HomeMy WebLinkAbout85-8-2721376 ORDINANCE NO. 85-8-2721 AN ORDINANCE CREATING SECTIONS 12.9 THROUGH 12.11, FIRE PREVENTION AND PROTECTION, OF THE CODE OF ORDINANCES OF THE CITY OF PADUCAH, KENTUCKY BE IT ORDAINED BY THE CITY OF PADUCAH, KENTUCKY: SECTION 1. That Section 12.9, Definitions, is hereby created to read as follows: "Section 12.9. Definitions. For the purposes of Section 12.9 through 12.11 of the Code of Ordinances of the City of Paducah, Kentucky, the following terms, phrases, words and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future; words in the plural number include the singular number, and words in the singular number include the plural number. The word 'shall' is always mandatory and not merely directory. (a) 'Approved' is approved by the fire marshal. (b) 'City' is the City of Paducah, Kentucky. (c) 'Fire Apparatus' is equipment designated for use by the fire department. (d) 'Fire department connection' is a connection for fire department use in supplementing or supplying water for standpipes or sprinkler systems. (e) 'Fire hydrant' means a valved connection on a water supply system having (1) or more outlets and which is used to supply hose and fire department pumpers with, water. (f) 'Fire lane' means the road, path, or other passageway developed to allow the passage of fire apparatus through congested areas as designated by the fire marshal. (g) 'Fire marshal' means the fire marshal of the city. SECTION 2. That Section 12.10, Required Access for Fire Apparatus, is hereby created to read as follows: it "Section 12.10. Required Access for Fire Apparatus. (a) All premises which the city fire department may be called upon to protect in case of fire and which any portion of any building or structure is not readily accessible from public roads shall be provided with suitable gates, access roads, and fire lanes, no less than eighteen (18) feet wide, so that buildings and water supplies on the premises are at all times accessible to fire apparatus. (b) The maintenance and marking of fire lanes on privates premises shall be the responsibility of the property owner and/or persons in possession of said property." SECTION 3. That Section 12.11, Standing of Vehicles Near Fire Hydrants, Fire Department Connections or in Fire Lanes, shall hereby be created to read as follows: "Section 12.11. Standing of Vehicles Near Fire Hydrants, Fire Department Connections or in Fire Lanes. (a) It shall be unlawful for any person to park a motor vehicle within ten (10) feet on either side of a fire hydrant or fire department connection (b) It shall be unlawful for any person to park a motor vehicle on, or otherwise obstruct any fire lane. (c) Notwithstanding the provisions of paragraph (b) above, the property owner and/or person in possession of property may designate a portion of the fire lane for loading and unloading of delivery vehicles, providing the following are satisfied: (1) Plans be approved by the Fire Marshal showing adequate clearance for fire apparatus while a delivery vehicle is parked in the fire lane; (2) The loading and unloading zone be adequately signed for that purpose with a 10 -minute time limit for loading and/or unloading. 377 (d) Any person violating section (a) (b) or (c) of this section (Section 12.11) shall be fined in the amount of .Ten Dollars ($10.00) per occurrence. SECTION 4. This ordinance shall be read on two separate days and will become effective upon publication of title and a certified summary thereof.
