ORDINANCE NO. 81-12-2180
AN ORDINANCE AMENDING SECTIONS 7-71 AND 7-80, CREATING SECTION 7-83, AND
REPEALING SECTION 7-55 OF CHAPTER 7;-B.:UILDINGS-AND-BUILDING REGULATIONS OF THE CODE
OF ORDINANCES OF THE CITY_OF.,PADUCAH, KENTUCKY
BE .IT ORDAINED -BY THE CITY OF PADUCA :,-- KENTUCKY:
SECTION 1. That.Section 7-71., Off premise outdoor advertising sign, be
amended and reordained so..that said.section shall hearafter-read as follows:
"Sec. 7-71. Billbeard Off premise outdoor advertising --signs.

An 'off premise outdoor -advertising sign' is
A) Any outdoor sign; -display,, figure, painting, drawing, message,
plaque, poster, billboard; or any -other thing; AND
B) Designed, -intended_ or used =to advertise- or inform; AND
C) Any part of which advertising or informational content is visible
from any place on..the main travelled -way of the interstate, -system, or
any thoroughfare within .the City; AND
D) Containing a surface.-area.in excess,=of 16 square. feet.
Provided, however, that no signon which fifty percent {50%) or more of the
area of the face of any sign advertises goods sold or services performed on
the premises where -the sign is„located.,shall be deemed an 'off premise
outdoor advertising sign'
An electric sign, an illuminated sign,, -a roof sign; and -a wall bulletin
also be an off premise -outdoor-advertising sign, :in.which=event such si
shall comply with. all- provisions of both classifications into which it
falls".
SECTION 2. That Section 7-80, Off premise outdoor advertising signs -
requirements, be amended and reordained so that said section shall hereafter read as
follows:
Section 7-80.- Billbeards. Off premise outdoor advertising,signs -
requirements..

"In addition to complying with all other provisions of the Code of
Ordinance, all off premise outdoor advertising signs shall conform with the following
requirements:
"(a) Size of off premise outdoor advertising:
i. The maximum area of a face of any off premise outdoor
advertising sign shall be 400 _square feet with. -
maximum. -length of 55 feet; -inclusive of any border and trim, but
excluding the base supports, or.other.structural
members; provided however, that the foregoing
restriction shall not apply to any sign,located within
850 feet of an interstate Highway, where the maximum
area of the face of any sign shall,be 1200 s.quare.feet
ii.- When two -off' premise outdoor advertising signs are
placed back to back or V-type,,with an,angle between .
them of not more than --9-0 on7 the 'same structure each
sign face shall conform to the maximum si.ze.limitations.
(b) Spacing of off premise advising signs:
i. For the purpose of this section each side of the roadway
shalh be considered_..separately.
ii. V -type, with an angle_. between them of not more than 900
,
or ,back to back signs: on the -"same structure shall be
considered one sign.
iii.- No two off premise:.out.door advertising signs shall be
less than 300 feet apart.; provided --'-however, that if two
such signs are so placed that existing structures
prevent -both of them: -from be-in.g seen -from the public
roadway at the same time, no minimum spacing shall be
required.
(c) Height of off premise outdoor .advertising- signs:
There shall be a height restriction -of forty five.(45)
feet measured from the, g.round at the base of the sign
pp p- _ gn or 'from -grade- of the
su ."orfs ao..,the `t.o o,f the. s.i
thoroughfare immediately adjacent to the sign. which
is of greater height.
(d) "Off -premise Ioutdoor advertising signs may be
illuminated, subject to the following restrictions:
i. External lighting, such as flood lights, thin line and
goose neck reflectors are permitted, provided the
light source is directed on the face of the sign and
is effectively shielded`so..as to prevent beams or rays
of light from being directed into any portion of a
travelled way.
(e) `Pr"ox unity of off premis"e outdoor advertising signs to
Churches and residences.
i. For the purpose of this subsection, the word -'Church'
shal-l' -mean a structure designed and --constructed as a
place for the gathering of.individuals for worship,

and used at the time -of the 4 ro osed s

for such purpose.
ii. No off premise outdoor advertising sign shall be
imstalled'' upon the area of' any lot adjoining a roadway
within 300 roadway feet from any Church,or residence.
Roadway feet,' as used in "the preceding sentence, shall
Fe- the distance along the centerline of the roadway,
from a point upon that centerline perpendicular to the
nearest edge of the Church -to a point in that
center ine-p�erpendicular 'to the nearest edge of such
sign. Notwithstanding Section 7-80 (b)(i), this
-provision -applies`to-'both sides'of the -roadway.
iii. No off premise outdoor --advertising sign shall'be
constructed closer to any Church or residence, which
-does -not abut -the roadway upon which the sign is
located, than 50 feet, measured directly from the
portion of the sign nearest to the Church or
residence, to the portion of the Church or residence
nearest to the sign.

iv. The provisions of this subparagraph "e" may be waived
in writing by the action of the governing body of any
involved Church or residence. Such waiver, so
obtained, shall be notarized and filed with the
Building Inspector before any building permit is
issued or construction is initiated.
v. For the purpose of this subsection, a 'residence'
shall be deemed to include any structure, regardless
of the zone in which it is situated, designed and
constructed primarily for the purpose' of human
habitation, and in use at the time of the proposed
sign construction as a human habitation. -
(f) Any-off-Lemise outdoor advertising sign which does
not comply with this subsection may be maintained and
repaired, but may not be enlarged or moved Such'a
sign which is damaged or destroyed by any cause cannot
be repaired or 'rebuilt except in compliance_ with -the
ons

SECTION 3. That a new section, 117-83, Conflicts" be created to hereafter
read as follows:
Section 7-83. Conflict.
"Where more restrictive, the limitations of the zoning laws, Appendix A,
of the Code of Ordinances, shall take precedence over the regulations of this
section"
SECTION 4. That a new Section 7-78 (3) electric signs be created to
hereafter read as follows:

SECTION 5. That Section 7-55, maximum projection; minimum clearance above
sidewalk, be, and it is hereby, deleted in its entirety.
SECTION 6. This ordinance shall be read on two separate days and will be
effective upon publication of title and a certified summary thereof.
