HomeMy WebLinkAbout81-1-20474 ORDINANCE NO. 81-1-2047 AN ORDINANCE AMENDING SUB -SECTIONS (a) AND (d) OF SECTION 7-19, FENCING OF OUTDOOR SWIMMING POOLS, OF THE CODE OF _.ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: _. SECTION 1. That sub -section ,(a) of Section 7-19, Fencing of outdoor swimming pools, of the Code of Ordinances be amended so that same shall hear - after read as follows: "(a) Every outdoor swimming pool or family pool within the corporate boundaries _of the City of Paducah shall be completely surrounded by a fence or wall not less than Four (4) -(fine-{53-feet in height, which shall be so constructed as not to have openings, holes or gaps larger than four (4) inches in any dimension except for doors and gates, and if a picket fence is erected or maintained, the horizontal dimension shall not exceed four (4) inches,._ . A . dwelling house or accessory building may be used_ as part of such enclosure. (b) All gates or doors opening., through such enclosure shall be equipped with a self-closing and self -latching_ device for keeping the_ gates , or doors_ securely locked at all times when not in actual use, except that the door of any dwelling which forms a part of the enclosure need not be so equipped.- (c) quipped._ (c) This requirement shall be applicable to all_new swimming pools or family pools hereafter constructed, other than indoor pools, and shall apply to all existing pools which have a minimum depth of twenty-four (24) inches of water. No person in possession of land within the city, either as owner, purchaser, lessee, tenant or a licensee, upon, which is situated .a swimming pool or family pool having a minimum depth of twenty-four_ (24) inches, _ shall fail to. _provide and maintain such fence or wall as hereinprovided. (d) The department of buildings and, electrical construction and code enforcement may make modifications in individual cases, upon a showing of good cause with respect to the height, nature of location of the fence, wall, gate or latch, or the necessity therefor, provided the protection as sought hereunder is not re- duced thereby. The department of building and electrical construction and code enforcement may permit other protective devices or .structures to be used so long as the degree of protection afforded by the substitute devices or structure is ,not less than the protection afforded, by the wall,.. fence, gate and latch described_ herein. 5 The structure of the. pool itself may be used as the : required fence or wall pro- vided- that there is at least a four (4) foot" Height between th6-&ound or- the highest point accessible from the ground -to the top of the pool;' and" further provided that all steps, ladders, and other devices used for entering, 'the _pool are of the nature' that 'they will automatically recede 'or be inaccessible to a Hei=ght of at least .four (4): feet. -above the ground or `other structure accessible from the ground. The "department of; building and electrical construction and code enforcement shall -allow a reasonable period within which to -comply with the requirements `of this section. - SECTION 2 This -ordinance shall be read on two separate days: and_ will be effective upon publication - of- title and a - certified summary thereof.
