HomeMy WebLinkAbout83-2-2356522 ORDINANCE NO. 83-2-2356 AN ORDINANCE AUTHORIZING THE SALE BY GENERAL WARRANTY DEED OF A STRIP OF LAND TO CONTEMPRA CORPORATION, c/o DAYS INN.. --I-24 & US 60W WHEREAS, the City of Paducah has acquired the Conrad Heights Treatment Plant real estate, and WHEREAS, Contempra Corporation, c/o Days Inn, I-24 & US 60W, Paducah, Kentucky, would like to purchase said property which is adjacent to their property, WHEREAS, said property is presently owned by the City of Paducah, Ken- tucky. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. The City of Paducah hereby accepts the offer of Contempra Corporation to purchase from the City of Paducah, the property located between the former Conrad Heights Treatment Plant and Days Inn Motel; and the Mayor and City Clerk are authorized to execute a deed from the City of Paducah, for the con- sideration of the sum.of $2,000.00, said property more particularly described as follows: Being that part of -the Ernestberger farm tract designated "Sewage Treatment Plant Site", as shown on a.plat of survey by Elmer Y. Hollis., registered.engineer, dated August 29, 1956, and attached hereto, and beginning at a concrete stone in.the southeasterly line of the tract herein conveyed at the point of intersection with the southwesterly line of an easement hereinafter described, which stone is South 61 degrees 42 minutes East 304..4 feet; South 45 degrees East 352.6 feet to another stone in the northerly right of way line of U. S. Highway 60, which is located North 45 degrees West 34.95 feet from a point.in the center line of said highway, which point is North 64 degrees 15 minutes East 1358.5 feet from the point of intersection,of the center line of U. S. Highway 60 and the center line of the Coleman Road, starting thence at the point of beginning, the concrete stone first mentioned above; thence South 48 degrees 18 minutes West 86.28 feet to an iron pipe; thence North 49 degrees 42 minutes West 146.9 feet,to an iron pipe in'the bed of Perkins Creek; thence North 21 degrees 33 minutes East 190.1 feet to an iron pipe in the bed of Perkins Creek; thence South 35 degrees 42 minutes East 232.0 feet to an iron pipe; thence South 48 degrees 18 minutes West through a concrete marker 38.97 feet to a concrete marker, the original point of beginning. Being a part of the same property conveyed to the City of Paducah by Conrad Heights Treatment .Plant, by deed dated the 7th day of July, 1982, and recorded in Deed Book 647, Page 29, in the McCracken County Court Clerk's office. SECTION 2. The City of Paducah shall retain two permanent sewer and utility easements, which are more particularly.described as follows: EASEMENT N0. 1. A parcel of land 20 feet in width, the centerline of which is more particularly described as follows: Beginning at a point in the southeast property line of the above described tract, said point being 5 feet more or less northeast of a concrete stone, said stone is the point of intersection of said property line and the south line of a 25 feet existing permanent easement as referenced in the above description; thence North 660 19' 58" West a distance of 20 feet more or less to a point; thence North 00 10' 02" East a distance of 100 feet more or less to the north property line of the above described tract. EASEMENT NO. 2. A parcel of land 20 feet in width, the centerline of which is more particularly described as follows: 523 Beginning at a point, said point being located in the north property line of the above described tract where said property bounds the William Donald Lynn James property and being approximately 40 feet southeast of the -northwest corner of said tract; thence South 560 40' 62" West a distance of approximately 70 feet to the west pro- perty line of the above described tract, common to Conrad L. and Virginia E. Slayden, said point being located in Perkins Creek. SECTION 3. The Corporation Counsel is authorized to draw all deeds and any other documents necessary to accomplish the purposes of this ordinances. SECTION 4. This ordinance shall be read on two separate days and will be effective upon publication of title and a certified copy thereof. JOEW K.
