ORDINANCE NO. 84-3-2491
AN ORDINANCE AMENDING SECTION 32-5.5 "SEWER CONNECTION CHARGES" OF THE CODE OF
ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY
BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY:
SECTION 1. That Section 32-5.5, "Sewer connection charges" of the Code of
Ordinances of the City of Paducah, be amended so that said section shall hereafter read as
follows:
"Sec. 32-5. Sewer connection charges.
Nothing in this Code or the ordinance adopting this Code shall affect the
validity of any ordinance establishing the amount to be paid for connecting to the city
sanitary sewers in any area or for any property, and such ordinances are hereby recognized
as continuing in full force and effect to the extent of the establishment and the amount
of a sewer connection fee.
All fees for sewer connections shall be paid at the office of the City Trea-
surer. Where new construction is involved, payment shall be made at the time a building
permit is obtained. The City Treasurer and Building and Electrical Inspector shall
coordinate their activities and offices to insure compliance.
Fees for connecting to a sanitary sewer for which a fee has been established
shall be the amount established for a single connection or service times the following
factors:
(a) For single family residential buildings, including those wherein a home
occupation may exist, and churches, the factor shall be one.
b) For all other residential, business or industrial uses, the factor shall be
the greater of:
1) The number of lots, or fractions thereof, within the actual or re-
quired building or plant site as subdivided at the time the fee was
established, or
2) The number of lots in said site as subdivided at the time of con-
nection, if the property was not subdivided at the time the fee was
established. or
(3) One fee for the nearest hundred feet of front footage on a street
where lots face in a subdivided area, or along a street where a
connection may be made in unsubdivided areas.
Provided however, there shall be at least one connection fee per connection
regardless of lot size, and further provided, that the factor for determining a maximum
fee shall be established by dividing the front footage by fifty feet".
SECTION 2. All ordinance or parts of ordinances in conflict herewith are, to
the extent of such conflict, hereby repealed or amended.
SECTION 3. This ordinance shall be read on two separate days and will be effective
upon publication of title and a certified summary thereof.
