an intention to stop or suddenly decrease speed by illuminating at
least one red or yellow light with the word "Stop" on it on the rear of the vehicle.
(e) All signals herein required given by hand and arm shall be given from the left
side of the vehicle in the following manner, and such signals shall indicate as follows:

(1) Left turn - hand and arm extended horizontally;
(2) Right turn - hand and arm extended upward;
(3) Stop or decrease speed - hand and arm extended downward".
SECTION 18. That section 20-267 be created to read as follows:
"SEC. 20-267". Authority to place devices indicating required
turns.
The traffic commission may authorize the placing of official traffic- control
devices within or adjacent to intersections indicating the course to be traveled by vehicles
turning at such intersections, and such course to be traveled as so indicated may conform to
or be other than as prescribed by law".
SECTION 19. That section 20-268 be created to read as follows:
"SEC. 20-268. Authority to,designate turns at intersections; -placing 9f
. signs.
The traffic commission is authorized to determine those intersections at which
drivers of vehicles shall not make a right, left or "U" turn, and to authorize the placing of
proper signs at such intersections.. The making of such turns may be prohibited between
certain hours of any day and permitted at other hours, in which event the same shall be
plainly indicated on the signs or they may be removed when such turns are permitted".
SECTION 20. That section 20-269 be created to read as follows:
"SEC. 20-269. Obedience to turn signs.
Whenever authorized signs are erected indicating that no right or left or "U" turn

is permitted, no driver of a vehicle shall disobey the directions of any such sign".

SECTION 21. That section 20-270 be created to read as follows:
"SEC. 20-270 Decreasing state speed limits in certain zones.
When the traffic commission determines upon the basis of an engineering and traffic
in-ve-stigation that the speed of thirty-five (35) miles per hour permitted,r;by state law is
greater than is necessary for safe operation of vehicles on certain streets, the commission
shall designate the maximum speed limit and order the installation of appropriate signs. The
street 'speed limit ordered shall be effective when signs are in place giving notice thereof".
SECTION 22. That section 20-271 be created to read as follows:
"SEC. 20-271. Size restrictions upon vehicles using certain streets,
It has been determined by the traffic commission that based on an engineering and
traffic investigation the size of vehicles permitted by state law is greater than physical
conditions will allow upon certain streets or parts of streets when signs are erected giving -
notice thereof, no person shall operate any vehicle exceeding the dimensions specified on the
signs".
SECTION 23. That section 20-272 be created to read as follows:
SEC. 20-272. Restrictions upon use of streets by certain vehicles.
(a) The traffic commission is hereby _aiithorized to determine and designate those
heavily"traveled streets upon which shall be prohibited the use of the roadway by motor -driven
cycles, bicycles, horse-drawn vehicles or other nonmotorized traffic and shall erect appro-
priate signs giving notice thereof".
SECTION 24. That section 20-273 be created to read as follows:
SEC. 20-273. Traffic commission to designate, mark street for angle.
parking.
The traffic commission shall determine upon what streets angle parking shall be
permitted and shall authorize the marking or placing of signs on such streets".
SECTION 25. That section 20-274 be created to read as follows:
"SEC. 20-274. Parking prohibited on streets.
(a) The traffic commission may authorize the erection of signs indicating no
parking upon any street when the width of the roadway does not exceed twenty (20) feet, or
upon one side of a street as indicated by such signs when the width of the roadway does not
exceed thirty (30) feet.
(b) When official signs prohibiting parking are erected upon narrow streets as
authorized herein, no person shall park a vehicle upon any such street in violation of any
such sign".
SECTION 26. That section 20-275 be created to read as follows:
"SEC. 20-275. No stopping, standing or parking near hazardous or
congested places.
(a) The traffic commission is hereby authorized to determine and designate by
proper signs places not exceeding one hundred (100) feet in length in which the stopping,
standing or parking of vehicles would create an especially hazardous condition or would cause
unusual delay to traffic.
(b) When official signs are erected at hazardous or congested places as authorized
herein, no person shall stop, stand or park a vehicle in any such designated place".

SECTION 27., That section 20-276 be.created to read as follows:
"SEC. 20-276. Parking adjacent to schools.
(a) The. traffic_ commission may authorize the erection of signs indicating no
parking upon either or both sides of any street adjacent to. any school property when such
parking would, in its opinion, -interfere with traffic or create a hazardous situation.
(b) When official signs are erected indicating no parking upon either side of a
street adjacent to any school,property as authorized herein, no person shall park a vehicle in
any such designated place".
SECTION 28. That -section 20-277 be created to -read as follows:
"SEC. 20-277. Parking prohibited during certain hours on certain
streets.
The traffic commission may designate streets and parts of streets where parking is
prohibited during certain hours. When signs are erected giving notice thereof, no person
shall park a vehicle between hours specified on signs upon any streets or parts of streets
where such signs are in place".
SECTION 29. That section 20-278 be created to read as follows:
"SEC. 20-278. Stopping, standing or parking prohibited during certain
hours, on certain streets.
The traffic commission may designate streets and parts of streets where parking,
stopping or standing is prohibited during certain hours. When signs are erected giving notice
thereof, no person shall stop, stand or park a vehicle between the hours specified on signs
upon any streets or parts of streets where such signs are in place".
SECTION 30. That,s,ection 20-279 be created to read as follows:

"SEC. 20-279. Parking time limited on certain streets.
The traffic commission may designate certain blocks or parts of blocks where number
of hours of parking shall be limited. When signs are erected giving notice thereof, no
persons hall park a vehicle for longer than the time specified on the signs".
SECTION 31. That section 20-280 be created to read as follows:
"SEC. 20-280. Traffic commission to designate curb loading zones.
The traffic commission is hereby authorized to determine the location of freight
curb loading zones and authorize the placing of appropriate signs indicating the same and
stating the hours during which the provisions of this section are applicable".
SECTION 32. That section 20-281 be created to read as follows:
"SEC. 20-281. Traffic commission to designate taxicab stands.
The traffic commission is hereby authorized and required to establish taxicab stands
and stands for other passenger common -carrier motor vehicles on such public streets, in such
places and in such number as it shall determine to be of the greatest benefit and convenience
to the public, and every such bus stop, bus stand, taxicab stand or other stand shall be
designated by appropriate signs".
SECTION 33. Tha,t_,se.ction 20-282 be created to read as follows:
"SEC. 20-282. School zone.
(a) In those areas where the City of Paducah has control of the highway, it shall
be unlawful for any person to operate any motor vehicle at a speed in excess of fifteen (15)

miles per hour in any school zone where school flasher lights are in operation. In all areas
the governmental unit having control of the highway shall determine the speed limit.
(b) Highways as used in this section shall mean any public road or street main-
tained ,by the City, -County or State"
SECTION 34. That section 20-283 is created to read as follows:
"SEC. 20-283. Handicapped parking.
The Traffic Commission is hereby authorized to determine the number and location of
handicapped parking zones, and'authorize the placing of appropriate -signs indicating same.
-No person shall park in a handicapped designated zone unless the vehicle displays
handicapped license plates or other handicapped designation issued by the Commonwealth of
Kentucky:'
No person shall park an automobile in a parking spot designated for handicapped
parking on a public or private parking lot. The police officers of the City of Paducah are
authbrized>;to issue citations for the violation of this section":'
SECTION 35. That section 20-91 is amended to read as follows:
'SEC. 20-91. Penalty for violating sections 20-80, 20-82, 20-83, 20-84, 20-85,
20-86, 20-87, and 20-89.
Any person violating any provision of sections
crr---2A--7b, 20-80, 20-82, 20-83, 20-84, 20-85, 20-86, 20-87 or 20-89 shall be guilty
of a mledemean" violation and upon conviction thereof, shall be punishable by a
fine of` not less than ten dollars ($10.00) nor more than one hundred dollars

SECTION 36., That section 20-290 be created to read as follows:
"SEC. 20-290. A person. -violating any provision of section 20-250 through 20-273 or
20-282 shall be guilty of a violation and upon conviction shall be fined not less than $10.00
nor more -than $100.00. Any person violating section 20-274 through 20-278, 20-280 or 20-281
shall pay a penalty to the City of Paducah in the amount of $5.00. Any person found guilty of
violating section 20-279 shall be guilty of a violation and shall pay to the City of Paducah,
the sum of.$5.00. However, if said amount is paid within forty-eight (48) hours then it shall
be reduced to the sum of One Dollars ($1.00). Any person violating the provisions of 20-283
shall be guilty of a violation and upon conviction shall pay to the City of Paducah the sum of
$20.00".
SECTION 37. That sections 20-72, 20-73, 20-74, 20-75, 20-76, 20-77, 20-78, 20-79,
20-81, 20-88, 20-99, 20-100, 20-101; 20=102, 20-103, 20-106, 20-107, 20-118, 20-119, 20-122,
29-123, 20-124, 20-126, 20-127, 20-128, 20-143, 20-148 subsection (a), be repealed in their
entirety.
SECTION 38. This ordinance shall be read on two separate days and will be effective
upon publication in full.
