HomeMy WebLinkAbout2014-08-817867 ORDINANCE NO. 2014-8-8178 AN ORDINANCE APPROVING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM R-2 (LOW AND MEDIUM DENSITY RESIDENTIAL ZONE) TO R-4 (HIGH DENSITY RESIDENTIAL ZONE) FOR PROPERTY LOCATED AT 1139 & 1179 LONE OAK ROAD AND 1121 SANDERS AVENUE, AND AMENDING THE PADUCAH ZONING ORDINANCE SO AS TO EFFECT SUCH REZONING BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That a Resolution passed by the Paducah Planning Commission on August 18, 2014, and entitled, "A RESOLUTION CONSTITUTING THE FINAL REPORT OF THE PADUCAH PLANNING COMMISSION ON THE PROPOSED ZONING CHANGE FROM R-2 (LOW AND MEDIUM DENSITY RESIDENTIAL ZONE) TO R-4 (HIGH DENSITY RESIDENTIAL ZONE) FOR PROPERTY LOCATED AT 1139 & 1179 LONE OAK ROAD AND 1121 SANDERS AVENUE" be approved as the final report of said Commission respecting the matters therein set forth. SECTION 2. That the zone classification and the map amendment proposed in said resolution be, and the same is hereby, declared to be in agreement with the Comprehensive Plan of the City of Paducah. SECTION 3. That the zone classification of the following described property be, and is hereby, changed from R-2 (Low and Medium Density Residential Zone) to R-4 (High Density Residential Zone): ZONE CHANGE LEGAL DESCRIPTION Rezoned from "R-2" (Low & Medium Density Residential Zone) to "R-4" (High Density Residential Zone) A certain tract of land containing 3.5423 acres located on the north side of U.S. Highway 45 (Lone Oak Road) between Sycamore Street and Hickory Street in Paducah, McCracken County, Kentucky, and being more particularly described as follows; Commencing at the centerline intersection of U.S. Highway 45 and Sycamore Street, Thence North 53 degrees 19 minutes 03 seconds East for a distance of 185.00 feet with the centerline of U.S. Highway 45 to a point in the centerline of said Highway, the True Point of Beginning of the herein described tract of land; THENCE North 53 degrees 19 minutes 03 seconds East for a distance of 293.00 feet with the centerline of U.S. Highway 45 to a point; THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 45.50 feet to a point on the north right-of-way line of U.S. Highway 45; THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 160.00 feet with the west line of Lot 9, Block 16 of L.D. Sander's Arcadia Subdivision recorded in Plat Section "A", Page 218-219, to a point in the south side of an undeveloped alley; THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 30.00 feet, crossing said alley to a point on the north side of said alley; THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 172.10 feet with the west line of Lot 12, Block 16 of L. D. Sander's Arcadia Subdivision recorded in Plat Section "A", Page 218-219 to a point on the south side of Sanders Avenue, a 40 foot right-of-way closed per City of Paducah Ordinance 2007-6-7294; THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 40.00 feet with the south line of said closed street to a point on the west line of a closed 15 foot wide alley, per City of Paducah Ordinance 2007-6-7294; THENCE North 36 degrees 41 minutes 52 seconds West for a distance of 137.90 feet with the west line of said closed alley to a point on the south side of an undeveloped alley; M THENCE South 53 degrees 18 minutes 08 seconds West for a distance of 253.00 feet with the south side of said alley to a point on the east side of an undeveloped alley; THENCE South 36 degrees 41 minutes 52 seconds East for a distance of 500.00 feet with the east side of said alley to a point on the north right-of-way of U.S. Highway 45; THENCE South 36 degrees 41 minutes 52 seconds East for a distance of 45.42 feet to a point in the centerline of said highway, being the True Point of Beginning. SECTION 4. That if any section, paragraph or provision of this ordinance shall be found to be inoperative, ineffective or invalid for any cause, the deficiency or invalidity of such section, paragraph or provision shall not affect any other section, paragraph or provision hereof, it being the purpose and intent of this ordinance to make each and every section, paragraph and provision hereof separable from all other sections, paragraphs and provisions. SECTION 5. This ordinance shall be read on two separate days and will become effective upon summary publication pursuant to KRS Chapter 424. ATTEST: jS� Tammara S.
