ORDINANCE NO. 82-1-2199
AN ORDINANCE AMENDING.THE.EXISTLNG WATER;RATE ORDINANCE OR THE CITY OF
PADUCAH, KENTUCKY, SO AS TO INCREASE WATER RATES AND MINIMUM CHARGES FOR WATER
SERVICE TO CUSTOMERS OF THE PADUCAH WATER WORKS BOTH INSIDE AND OUTSIDE THE CORPORATE
LIMITS OF THE CITY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That the City of Paducah accept the recommendation of the
Commissioners of Water Works;-axe-that-A-FdiRaxee-Ale--78-11-1644-eRaetee--ex-Nevember

and minimum charges for -water service to customers,both-inside and=outside the�
corporate limits of the .Cit of -Paducah shall,. hereafter be -.as follows
1. NEW WATER RATES.
That the rates for water service furnished by the Paducah Water Works are
hereby fixed and established as follows:
A. RATES INSIDE CITY LIMITS
Water rates charged" to ir"idustri:al -customers with a monthly average' "of five' million
gallons usage may be negotiated at the discretion of the Commissioners of Water
Works.
(b) Minimum Monthly Charges
The minimum monthly charge to residential customers inside the city limits
having a 5/8 inch meter'shall.be-$2.68 3:93 -per month, and each such residential
customer shall be entitled to 1;5.00-gallons-.of�wat.er-per-month forsuch minimum
charge. The minimum monthly charge._to..commercial customers inside the_City-Limits
having a 5/8 inch meter shall be $ 7.12 per month, and each such commercial. customer
shall be entitled to 3,000 gallons of water per month for such minimum charge. The
minimum monthly charge for all other size meters and the applicable water consumption
to which such residential or commercial customer shall be entitled for such minimum
monthly charge, are as follows:

(b) Minimum Monthly Charges
The minimum monthly charge to residential customers outside the city
limits, having a 5/8 inch meter, shall be $4763 6.95 per month, and each such
residential customer shall be entitled to 2,500 gallons of water per month for such
minimum
charge. The minimum monthly charge to commercial customers outside the city limits
for all -size having a 5/8 inch meters shall be $13.90 per month, and each such
commercial customer shall be entitled to 5,000 gallons of water per month for such
minimum charge. The minimum monthly charge for all other size meters and the
applicable water consumption to which such residential or commercial customers shall
be entitled for such minimum monthly charge, are as follows:

(d) Surcharge_ .
In addition to the rates and charges set out -in 1B(a), (b), and (c) above,
a surcharge shall be added to the -monthly bills of customers in -certain areas outside
the city limits, as follows:

$0.50 of such surcharge in each month shall be applied to fire protection.
The proceeds of the surcharge in the respective areas shall be applied to
retire indebtednesses incurred by the Paducah Water Works (and/or bonds issued by the
City) in extending water mains into the respective county areas.

SECTION 2. FIRE MAINS AND FIRE PROTECTION SERVICE RATES INSIDE THE
CITY OF PADUCAH.
The charge to the City of Paducah for providing fire hydrants and adequate
mains for fire protection shall be $.0015 (1.5 mills) per diameter inch per linear
foot of mains now installed inside the City -limits or which may be hereafter
installed inside the City limits or which are in areas that are hereafter annexed by
the City.
SECTION 3. CONNECTION CHARGE.
A. New customers of the Water Works located within the City and County
limits shall pay the following connection charges per service:

B. New customers of the Water Works located Within -the City and County

C. The connection charges listed in 3A and 3B are based on the December,
1981, ENGINEERING NEWS RECORD construction cost index of $3,705.12. These charges
will be increased or decreased annually on January 1, based on the construction cost
index for the previous December.
SECTION 4. CUSTOMER PAYS COST OF RUNNING LINES ON HIS PREMISES.
Each customer is responsible for constructing and bearing the cost of
running his water line from the building located on his premises to the point in his
property line or easement where such water service has been brought or to such other
point to which such water line has been brought by the City to serve his premises.
The construction of said private lines shall be in accordance with the Paducah Water
Works regulations for materials and construction.
SECTION 5. INDEMNIFICATION AND SUPERVISION.
Each property owner shall indemnify the Paducah Water Works from any loss
or damage that may directly or indirectly be occasioned by the construction of a
water line from the respective premises to the point where the Paducah Water Works
has brought such line or lines, and all water connections shall be made under the
supervision of the Paducah Water Works.
SECTION -3- 6. EFFECTIVE DATE FOR NEW WATER RATES AND CHARGES.
The foregoing water rates and charges shall be effective as to existing
water customers for the next regular billing beginning as soon as practicable after
the effective date of this Ordinance.
SECTION -4- 7. RATES ARE EXCLUSIVE OF SALES TAX.
The foregoing rates are rates to be charged by the Paducah Water Works, and
any applicable State sales tax shall be added to each bill as a separate charge.
SECTION 8. ALL CUSTOMERS METERED: NO FREE SERVICE.
It shall be mandatory for all customers of the Paducah Water Works to be
metered. No one shall receive or be entitled to free water service without paying
the full rates herein specified. If any person is discovered using water from fire
connections for any purpose other than fire purposes, such person shall be charged
for such water the fire protection rate established in Section 1A(c) and Section
1B(c) above, plus the applicable rates prescribed in Section IA(b) and Section 1B(b)
above, and shall further be required, at his own expense,_ to install a meter on such

SECTION 9. REVISION OF RATES.
The schedule of rates and charges prescribed in this Ordinance shall be
revised from time to time, and whenever required shall be increased, so as to produce
income and revenues from said Water Works adequate to comply with such covenants and
agreements as may be made by the City in connection with any Revenue Bonds issued by
the City.

SECTION 10. RECORDS AND AUDITS.
That the rates and charges for use of and services rendered by the Paducah
Water Works shall be billed and collected by the Utility, and the full amount of the
proceeds for such service shall be deposited as received and set aside into the water
revenue fund designated, in such manner as the Water Works may require, but subject
to any different designation which may be made in any.ordinance relating to the
issuance of Revenue Bonds. The records of the Paducah Water Works with respect to
charging, billing, collecting and accounting for water service shall be audited at
least once each twelve months by an independent Certified Public Accountant,,and a
report thereof shall be filed with the City Clerk, or such report shall be filed in
such manner and at such other time or times as may be provided in any ordinance
relating to the issuance of Revenue Bonds. The cost of such audit shall be
classified and paid as an expense of operation and maintenance of the Water Works.
SECTION -S- 11. CONTRACTS WITH WATER DISTRICTS.
Nothing in this Ordinance shall be construed to affect any contract between
the Paducah Water Works and any water district relative to the amount and method of
charging such water district for water furnished by the Paducah Water Works.
SECTION -6- 12. SEVERABILITY.
If any clause, provision, paragraph or section of this Ordinance shall be
ruled void or unenforceable by any court of competent jurisdiction, the remainder
hereof is intended to be enacted and shall be in full force and effect
notwithstanding.
SECTION 13. CONFLICTING ORDINANCES.
All ordinances and parts of ordinances in conflict herewith are, to the
extent of such conflict, hereby repealed.
SECTION 14. ORDINANCE INTRODUCTION.
This ordinance shall be read on two separate days and will be effective
upon publication in full.
