AN ORDINANCE AMENDING SUB -SECTION 28-5 OF CHAPTER 28, STREETS AND SIDE-
WALKS, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Sub -section 28-5 of Chapter 28, Streets and Sidewalks of
the Code of Ordinances of the City of Paducah, Kentucky, be amended and reordained so
that said Section as amended and reordained shall hereafter read as follows:
"Sec. 28-5. Banners prohibited across or along streets and sidewalks -
Exceptions.
(a) It shall be unlawful for any person to suspend any banner across or
along any street, sidewalk or other public way of the city for the purpose of
advertising a person's candidacy for public office or for any other purpose.
(b) In order to promote general events of a civic and public nature in the
Central Business District, notwithstanding the prohibition set forth in Paragraph (a)
above, any person, firm, corporation or organization in charge of events of a civil
and public nature may hang a banner for two weeks across Broadway publicizing the
event, between Sixth and Seventh Streets, providing the subsequent guidelines are
followed. Banners for commercial advertisements reflecting price or product
promotion of goods or services are prohibited. Only one banner may be hung at any
one time.
1. Applications for a permit must be completed in the City
Treasurer's office and must contain the name of the person, firm
corporation or organization sponsoring the event; the dates the
banner is to be installed and remain above the street; and a
signed statement by the owners of the buildings giving the
applicant permission to attach the banner to their property.

3. The applicant must furnish to the City, public liability
insurance from a company licensed to transact business in the
Commonwealth of Kentucky, in the amount of one million dollars
($1,000,000) covering the period of time the banner is above
Broadway. The City and the owners of the buildings the banner is

(b c) Any person violating the provisions of this section shall be guilty
of a misdemeanor and, upon conviction thereof, shall be punishable by a fine of not
less than five dollars ($5.00) nor more than one hundred dollars ($100.00), and each
day such offense is committed shall be deemed a separate offense and shall be subject
to a separate penalty under the provisions of this section.

SECTION 2. This ordinance shall be read on two separate days and will be
effective upon publication of title and a certified summary thereof.
