At a regular meeting of the Board of Commissioners held in the Commission Chamber
in the City.Hall, Paducah, Kentucky, at 7:30 p.m. on September 28, 1971, Mayor Cherry
presided and upon call of the Roll the following answered to their names: gommissioner
Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Mayor Cherry offered motion, seconded by Commissioner Fisher, that the reading
of the Minutes for September 14, 1971 be waived and that the Minutes of said meeting
prepared by the City Clerk be approved as written. Adopted on call of the Roll,
Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry
Mayor Cherry made the following appointment:

It appearing that the term of office of Jerry Page as a member of the Paducah -
(5) .
McCracken County Riverport Authority expired on September 26, 1971, I hereby, subject
to the approval of the Board of Commissioners, reappoint the said Jerry Page for a
further term of four (4) years, so that same shall be composed of the following members:
J. S. Piers whose term expires September 26, 1973
Gresham-Hougland whose term -expires September 26, 1974
Jerry Page whose term expires September 26, 1975.

Mayor Cherry made the following appointment:
WHEREAS, the term of office of Robert W. Levin as a member of the Paducah Planning
Commission expired on August 31, 1971, I hereby, subject to the appooval of the
Board of Commissioners, appoint Robert D. Seay as a member of said Commission for a
term of four (4) years, so that said Commission shall be composed of the following
members:
Wilbur M. Lee whose term expires August 31, 1972
Gordon Meeks whose term expires August 31, 1972
Andrew S. Wood whose term expires August 31, 1973

Commissioner Fisher offered motion, seconded by Commissioner Harvey, that the
Board of Commissioners approve the action of Mayor Robert C. Cherry appointing
Robert D. Seay as a member of the Paducah Planning Commission. Adopted on call of
the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Fisher offered motion, seconded by Commissioner Harvey, that the
Board of Commissioners approve the sale by the City to Cosmopolitan Mortuary of the
southwest corner of Lot 314 in Block 6 of the Rushing Addition to Oak Grove Cemetery,
and that the --City Clerk be authorized to execute a deed of conveyance to said cemetery
grave. Adopted on call of the Roll, Yeas, Commissioners Fisher, Harvey, Hornsby, Purye
and Mayor Cherry (5).

Commissioner Harvey offered motion, seconded by Commissioner Fisher, that the
report of the Election Commissioners showing the result of the City Primary Election
held on September 18, 1971, be received and filed. Adopted on call of the Roll, Yeas,
Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Harvey offered motion, seconded by Commissioner Fisher, that the
request of Carl Douglas for the closing of a portion of 29th Street lying west of
Mississippi Street and extending in a westerly direction a distance of 150 feet,
together with a copy of the motion adopted by the Paducah Planning Commission on Septemb
15, 1971 recommending the closing of same, be received and filed. Adopted on call of t

Commissioner Harvey offered motion, seconded by Commissioner Fisher that the clai
of B. W. Hulen and Sylvia Hulen in the amount of $38.20 for damage to their automobile
which was struck by Parks Director, Byron McGill on September 3, 1971, at 3300 Park
Avenue be approved, and that the City Treasurer be authorized to pay said claim after
first obtaining a complete and final release. Adopted on call of the Roll, Yeas,
Commissioners Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Harvey offered motion, seconded by Commissioner Fisher, that the
Certificate of Insurance issued by The Home Indemnity Company covering work done by
C. A. Wahl, Jr. d/b/a Amos Wahl Contractor, for the period ending October 1, 1972,
be received, approved and filed. Adopted on call of the Roll, Yeas, Commissioners
Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Hornsby offered motion, seconded by Commissioner Puryear, that the
claim of William Terry Gaines and Herb Jones Chevrolet Company of Eddyville, Ky. in the
amount of $128.50 for damage to a 1971 Chevrolet which was struck by a refuse packeA
operated by John B. Robertson at 13th & Kentucky Avenue be allowed, and that the City
Treasurer be authorized to pay said claim after first obtaining a complete and final
release from both parties. Adopted oncall of the Roll, Yeas, Commissioners Fisher,
Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Hornsby offered motion,_seco:nded by Commissioner Puryear, that the
Board of Commissioners approve the sale by the City of Paducah to Mundy Funeral Home

WHEREAS, on August 22, 1916 The Fidelity & Deposit Company of Maryland issued
Bond No. 12 749 56 in favor of the City of Paducah, Kentucky, on behalf of Western
Union Telegraph Company for indemnification from placing utility poles along city
right-of-way, and

WHEREAS, the Western Union Telegraph Company is nb longer placing poles along
city right-of-way in the City of Paducah, Kentucky, and said bond is no longer needed,
NOW THEREFORE, I move that the City Manager be authorized to execute a
cancellation request for said bond to be effective on August 22, 1971: Adopted on ca

Jesse Sparks Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that
sewer tap -on
2505 Cairo Road the letter from'Jesse Sparks dated September 23, 1971 pertaining to -a -sewer tap -on for
his property at 2505 Cairo Road, be received and filed, and he further moved that the
offer contained in said letter be accepted and that the City issue a sewer tap -on permit
upon receipt of payment in the sum of $500.00. Adopted on call of the Roll, Yeas,

executed -copy of the contract between the City and Ryan Paving Company,-Ihc., 'for sale
to the City of a-pproximately 40,000 square yards of bituminous slurry surface for
city streets be received and filed.- Adopted on call of the Roll, Yeas, Commissioners
Fisher, Harvey, Hornsby, Puryear and Mayor Cherry (5).
Commissioner Puryear offered motion, seconded by Commissioner Hornsby, that the
executed copy of the contract between the City of Paducah and Midwest ,Fire and Safety
Equipment Company, Inc., for sale to the City of one new 1,250 gallon per minute pumping
engine with dieset engine and cab forward over engin chassis, be received and filed.

Upon the recommendation of the City Manager, I move that the following personnel

1. The following sergeants in the Police Department be promoted to captains in said
department, at'a salary of $670.00 -per month:

AND IMPROVEMENT REVENUE BONDS, UNDER THE PROVISIONS OF SECTIONS 82.050 AND 58.010
58.140, INCLUSIVE, OF THE KENTUCKY REVISED STATUTES, AND THE PURPOSE OF PROVIDING FOR
THE REDEMPTION AND REFUNDING ON JANUARY 1, 1973, OF CERTAIN OUTSTANDING CITY OF P
PARKING FACILITIES REVENUE BONDS, DATED JANUARY 1, 1968, AND FOR THE PURPOSE OF PRO-
